R-3662-5-19 RESOLUTION NO.3662-5-19(R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, DECLARING THE RESULTS OF THE GENERAL AND SPECIAL ELECTIONS OF THE CITY OF ALLEN HELD MAY 4, 2019, FOR CITY COUNCILMEMBERS AND A PROPOSED AMENDMENT TO THE HOME RULE CITY CHARTER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it is hereby found and determined that notice of the elections was duly given in the form, manner and time required by law, and said elections were in all respects legally held and conducted in accordance with applicable laws of the State of Texas and the proceedings calling and governing the holding of such election; and, WHEREAS, it is imperative to consider the returns of the elections held on May 4, 2019, for the purpose of electing the hereinafter named officials, and to consider returns of a proposition for the issuance of an amendment to the Home Rule City Charter; and, WHEREAS, the returns of said elections have been duly and legally made and submitted to the City Council for canvassing, and a tabulation of the returns for the polling place and for early voting, as canvassed and tabulated by this governing body as follows: EARLY VOTES REGULAR VOTES TOTAL VOTES CAST CAST CAST COUNCILMEMBER PLACE NO.4 Melanie Hughes 2,556 1,273 3,829 Chris Schulmeister 2,961 1,135 4,096 COUNCILMEMBER PLACE NO.6 Jon Toney • 1,430 788 2,218 Baine Brooks 4,013 1,549 5,562 PROPOSITION A-1: Shall the Home Rule Charter of the City of Allen,Texas be amended to provide term limits for the mayor and council members consisting of: (i) no person may serve as a member of the city council either as mayor or as a council member for more than twelve (12) years; (ii) no person who has ever served twelve (12) or more years on the city council either as mayor or council member may be elected to the city council either as mayor or as a council member; (iii) no person may serve either as mayor or as a council member for more than two(2) consecutive terms with the exception that the mayor may run for the office of council member and a council member may run for the office of mayor, provided such person has not already served twelve (12) or more years on the city council; and (iv) a person ineligible to run for the office of mayor or council member because of having already served two (2) consecutive terms is eligible to run for the office of mayor or council member after the expiration of one full term following the expiration of the last elected term of office, provided such person has not already served twelve(12)or more years on the city council? "FOR" 3,767 1,722 5,489 "AGAINST" 2,213 874 3,087 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY,TEXAS,THAT: SECTION 1. Said elections were duly called, that notice of said elections were given in accordance with law, and that said elections were held in accordance with law, and that Chris Schulmeister was duly elected Councilmember, Place No. 4 and that Baine Brooks was duly elected Councilmember, Place No. 6. Above named parties are hereby declared duly elected to those respective offices, subject to the taking of their oaths as provided by the laws of the State of Texas. SECTION 2. It is determined that Proposition No. A-1 allowing for an amendment by a majority of the qualified voters shall become a part of the City of Allen Home Rule Charter. SECTION 3. It is further found and determined that in accordance with the order of this governing body, the City Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located in the City Hall, a place convenient and readily accessible to the general public, and said notice having been so posted and remaining posted continuously for at least 72 hours preceding the scheduled time of said meeting. SECTION 4. This resolution shall become effective immediately from and after its passage.
