A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY,TEXAS,ACCEPTING THE PETITION OF THE ALLEN FIREFIGHTERS
ASSOCIATION, IAFF LOCAL 3453 REQUESTING RECOGNITION AS THE SOLE
AND EXCLUSIVE BARGAINING AGENT FOR THE CITY OF ALLEN
FIREFIGHTERS AND DETERMINING THAT THE CITY MAY MEET AND
CONFER PURSUANT TO SUBCHAPTER C,CHAPTER 142 OF THE TEXAS LOCAL
GOVERNMENT CODE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
REPEALING CLAUSE;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on February 1, 2019 the City Secretary received a petition submitted by Allen Firefighters
Association,IAFF Local 3453 requesting recognition as the sole and exclusive bargaining agent for the covered
firefighters employed by the Allen Fire Department located in Allen, Texas for the purposes of "meet and
confer"with the City of Allen,Texas ("Petition'); and,
WHEREAS,the City Council recognizes that the petition was signed by a majority of all firefighters employed
by the City,excluding the head of the fire department and excluding exempt employees; and,
WHEREAS,the City Council desires to grant recognition the Allen Firefighters Association,IAFF Local 3453
as the sole and exclusive bargaining agent for the covered firefighters employed by the Allen Fire Department
located in Allen Texas for purposes of "meet and confer" under Subchapter C, Chapter 142 Texas Local
Government Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY,TEXAS,THAT:
SECTION 1. The City Council,pursuant to Section 142.103(1)of the Texas Local Government Code,hereby
grants recognition of the Allen Firefighters Association, IAFF Local 3453 as requested in the Petition and
determines that the City may meet and confer pursuant to Subchapter C, Chapter 142 of the Texas Local
Government Code without conducting an election by the voters in the City under Section 142.105 of the Texas
Local Government Code.
SECTION 2. Should any word,sentence,paragraph,subdivision,clause,phrase or section of this Resolution,
be adjudged or held to be void or unconstitutional,the same shall not affect the validity of the remaining portions
of said Resolution, which shall remain in full force and effect.
SECTION 3. All prior Resolutions of the City of Allen,Collin County,Texas,in conflict with the provisions
of this Resolution, be and the same are hereby repealed; provided, however, that all other provisions of said
Resolutions not in conflict with the provisions of this Resolution shall remain in full force and effect.
SECTION 4. This Resolution shall take effect upon its adoption.
