Call to Order and Announce a Ouorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7.00 p.m. on Tuesday, May 26, 2015, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Pledge of Allegiance Administration of Oaths -of -Office and Presentation of Certificates -of -Election City Secretary George administered the Oaths -of -Office to re-elected Councilmember Kurt Kizer, Place No. I, Councilmember Joseph Herald, Place No. 3, and Councilmember Gary L. Caplinger, Place No. 5. Mayor Terrell presented the Certificates -of -Election and offered his congratulations to them. The Councilmembers took their places at the Council bench Public Recognition 1. Individual Winner: Maya Bullock, 91' Grade, Lowery Freshman Center, 182 pairs of shoes Consent Atenda MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember Brooks, the Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda as follows: 3. Approve Minutes of the May 12, 2015, Regular Meeting. 4. Approve Minutes of the May 19, 2015, Special Called Meeting to Conduct the Canvass of the General and Special Elections. 5. Adopt an Ordinance Adopting the Amendments to the Allen City Charter Approved by the Voters of the City of Allen at an Election held on May 9, 2015. ORDINANCE NO. 3305-5-15: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF 1 ALLEN, COLLIN COUNTY, TEXAS, ADOPTING THE AMENDMENTS TO THE HOME RULE CHARTER APPROVED BY THE VOTERS OF THE CITY OF ALLEN AT AN ELECTION HELD ON MAY 9, 2015, AND PROVIDING FOR AN EFFECTIVE DATE. 6. Adopt an Ordinance Approving a Negotiated Settlement Between the Atmos Cities Steering Committee and Atmos Energy Corporation Regarding the Company's Rate Review Mechanism (RRM), ORDINANCE 3306-5-15: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING A NEGOTIATED RESOLUTION BETWEEN THE ATMOS CITIES STEERING COMMITTEE AND ATMOS ENERGY CORP., MID-TEX DIVISION REGARDING THE COMPANY'S 2014 AND 2015 RATE REVIEW MECHANISM FILINGS, APPROVING A SETTLEMENT AGREEMENT WITH ATTACHED RATE TARIFFS AND PROOF OF REVENUES, DECLARING EXISTING RATES TO BE UNREASONABLE; ADOPTING TARIFFS THAT REFLECT RATE ADJUSTMENTS CONSISTENT WITH THE NEGOTIATED SETTLEMENT; FINDING THE RATES TO BE SET BY THE SETTLEMENT TARIFFS TO BE JUST AND REASONABLE AND IN THE PUBLIC INTEREST, REQUIRING THE COMPANY TO REIMBURSE REASONABLE RATEMAKING EXPENSES, DETERMINING THAT THIS ORDINANCE WAS PASSED IN ACCORDANCE WITH THE REQUIREMENTS OF THE TEXAS OPEN MEETINGS ACT; ADOPTING A SAVINGS CLAUSE; DECLARING AN EFFECTIVE DATE; AND REQUIRING DELIVERY OF THIS ORDINANCE TO THE COMPANY AND THE ACSC'S LEGAL COUNSEL. 7, Award Bid and Authorize the City Manager to Execute the Purchase of Staffing Services for The Courses at Watters Creek with FW Services Inc. dba Pacesetter Personnel Services in the amount of 5212,576 with the Option for Two, One -Year Renewals and Award an Alternative Annual Contract with Starwood Staffing Services, to be Utilized in the Event the Primary Contractor is Unable to Fulfill Their Contractual Obligations. Authorize the City Manager to Enter into a Contract for the Upgrade and Renovation of Broadcast Equipment for the City Council Chambers and the Allen Public Library Civic Auditorium in the Total Amount of $161,331 with Digital Resources, Inc. Through the TIPS Local Cooperative Purchasing Program. Authorize the City Manager to Execute a Contract with Intermountain Slurry Seal, Inc. in the Amount of $78,011 for Micro -Surfacing of the Streets in the Allenwood Estates Neighborhood Through an Interlocal Purchasing Agreement with the City of North Richland Hills and Establish a Project Budget of $86,000. 10. Receive the Capital Improvement Program (CtP) Status Reports. 11. Receive the Summary of Property Tax Collections as of April 2015. The motion carried. Regular Agenda 12. Adopt a Resolution Establishing Rates and Fees for Commercial and Residential Solid Waste, Recycling, and Household Hazardous Waste Services. Although there was not a public hearing scheduled, Mayor Terrell allowed residents to speak on this item. Don Evans, 932 Glen Rose Court, Allen, Texas, requested an exemption for citizens 65 and over from future increases. The following individuals did not speak but supported an exemption for citizens over 65' Jack Rettig, 820 Kipling Drive, Allen, Texas; Judy Rettig, 820 Kipling Drive, Allen, Texas; Ronald J Boggan, 1007 Sandy Creek, Allen, Texas; Mike Britton, 2026 Midhurt Drive, Allen, Texas, RESOLUTION NO. 3307-5-15( : A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING FEES AND RATES FOR COMMERCIAL SOLID WASTE COLLECTION SERVICES, PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE MOTION: Upon a motion made by Councilmember Sedlacek and a second by Mayor Pro Tem Caplinger, the Council voted seven (7) for and none (0) opposed to adopt Resolution No. 3307-5-15(R), as previously captioned, that sets new rates and fees for commercial and residential solid waste, recycling, and household hazardous waste services. Items of Interest. • Council recognized a Boy Scout from Troop 4223 in attendance as a requirement in earning the citizenship in community merit badge. Executive Session The Executive Session was not held. AJourn MOTION: Upon a motion made by Councdmember Herald and a second by Councilmember Brooks, the Council voted seven (7) for and none (0) opposed to adjourn the Regular Meeting of the Allen City Council at 7:27 p in on Tuesday, May 26, 2015.
