Leeper, Planner Dennis Abraham, Civil Engineer David Dodd, City Attorney's Office REGULAR AGENDA Call to Order and Announce a Quorum is Present With a quorum of the Commissioners present, the Allen Planning & Zoning Commission was called to order at 7:00 p.m. by Chairman Obermeyer, at the Allen City Hall Council Chambers, 305 Century Parkway, Allen, Texas. Update on Council Action Ms. Marina Sukup, Director of Planning & Development, updated the Commission on the Council action from their February 21, 2002 meeting. • Street Image Study — Continued to March 7, 2002 • Mini warehouses on East Main St. (PD 89) - Approved • Mini warehouses in Lost Creek Village (PD 69) - Denied • Charles Key Property — Continued to March 7, 2002 • Citizen Survey — Update was given to the Council by David Hoover. CONSENT AGENDA 1. Approve Minutes of February 14, 2002 Regular Meeting Motion: Upon a motion by Commissioner Harvey, and a second by Commissioner Grimes, the Commission voted 4 IN FAVOR and 0 OPPOSED to approve the Consent Agenda. Detailed Site Plan/Preliminary Plat— Consider a Detailed Site Plan/Preliminary Plat for Trails of Suncreek, Lot 1, Block A, being 14.144± acres of land situated in the GW Ford Survey, Abstract No. 326, Joseph H. Wilcox Survey, Abstract No. 775, City of Allen, Collin County, Texas; located at the northwest corner of Alma Drive and Hedgcoxe Road. Mr. David Hoover, Assistant Director of Planning, presented the item to the Commission. He stated that the applicant proposes to construct an apartment complex in compliance with the provisions of Planned Development 31 zoning requirements. The zoning allows for a density of 24 units per acre; however; the applicant is proposing a total of 246 units on 14.144 acres, which is 18 units per acres Mr. Hoover stated that staff has reviewed the site plan/preliminary plat and it conforms to the Allen Land Development Code. Staffmcommends approval. Frank Trabold, Developer, 4949 Westgrove, Dallas, stated that they would save as many trees as possible. Motion: Upon a motion by Commissioner McGregor, and a second by Commissioner Caplinger, the Commission voted 5 I FAVOR and 0 OPPOSED to approve the Detailed Site Plan/Preliminary Plat for Trails of Suncreek. The motion carried. 3. Preliminary Plat —Consider a Preliminary Plat for Lost Creek Village Addition, Lots 1, 2, 3, and 4, Block I, being 8.536± acres situated in the J. Roberts Survey, Abstract No 777, City of Allen, Collin County, Texas, located at the southwest comer of Stacy Road and Angel Parkway .j Mr. Hoover presented the item to the Commission, and stated that as a result of Council action to deny the mini storage, the applicant is requesting a preliminary plat on 4 lots at this time. He stated that all requirements of the Allen Land Development Code have been met and there are no unresolved issues. Staff recommends approval of the Preliminary Plat. Commissioner McGregor questioned the timing of the construction of the screening wall. Mr. Hoover stated that CVS Pharmacy would be under construction soon. The wall will be constructed before they get their Certificate of Occupancy if no construction has begun on the southern lot. If the construction of the development on the southern lot is started prior to the completion of CVS, then the wall will be built at the time of completion of construction on the southern lot. Commissioner McGregor stated that it would be prudent to establish the timing for construction of screening walls as part of the Land Development Code to ensure equity and consistency in implementation. Ms. Sukup stated that some changes to the Allen Land Development Code will be made along with the update to the Comprehensive Plan, and that this will be reviewed at that time. Bill Grant, Oakmont Capital, managing partner for the ownership, 5700 W Plano Parkway, stated he would answer any questions. None were presented. Motion: Upon a motion by Commissioner Caplinger, and a second by Commissioner McGregor, the Commission voted 5 I FAVOR and 0 OPPOSED to approve the Preliminary Plat for Lost Creek Village Addition, Lots 1, 2, 3 and 4. Final Plat — Consider a Final Plat for Lost Creek Village Addition, Lot 1, Block 1, being 1.9741 acres of land situated in the J. Roberts Survey, Abstract No. 777, City of Allen, Collin County, Texas; located at the southwest comer of Stacy Road and Angel Parkway Mr. Hoover presented the item to the Commission. He stated that off-site easements by separate instruments have been provided to ensure adequate access and utility easements during the development of the entire tract. Staff recommends approval. Commissioner McGregor questioned the difference in acreage between the preliminary plat and this final plat. It was noted that it was due to right-of-way dedication, and that the final plat was correct. Motion: Upon a motion by Commissioner Grimes, and a second by Commissioner Caplinger, the Commission voted 5 I FAVOR and 0 OPPOSED to approve the Final plat for Lost Creek Village Addition, Lot 1. The motion carried. 5. Final Plat— Consider a Final Plat for Lost Creek Village Addition, Lot 2, Block 1, being 1.5364± acres of land situated in the James Roberts Survey, Abstract No. 777, City of Allen, Collin County, Texas; located at the southwest comer of Stacy Road and Angel Parkway Mr. Hoover presented the item to the Commission. He stated that the lot is in conformance with the Allen Land Development Code and staff recommends approval. Motion: Upon a motion by Commissioner McGregor, and a second by Commissioner Harvey, the Commission voted 5 IN FAVOR and 0 OPPOSED to approve the Final Plat for Lost Creek Village Addition, Lot 2. The motion carried. 6. Public Hearing — Conduct a public hearing and consider an ordinance to change the zoning from AO-Agriculture/Open Space to CC -Corridor Commercial on property being 96.636± acres of land situated in the G. Phillips Survey, Abstract No. 701, and the Joseph Dixon Survey, Abstract No 276, City of Allen, Collin County, Texas; further described as being located west of US 75, north of Stacy Road. Mr. Hoover stated that the property was annexed in 1994 and zoned "AO" - Agriculture/Open Space at that time. The applicant is requesting Corridor Commercial zoning that is consistent with the Comprehensive Plan. Staff recommends approval of the request. Commissioner McGregor questioned if this was consistent with the finding of the SH 121 ad hoc committee, and Mr. Hoover stated that is was. The proponent was present but indicated he had nothing to add. Chairman Obermeyer opened the public hearing. With no one wishing to speak, the public hearing was closed. Motion: Upon a motion by Commissioner Caplinger, and a second by Commissioner Grimes, the Commission voted 5 IN FAVOR and 0 OPPOSED to approve the request. The motion carried. Public Hearing — Conduct a public hearing and consider an ordinance to amend Planned Development No. 3 to allow a full service day care facility on Tract At, as an additional permitted use. The property is 1.148± acres of land situated in the William Perrin Survey, Abstract No. 708, Lot 2, Tract AI, Allen Business Centre, City of Allen, Collin County, Texas; located northeast of Prestige Circle and Bethany Drive. Mr. Hoover stated that after further research and discussion, Staff believes, and the applicant concurs, that a better method to obtain the desired results is to request a zone change for the property from the PD -LI to straight Local Retail. This will allow for the day care facility and other uses more appropriately suited on the adjacent property. This process would entail a re -noticing to the adjacent property owners and a change in the requested application. This would he brought back to the Commission at that time. Chairman Obermeyer opened the public hearing. With no one wishing to speak, the public hearing was closed. No action is required.
