Director's Report is attached for action taken on the Planning & Zoning Commission items by City Council at the May 10, 2011 regular meeting. Consent Aeenda 2. Approve minutes of the May 3, 2011 regular meeting 3. Final Plot — Consider a request for a Final Plat for The Preserve, being 32.8581 acres located north of McDermott Drive and west of Lakeway Drive. (FP -4/11/11-115) [The Preserve] 4. Extension Requesi — Consider a request for an extension for filing a Combination Plat for The Dentist of Allen The property is 4.945+ acres located at the northeast comer of Exchange Place and US75. (FP-2/4/11-105)[The Dentist of Allen] 5. Extension Request — Consider a request for an extension for filing a Combination Plat for Allen Assisted Living. The property is 20+ acres in the City of Allen, Texas; located northwest of Greenville Avenue and Prestige Circle. (FP -2/1/11-102) [Allen Assisted Living] Item #3 was removed from the Consent Agenda for separate consideration. Motion: Upon a motion by 2n' Vice Chairman Dreggors, and a second by Commissioner Kizer, the Commission voted 6 IN FA VOR, and 0 OPPOSED, to approve Items 2, 4 and 5 of the Consent Agenda. The motion carried. Agenda Item #3: Final Plat — Consider a request for a Final Plat for The Preserve, being 32.858± acres located north of McDermott Drive and west of Lakeway Drive. (FP - 4/11/11 -115) [The Preserve] Commissioner Platt stated a concern with the lots draining properly. Helen -Eve Liebman, Senior Planner, stated the typical lot detail shown on the Final Plat was provided on the Preliminary Plat. Provisions for lot dimensions were also outlined in the PD. Motion: Upon a motion by I" Vice Chairman Cocking, and a second by 2°" Vice Chairman Dreggors, the Commission voted 6 IN FAVOR, and 0 OPPOSED, to approve the Final Plat for The Preserve. The motion carried. Regular Agenda Agenda Item 46: Public Hearing — Conduct a Public Hearing and consider amendments to the Allen Land Development Code amending Article III, Building Regulations by adopting the 2009 Editions of the International Building Code, International Fire Code, International Residential Code, International Mechanical Code, International Plumbing Code, International Fuel Gas Code, and International Energy Conservation Code with local amendments to each of said codes, and the 2011 Edition of the National Electrical Code, with local amendments. Bret McCullough, Building Official, spoke to the Commission. Currently adopted construction codes in the city are the 2006 Edition of the International Building Code, International Fire Code, International Residential Code, International Plumbing Code, International Mechanical Code, International Fuel Gas Code, International Energy Conservation Code and the 2005 National Electrical Code, which were adopted March 11, 2011 Proposed Codes are the 2009 Editions of the International Building Code, International Fire Code, International Residential Code, International Mechanical Code, International Fuel Gas Code, International Plumbing Code, International Energy Conservation Code, and the 2011 Edition of the National Electrical Code. State law already mandates that all cities within the state adopt the International Residential Code for residential construction and the International Building Code for commercial construction Included with the adoption of the 2009 International Codes and 2011 National Electrical Code is an amendment package recommended by the NCTCOG Regional Codes Coordinating Committee. Since 1992, the City of Allen, along with our neighboring cities has adopted the NCTCOG Regional Amendment Package in order to facilitate regional consistency in the enforcement and interpretation of building codes. Staff recommends approval. 2n° Vice Chairman Dreggors asked for clarification on how the CO2 alarms would be wired in each bedroom. Mr. McCullough stated he does not believe the alarms are required to be interconnected Chairman Wendland opened the Public Hearing. With no one wishing to speak Chairman Wendland closed the Public Hearing. Commissioner Kizer asked if the Commission is still fulfilling its duties while heavily relying on staffs research and recommendations of the proposed amendments Chairman Wendland answered that since there are so many changes proposed it is appropriate to rely on staff when considering these amendments. Commissioner Kizer asked for clarification on how consistent the codes will be with other cities/areas. Mr. McCullough stated that there are very few variations to the NCTCOG Regional Amendment Package. The recommendation is adopted for the most part. Motion: Upon a motion by Commissioner Platt, and a second by 2"" Vice Chairman Dreggom, the Commission voted 6 IN FAVOR, and 0 OPPOSED, to recommend approval of the amendments to the Allen Land Development Code amending Article III, Building Regulations by adopting the 2009 Editions of the International Building Code, International Fire Code, International Residential Code, International Mechanical Code, International Plumbing Code, International Fuel Cas Code, and International Energy Conservation Code with local amendments to each of said codes, and the 2011 Edition of the National Electrical Code, with local amendments. The motion carried. Agenda Item N7: Preliminary Plat — Consider a request for a Preliminary Plat for Fall Creek, being 38.814± acres located south of Ridgeview Drive and west of Twin Creeks Drive. (PP -1/24/11-101) [Fal]Creek] Helen -Eve Liebman, Senior Planner, spoke to the Commission. The property is located south of Ridgeview Drive and west of Twin Creeks Drive. The property is zoned Single Family Residential R-5 The Preliminary Plat shows one hundred and twelve (1 l2) residential lots and four (4) open space lots to be maintained by the HOA. It is proposed for the development to be built in two phases. The Preliminary Plat has been reviewed by the Technical Review Committee and meets the requirements of the Allen Land Development Code. Staff recommends approval. 2ntl Vice Chairman Dreggors asked if Bending Branch Way was the only entrance into the subdivision. Ms. Liebman answered there is also an entrance at the southern end of the subdivision. I" Vice Chairman Cocking asked if the topography of Lots 11 and 12, Block D will have to be adjusted for drainage. Ms. Liebman answered yes. The engineer will work with staff and address this issue through the civil engineering plan and final plat review Motion: Upon a motion by 2n° Vice Chairman Dreggors, and a second by Commissioner Platt, the Commission voted 6 IN FAVOR, and 0 OPPOSED, to approve the Preliminary Plat for Fall Creek The motion carried.
