Leeper, Planner Pam Conway, Administrative Secretary Dennis Abraham, Civil Engineer Pete Smith, City Attorney REGULAR AGENDA Call to Order and Announce a Quorum is Present: With a quorum of the Commissioners present, Chairman Caplinger called the meeting to order at 7:00 p.m. in the City Hall Council Chambers, 305 Century Parkway Director's Report on December 10, 2002 Council Action: Ms. Marina Sukup, Director of Planning & Development, advised that Council was briefed at December 3, 2002 workshop on the 2002-2022 Comprehensive Plan, noting that the Plan would be on the Council's agenda January 28, 2003 for a Public Hearing. CONSENT AGENDA 1. Approve Minutes of December 3, 2002, Regular Meeting 2. Final Plat -Consider a Final Plat for Brookhollow, being, 12.384± acres out of the R. C. Whisenam Survey, Abstract No. 1012, City of Allen, Collin County, Texas; located at the northwest corner of Chaparral Road and Allen Heights Drive. 3. Request for Extension — Consider a 60 -day Extension for filing the Final Plat Lost Creek Ranch, Phase 3 PLANNING & ZONING COMMISSION DECEMBER 17, 2002 PAGE 2 Motion: Upon a motion by Commissioner Grimes, and a second by Commissioner Wendland, the Commission voted 5 IN FAVOR and 0 OPPOSED to approve the Consent Agenda. The motion carried. REGULAR AGENDA 4. Public Hearing/Replat - Consider a Replat of a Replat of Lot 2 on a part of Block A. Allen McDermott Square, for Advantage Self Storage, situated in the Catherine Parsons Survey, Abstract No. 711, City of Allen, Collin County, Texas; located east of the northeast comer of McDermott Drive and Alma Drive. Mr. David Hoover, Assistant Director of Planning & Development, presented the item to the Commission, noting that a replat requires a public hearing. Mr. Hoover stated that the replat meets all the requirements of the Allen Land Development Code and staff is recommending approval. Chairman Caplinger Opened the Public Hearing. With no one wishing to speak, the Public Hearing was closed. Motion: Upon a motion by Commissioner Grimes, and a second by Commissioner Sedlacek, the Commission voted 5 IN FAVOR and 0 OPPOSED to approve the request. The motion carried. 5. Preliminary Plat — Consider a Preliminary Plat for the Custer Hedgcoxe Addition, Lots 1, 2, and 3 Block A, being 15.0638 f acres situated in the Grizzell Kennedy Survey, Abstract No. 499, City of Allen, Collin County, Texas; located at the northeast comer of Custer Road and Hedgcoxe Road. Mr. Hoover explained that, with the exception that the main driveway for Lot 1 which takes access from the `old" Custer Road right-of-way, the preliminary plat is consistent with the approved General Development Plan (completed in conjunction with the zoning). He stated that the Old Custer roadway has been relinquished by TxDOT to the City of Allen which would allow for the change in driveway access to align with the present median break on Hedgcoxe. Mr. Hoover stated that staff recommends approval subject to the following conditions prior to submittal of a Final Plat: (1) Corner clips will be needed at all drive locations. (2) Proposed Trail alignment will have to be staked out on site to ensure that constmctton will meet all applicable standards, as well as provide adequate access for maintenance of floodplain area. (3) Secondary access issues will have to be arranged to satisfy emergency service needs (4) All utility issues will need to be adequately addressed for all lots, including stub outs to Exxon site at the hard corner. (may require additional easements) (5) Deceleration lanes may be required on Lots 1 and 2 when they are developed, depending on the intensity of the development. PLANNING & ZONING COMMISSION DECEMBER l7, 2002 PAGE 3 (6) Landscape easements will need to be included on the Final Plat. Commissioner Woodland questioned the condition of Old Custer Road. Mr. Hoover explained that originally TxDOT was the owner, but that it has been relinquished to the City of Allen. Motion: Upon a motion by Commissioner Harvey, and a second by Commissioner Woodland, the Commission voted 5 IN FAVOR and 0 OPPOSED to approve the request with the following conditions being met prior to final plat submittal: 1. Corner clips will be needed at all drive locations. 2. The motion carried. 