Items of Interest 2.1 Update Regarding the City of Allen Parks, Recreation, and Open Space Master Plan 2021-2031. 2.2 Committee Updates from City Council Liaisons. 2.3 Questions on Current Agenda. 3. Consent Agenda MOTION: Upon a motion made by Councilmember Corneae and a second by Councilmember Clemencich,the Council voted seven(7)for and none(0)opposed to adopting all items on the Consent Agenda as follows: 4.1 Approve Minutes of the February 8,2022,Regular City Council Meeting. 4.2 Adopt an Ordinance Amending the Code of Ordinances by Amending Chapter 2,Article VIII, "Code of Conduct"to Amend Section 2-221 "Complaints Against Officers" and to Add Section 2-226"Acknowledgment of Code of Conduct." ORDINANCE NO.3892-2-22: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN,COLLIN COUNTY,TEXAS,AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 2, ARTICLE VIII, "CODE OF CONDUCT" BY AMENDING SECTION 2-221 "COMPLAINTS AGAINST OFFICERS" TO PROVIDE FOR THE APPOINTMENT OF OUTSIDE COUNSEL TO INVESTIGATE COMPLAINTS AND FOR • RESOLUTION OF COMPLAINTS IF OFFICER RESIGNS OR NO LONGER HOLDS OFFICE OR POSITION; BY ADDING SECTION 2-226 "ACKNOWLEDGEMENT OF CODE OF CONDUCT"TO REQUIRE CITY SECRETARY TO PROVIDE COPY OF THE CODE OF CONDUCT TO OFFICERS AND TO OFFICER ACKNOWLEDGEMENT THEREOF; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; _ PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. 4.3 Adopt a Resolution Amending the City Council's Rules of Order and Procedure. The motion carried. 5. Regular Agenda Mayor Fulk announced Agenda Items 5.1 and 5.2. 5.1 Conduct a Public Hearing and Adopt an Ordinance to Amend the Development Regulations for Area "1" of Planned Development No. 3 with a Base Zoning of Light Industrial "LI" to allow a Winery Use by Specific Use Permit for Lot 3R2 at Allen Business Centre Addition,Located at 13 Prestige Circle. (Vinum 55-PD Amendment) 5.2 Conduct a Public Hearing and Adopt an Ordinance to Grant a Specific Use Permit for Winery Use of an 8,530±square-foot Portion of a Building Located at 13 Prestige Circle. (Vinum55- SUP) Mayor Fulk opened the public hearings for Agenda Items 5.1 and 5.2 and asked anyone wishing to speak for or against these items to do so,at this time. With no one speaking,Mayor Fulk closed the Public Hearings. ORDINANCE NO.3894-2-22:AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP, AS PREVIOUSLY AMENDED, BY AMENDING THE REGULATIONS RELATING TO THE USE AND DEVELOPMENT OF LOT 3R2, ALLEN BUSINESS CENTRE ADDITION, LOCATED WITHIN AREA"1" OF PLANNED DEVELOPMENT PD NO.3 WITH A BASE ZONING OF LIGHT INDUSTRIAL "LI"; PROVIDING FOR A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000)FOR EACH OFFENSE;AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Schulmeister and a second by Councilmember Cornette, the Council voted seven (7) for and none (0) opposed to approving Ordinance No. 3894-2-22, as previously captioned, to amend the Development Regulations for Area"1"of Planned Development No.3 to allow winery use by Specific Use Permit at Allen Business Centre. The motion carried. ORDINANCE NO.3895-2-22:AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP AS PREVIOUSLY AMENDED BY GRANTING SPECIFIC USE PERMIT NO. 182 AUTHORIZING AN APPROXIMATELY 8,530± SQUARE FOOT PORTION OF A BUILDING LOCATED ON LOT 3R2, ALLEN BUSINESS CENTRE ADDITION, PRESENTLY LOCATED WITHIN AREA "1" OF PLANNED DEVELOPMENT "PD"NO. 3 LIGHT INDUSTRIAL "LI" TO BE USED FOR A WINERY USE; PROVIDING A CONFLICTS RESOLUTION CLAUSE; PROVIDING A ALLEN CITY COUNCIL REGULAR MEETING FEBRUARY 22,2022 PAGE 4 SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000)FOR EACH OFFENSE;AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Shafer and a second by Councilmember Clemencich, the Council voted seven (7) for and none (0) opposed to approving Ordinance No. 3895-2-22, as previously captioned,to approving Specific Use Permit No. 182 for a winery on Lot 3R2 at the Allen Business Centre located at 13 Prestige Circle. The motion carried. 5.3 Authorize the City Manager to Execute a Contract with Phoenix 1 Restoration and Construction, LLC, for Disassembly,Relocation, and Reconstruction of a Historic Barn from Anna,Texas,to the Allen Heritage Village in the Amount of$326,600. MOTION: Upon a motion made by Councilmember Shafter and a second by, Councilmember Cornette,the Council voted six(6)for and one(1)opposed with Councilmember Meis casting the negative vote, to authorize the City Manager to execute a contract with Phoenix 1 Restoration and Construction, LLC, for Disassembly, Relocation, and Reconstruction of a Historic Barn from Anna, Texas,to the Allen Heritage Village in the amount of$326,600. The motion carried. 5.4 Award Bid and Authorize the City Manager to Execute an Agreement with Criterion Contractors, Inc., for Installation of Parking Lot Walls and Fencing at Police Headquarters in the Amount of$610,000. MOTION: Upon a motion made by Mayor Pro Tern Brooks and a second by Councilmember • Schulmeister, the Council voted seven(7) for and none (0) opposed to award bid and authorize the City Manager to execute an agreement with Criterion Contractors, Inc., for installation of parking lot walls and fencing at Police Headquarters in the amount of$610,000. Other Business 6.1 Calendar. 6.2 Items of Interest. • Mayor Pro Tem Brooks announced upcoming community events: February 26 — Allen ISD Eagle Run hosted by the Foundation For Allen Schools; February 25-27 — Collin County Home and Garden Show at the Credit Union of Texas Event Center; and,March 5 —Searching Allen/Sam Bass Day at the Allen Depot hosted by the Allen Heritage Guild. • Council congratulated Officer Chance Graves as the recipient of the Community Award from Allen Special Olympics Delegation. • Councilmember Schulmeister announced the Allen Community Development Corporation celebrated its 25th anniversary which was established by voters in 1996. He encouraged the public to attend the Townhall meeting in March to present projects to enhance the Allen community. • Mayor Fulk recognized the Fire and Police hockey teams for playing in the 12th Annual Fire and Ice game benefiting the Allen Public Safety Recovery Fund. He congratulated the Fire team for their win this year. ALLEN CITY COUNCIL REGULAR MEETING FEBRUARY 22,2022 PAGE 5 • Mayor Fulk announced the public art dedication for the Perpetual Flux featured at the Credit Union of Texas Event Center was held on Monday. • Mayor Fulk announced Allen Special Olympics as his Charity of the Month. • Mayor Fulk recognized the community impact of Ella Jo Adams who recently passed away. 7. Executive Session The Executive Session was not held. 7.1 Reconvene and Consider Action on Items Resulting from Executive Session. 8. Adjournment MOTION: Upon a motion made by Councilmember Shafer and a second by Councilmember Cornette,the Council voted seven(7) for and none(0)opposed to adjourn the Regular Meeting of the Allen City Council at 8:06 p.m. on Tuesday, February 22, 2022.
