Min - Planning and Zoning Commission - 1985 - 09/04 - WorkshopALLEN PLANNING & ZONING COMMISSION WORKSHOP MEETING SEPTEMBER 4, 1985 Present: Commissioners: Bobby Glass, Chairman Jerry Wilson, Vice Chairman Wayne Armand, Secretary Jack Pennington John Garcia Eileen Karlsruher Ken Browning Staff: Bill Petty, Director of Community Development Tom Keener, Development Coordinator Jon McCarty, City Manager Mark Thornton, Director of Parks & Recreation Ron Gentry, Fire Chief Richard Carroll, Police Chief Nadine Hopps, Secretary The workshop meeting of the Allen Planning & Zoning Commission called to order by Chairman Bobby Glass at 7:34 P.M. at the Allen Municipal Annex, One Butler Circle, Allen, Texas. Workshop Barnes Development (Agenda Item II) Mr. Jeff Barnes of Barnes Development reviewed the last workshop of Wednesday, August 14, 1985, and answered some of the concerns expressed at the last workshop by the Commission. He spoke in reference to private streets, alignment of Bethany Road, traffic, population study, and the park and community facilities area. ALLEN PLANNING & ZONING COMMISSION SEPTEMBER 4, 1985 PAGE TWO Workshop Barnes Development (Continued) (Agenda Item II) Mr. McCarty advised Mr. Barnes that staff had concerns in the following areas: 1. Traffic Control a. Enforcement b. Signage C. Control 2. Access points limited to only 2 a. Response Time b. Convenience c. Legal Aspect of Access Fire Chief Ron Gentry stated that due to the structure and street design in this development their response time would not be sufficient. He was concerned about the financial responsibility of repairing the fire trucks and "crash -through" gates if the fire department had to enter. Additionally, he did not want to have to rely on a security officer for entrance during an emergency. Police Chief Richard Carroll commented that he would have no jurisdiction in a private development. They cannot enforce any traffic laws there because there are virtually none. They can only enforce the law in situations where "Breach of the Peace" occurred. Chief Carroll contacted other private develop- ments to see how law enforcement was handled. Seis Lagos, east of Allen, has had a lot of problems with enforcement. The private streets would have to be maintained and the upkeep of the development would be done by the Property Owners Association. The Property Owners Association would commonly own the development. Therefore, they would be responsible for activities within the development. ALLEN PLANNING & ZONING COMMISSION SEPTEMBER 4, 1985 PAGE THREE Workshop Barnes Development (Continued) (Agenda Item II) Mr. Bland Pittman, Planner, said that they wanted to work with the Police, Fire, and any public services of the City in regard to this development. They wanted to deed restrict this area so that the Police, Fire, and other regulatory standards would be applicable to this development. Mr. Mark Thornton explained his concerns about this development. He said that this area is zoned to be dedicated to the City for a community facility. This area is also in the 100 -year flood plain and they are doing a green belt study at this time at a cost of $10,000 to find the best use for this area. Mr. Thornton said that he would gather input from the Parks Board and would give the Planning & Zoning an update at their next regular meeting. Some of the other issues addressed by Mr. Jeff Barnes, Mr. Art Barnes, and Mr. Bland Pittman were: The Aligning of Bethany Road - They proposed to move the road over approximately 1,000 feet to the east. This new location of the road would better serve their develop- ment and the other adjoining property owners. Mr. Pittman said Mrs. McDermott expressed that she did not want to have the trees moved from their natural setting, and he claimed that realigning the road would save these trees. Traffic Study and a Population Study is being done by Jack Hatchell of Barton -Ashman and Associates. It will be ready soon and they will present it at a later date. Private Streets - They would be maintained and have to be approved by the engineering department of the City just like all of the public streets in the City. Any zoning will be addressed at the public hearing and not before. at 15:15 p.m. Commission recessed/this workshop until Wednesday, September 18, 1985 at 7:30 P.M. in the open space office area of Allen Municipal Annex.