7 Public Hearing — Consideration of an ordinance changing the caning on 45 738 t acres of land from AO -Agricultural and Open Space to CC -Corridor Commercial for Mixon Investment Co., Inc. The property is situated in the Shadrick Jackson Survey, Abstract No. 489, City of Allen, Collin County, Texas; located near the southeast corner of Custer Road and SH 121. Mr. Hoover stated that there are no unresolved issues associated with this request, although there is an existing 30 -foot prescriptive right of way that the applicant will abandon as part of the development process. The roadway is not necessary according to the Thoroughfare Plan and Staff has no objections to the request. Staff recommends approval of the request. Chairman Caplinger Opened the Public Hearing. Bary Knight. 5400 Renaissance Tower, Dallas, representing the Mixon Investment Co., Inc. was present for any questions. With no one else wishing to speak, the Public Hearing was closed. Motion: Upon a motion by Commissioner Wendland, and a second by Commissioner Grimes, the Commission voted 5 IN FAVOR and 0 OPPOSED to approve the request. The motion carried. PLANNING & ZONING COMMISSION DECEMBER 17, 2002 PAGE 4 8. Public Hearing —Consider a request for Specific Use Permit (SUP) No. 93 for a Restauram/Private Club for Mi Casa Tex-Mex Grill. The property is a 3.441 t acre tract of land being Lots 1, 3, 6, 7, and 8 of the Custer/McDermott Addition, City of Allen, Collin County, Texas; located at 2023 W McDermott, Suite #220. Mr. Hoover presented the item to the Commission. The applicant proposes to remodel an existing lease space on the property site. No outdoor dining is proposed and access to the club is through the main entrance. There is no drive-through service. The windows will be screened to prevent a view of the bar from outside. The proposal meets the requirements of the Allen Land Development Code. Staff recommends approval. Chairman Caplinger Opened the Public Hearing. With no one wishing to speak, the Public Hearing was closed. The applicant, Ruben Cerda, 2425 W Walnut Street, Garland, was present for any questions. Motion: Upon a motion by Commissioner Sedlacek, and a second by Commissioner Harvey, the Commission voted 5 IN FAVOR and 0 OPPOSED to approve the request. The motion carried. 9 Public Hearing— Hold a Public Hearing and consider a Recommendation to City Council on the 2002-2022 Comprehensive Plan Ms. Sukup requested that any action by the Commission be deferred to the January meeting as the Parks Department has requested additional time for Parks Board review Chairman Caplinger Opened the Public Hearing. Tim Dentler, Assistant Director of Parks & Recreation, stated that he is reviewing the Parks section of the Comprehensive Plan and the Planning & Development staff has offered to attend the Parks Board meeting to assist with that review. Motion: Upon a motion by Commissioner Wendland, and a second by Commissioner Grimes, the Commission voted 5 IN FAVOR and 0 OPPOSED to continue the Public Hearing to the January 7, 2003 meeting. The motion carried. 10. Presentation — Presentation concerning the requirements of Phase II of the National Pollution Discharge Elimination Systems (NPDES) currently administered by the Texas Commission on Environmental Quality (TCEQ) and the status of the City's permit application. Dennis Abraham, P.E., Civil Engineer, gave a presentation to the Commission regarding Phase II �A of the National Pollution Discharge Elimination Systems, and the status of the City's permit L application. PLANNING & ZONING COMMISSION DECEMBER 17, 2002 PAGES The Commission questioned whose responsibility it was for enforcement and what type of training would be required. Mr. Abraham stated that the Engineering Inspectors, Building Inspectors and Code Enforcement personnel would be responsible for the enforcement; and that the North Texas Council of Governments has workshops to address the training. It was also noted that no changes in the Allen Land Development Code would be required at this time, and, regarding cost, the Drainage and Utility fund is already established — however, the final costs have not yet been determined. Mr. Abraham stated that TCEQ will monitor this process and if the City doesn't comply there could be fines. Ms. Sukup noted that the Community Facilities section of the Comprehensive Plan points towards these same goals. Mr. Abraham stated that the Planning Commission will hold a public hearing on this subject on January 21, 2003 and the City Council on January 28, 2003.
