Min - Planning and Zoning Commission - 1983 - 06/23 - RegularALLEN PLANNING & ZONING COMMISSION REGULAR MEETING 9 JUNE 23, 1983 Present: Commissioners: Jim Pendleton, Chairman Jim Wolfe, Vice Chairman Gary Koch, Secretary Glenn Andrew Bobby Glass Larry Larsen City Staff: Bill Petty, Director of Community Development Kathy Kerby, Secretary The regular meeting of the Allen Planning and Zoning Commission was called to order by Chairman Pendleton at 7:35 p.m. in the City Council Chambers of the Allen Municipal Annex, #1 Butler Circle, Allen, Texas. Approval of Minutes: June 8, 1983, Called Workshop Session June 9, 1983, Regular Meeting (Agenda Item II) Chairman Pendleton read the agenda item into the record as follows: "Approve minutes of June 8, 1983, Called Workshop Session and June 9, 1983, Regular Meeting. MOTION: Upon a motion by Commissioner Glass and second by Commis- sioner Andrew, the Commission voted Six (6) for and none (0) opposed to approve the minutes of June 8, and June 9, 1983 as submitted. The motion carried. Set a Date for Public Hearing to consider annexation and PD zoning on 183 acres by 4 -Way Development Company (Agenda Item III) Chairman Pendleton read the request into the record as follows: "Set a date for public hearing to consider recommendation of annexation and PD (Planned Development) zoning on approximately 183 acres of land as requested by 4 -Way Development Company, agent for Coronet Realty Development. Said 183 acres being located in the Peter Fisher Survey, Abstract No. 324, and being ALLEN PLANNING & ZONING COMMISSION JUNE 23, 1983 PAGE 2 Set a Date for Public Hearing to Consider Annexation and PD Zoning on 183 Acres by 4 -Way Development Company (Cont.) a resurvey of a called 183 acre tract of land conveyed by H.A. Rothfus and wife, Halye Rothfus, to Cecil 0. Patterson as recorded in Volume 397, page 335 of the Collin County Deed Records. Further described as being at the southeast corner of Exchange Boulevard and Malone Road. Zoning Case No. Z6-8-83-28" MOTION: Upon a motion by Commissioner Glass and second by Commis- sioner Andrew, the Commission voted six (6) for and none (0) opposed to set the date for public hearing on this agenda item for July 14, 1983. The motion carried. Set a Date for Public Hearing on a Request for Rezoning from AO to PD by Weston Blair (Agenda Item IV) Chairman Pendleton read the request into the record as follows: "Set a date for public hearing to consider rezoning and site plan approval on 12.8 acres of land as requested by Weston Blair. The request is to change the zoning on 12.8 acres from AO (Agricultur- al Open Space) to PD (Planned Development) to include multi -family. This tract being situated in the Peter Wetsel Survey, Abstract No. 990, Collin County, Texas. Further described as being west of State Highway 5 and north of the Cottonwood Creek Shopping Center, Phase II. Zoning Case No. Z6-15-83-29" MOTION: Upon a motion by Commissioner Glass and second by Commissioner Andrew, the Commission voted six (6) for and none (0) opposed to set the date for public hearing on this agenda item for July 14, 1983. The motion carried. Consider Final Plat of Fountain Park VI Being 37± Acres of Peter Wetsel Survey (Agenda Item V) Chairman Pendleton read the request into the record as follows: "Consider final plat of Fountain Park VI as requested by Bass Development Company. This plat being 37± acres of land out of the Peter Wetsel Survey, Abstract No. 990, situated in the City of Allen, Collin County, Texas. Zoning Case No. Z6-15-83-30" W. J. Shepherd, from Starnes and Associates in Arlington, Texas, presented the plat to the Commission for their approval. He told the Commission that there would be 136 lots on 37.4968 acres. They would include construction of Roaring Springs Blvd. to FM 2170. Bill Petty, Director of Community Development, presented a concern of Staff for a temporary turn around area for Emergency vehicles in this area. The main concern for a temporary turn around was acknowledged by ALLEN PLANNING & ZONING COMMISSION JUNE 23, 1983 PAGE 3 Consider Final Plat of Fountain Park VI Being 37° Acres of Peter Wetsel Survey, (Cont.) W.J. Shepherd and he stated that it would be no problem to make a temporary turn around in the Fountain Park VI Plat. MOTION: Upon a motion by Commissioner Andrew and second by Commissioner Glass, the Commission voted six (6) for and none (0) opposed to approve the Final Plat of Fountain Park VI contingent upon