Pledee of Alleeiance Election of Mayor Pro Tem ALLEN CITY COUNCIL REGULAR MEETING NNE 9, 2015 PAGE 2 ' Mayor Terrell called for nominations from the Council for the position of Mayor Pro Tem. Councilmember Obermeyer nominated Councilmember Caplinger with a second by Councilmember Sedlacek With no other nominations offered, Mayor Terrell closed the call for nominations. Councilmember Caplinger was re-elected as Mayor Pro Tem by a vote of six (6) for and none (0) opposed. Public Recognition 1. Citizens' Comments. 2. Presentation of the Public Art Committee's 2015 Annual Report by Chairperson Ann Carroll. Consent Agenda MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember Herald, the Council voted six (6) for and none (0) opposed to adopt the items on the Consent Agenda as follows: 3. Approve Minutes of the May 26, 2015, Regular Meeting. 4. Adopt a Resolution Authorizing the City Manager to Proceed with the Preparation for the Next Capital Improvement Program Bond Election Process. RESOLUTION NO. 3308-6-15(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING THE CITY MANAGER TO PROCEED WITH THE PREPARATION NECESSARY TO PLAN FOR THE NEXT CAPITAL IMPROVEMENT PROGRAM AND CONTINUE CITIZEN ENGAGEMENT IN THE IDENTIFICATION; AND PRIORITIZATION OF FUTURE PROJECTS, AND PROVIDE FOR AN EFFECTIVE DATE. 5. Adopt a Resolution Authorizing City Representatives to Execute Bank Depository Documents and Grant Certain Powers. RESOLUTION NO. 3309-6-15(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, DESIGNATING CITY REPRESENTATIVES FOR THE BANK DEPOSITORY. AND PROVIDING AN EFFECTIVE DATE. Conduct a Public Hearing and Adopt an Ordinance for Specific Use Permit No. 145 for a Gymnastics and Sports Training Facility Use for an Approximately 16,732 Square Foot Portion of a Building Located on Lot 2A, Block B, Brookshires Addition; Generally Located North of McDermott Drive and West of Greenville Avenue and Commonly Known as a Portion of 109 N Greenville Ave., Suite A. (The Den - Sports Performance Center) ALLEN CITY COUNCIL REGULAR MEETING JUNE 9, 2015 PAGE 3 Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3310-6-15: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING SPECIFIC USE PERMIT NO. 145 TO ALLOW A 16,732 SQUARE FOOT PORTION OF SUITE A IN THE BUILDING LOCATED ON LOT 2A, BLOCK B, BROOKSHIRE'S ADDITION (ALSO KNOWN AS 109 N. GREENVILLE AVENUE) PRESENTLY ZONED FOR SHOPPING CENTER "SC' TO BE USED FOR A GYMNASTICS AND SPORTS TRAINING FACILITY USE; PROVIDING FOR A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember Herald, the Council voted six (6) for and none (0) opposed to adopt Ordinance No. 3310-6- 15, as previously captioned, for Specific Use Permit No. 145 for a gymnastics and sports training facility use for an approximately 16,732 square foot portion of a building located on Lot 2A, Block B, Brookshires Addition; generally located north of McDermott Drive and west of Greenville Avenue and commonly known as a portion of 109 N Greenville Avenue, Suite A.