the satisfactory solution of the terminal problem and this being approved by the Staff first. The motion carried. Set a Date for Public Hearing to Consider Annexation and Rezoning on 145 Acres by Combined America Development (Agenda Item VI) Chairman Pendleton read the request into the record as follows: "Set a date for Public Hearing to consider recommendation of annexation and zoning 1303 acres and rezoning on approximately 15 acres as requested by Combined America Development. The request is to change the 15- acre tract from LR (Local Retail) to PD (Planned Development) and to establish zoning on the 130- acres and PD (Planned Development). Said 145 acre tract being situated in the John Davis Survey, Abstract 11225 and the Simon Burns Survey, Abstract 1192 in Collin County, Texas. Further described as being south of F.M. 2170, last of present Allen Heights Road, and west of the Greenwood Valley Develop- ment. Zoning Case Z6-17-83-31" MOTION: Upon a motion by Commissioner Andrew and second by Commis- sioner Wolfe, the Commission voted six (6) to none (0) opposed to set the date for public hearing on this agenda item for July 14, 1983. The motion carried. Public Hearing -Consider Rezoning on 409* Acre tract as Requested by Bass Dev. Co. (Agenda Item VII) Chairman Pendleton read the request into the record as follows: "Public Hearing -To consider rezoning on a 409- acre tract requested by Bass Development Company. Said 409* acres being situated in the R.C. Ingraham Survey, Abstract No. 462; R.C. Whisenant Survey, Abstract NO. 1012; Wm. Perrin Survey, Abstract No. 708; McBain Jamison Survey, Abstract No. 491; and the G.W. Ford Survey, Abstract No. 328, City of Allen, Collin County, Texas. Further described as being north of Chapparal Road, east of Jupiter Road, and west of Cottonwood Creek. Zoning Case No. Z5-23-83-23: ALLEN PLANNING S ZONING June 23, 1983 PAGE 4 Public Hearing -Consider Rezoning on 409+ Acre Tract as Requested by Bass Dev. Co. (Cont.) J.T. Duncan representative for Bass Development Company pre- sented the tract to the Commission. The Commission had already been given a book outlining the proposal. Some concerns of the Commission were density of homes, garden homes and the apartments. Also, the number of units per square foot, the square footage of the proposed units, the shopping center location, and the office location. Chairman Pendleton recessed the regular meeting of the Allen Planning 6 Zoning Commission at 8:15. The meeting reconvened at 8:30. Chairman Pendleton Opened the public hearing. No one appeared to speak either for or against this request. Chairman Pendleton closed the public hearing. MOTION: Upon a motion by Commissioner Andrew and second by Commis- sioner Wolfe, the Commission voted six (6) to none (0) opposed to table this item until July 14, 1983. The motion carried. Public Hearing -Consider Rezoning 41.201 Acres by Robert Carr (Agenda Item VIII) Chairman Pendleton read the request into the record as follows: "Public Hearing -To consider rezoning on 41.201 acres of land by Robert Carr, agent for John Willingham, Trustee. Request is to change the zoning from R-2 (Residential) to R-4 (Residential) on 39.071 acres and LR(Local Retail) on 2,130 acres of land. Said 41.201 acres being situated in the William Snider Survey. Abstract No. 821, and being a part of a 43.17 acre tract of land as conveyed from Earnest A. Northern, Jr. and wife, Doris D. Northern, to C.C. Gregory and W.E. Gregory by deed dated April 11, 1956, and recorded in Volume 516, pages 47-48 of the Collin County Deed Records. Further described as being the southeastern corner of F.M. 2170 and Malone Road. Zoning Case No. Z6-6-83-27" W.S. Shepherd from Starnes Association at 1200 Copeland Road, in Arlington, Texas, spoke on behalf of this agenda item. Heresented this the tract to the Commission. No one appeared to speak either for or against this request. Chairman Pendleton closed the public hearing. MOTION: Upon a motion by Commissioner Koch and second by Commis- sioner Glass, the Commission voted six (6) to none (0) opposed to approve the zoning from R-2 to R-4 on 39.071 acres and LR on 2.130 acres. The motion carried. CBD Base Committee Status Report By Commissioner Koch (Agenda Item IK) The Commission expressed concerns on this item. They were for the break down of zoning, needed study areas in restoration, traffic, and parking. This is an informational item only. There was no action taken on this item.
