Director's Report is attached for action taken on the Planning & Zoning Commission items by City Council at the December 13, 2011 regular meeting Consent Aeenda 2. Approve minutes of the November 15, 2011 regular meeting 3. Approve minutes of the December 6, 2011 regular meeting. 3. Extension Request - Consider a request for an extension for filing a Final Plat for Hamilton Hills, being 30.967± acres located west of Alma Drive and east of Tatum Drive (FP -8/18/11-156) [Hamilton Hills) Motion: Upon a motion by 2" Vice Chair Mangrum, and a second by Commissioner Trahan, the Commission voted 6 IN FAVOR, and 0 OPPOSED to approve the Consent Agenda. The motion carried. Reeular Aeenda Agenda Item #5 Public Hearing - Conduct a Public Hearing and consider a request to change the zoning from Agriculture -Open Space AO to Single Family Residential R-5. The property is 61.240± acres situated in the Henry Bradenburg Survey, Abstract No. 110; and being all of Lots 1 (save and except Stacy Road dedication recorded in County Clerk's File No. 2000-0058322, Land Records, Collin County, Texas), 3, 4, 5 (save and except Watters Road dedication recorded in County Clerk's File No. 2004-0020239, Land Records, Collin County. Texas), 6, 7, 8, 9, 10, and part of Lot 11 of Kittyhawk Estates, located south of Stacy Road and west of E. Kittyhawk Drive (Z-10/24/11-172) [Kittyhawk Estates) Ogden "Be" Bass, Director of Community Development, presented to the Commission. The property is located south of Stacy Road and west of E. Kittyhawk Drive. The current zoning is Agriculture -Open Space AO. The applicant is requesting to change the zoning to Single Family Residential R-5 Kittvhawk Estates Lot 2 is not a part of this zoning change at this time; however this property can be rezoned in the future. Mr. Bass stated that with this traditional zoning case the applicant will be required to go through the development process; providing more detailed plans at a later date. For this request the Commission should evaluate whether the property is better suited as Single Familv Residential or remain Agriculture - Open Space AO A conversion to Single Family Residential zoning is consistent with the Future Land Use Plan. The surrounding properties are zoned Single Family Residential R-3 and R-5. The proposed rezoning to Single Family Residential R-5 is compatible with surrounding property Mr. Bass addressed some citizen concerns that the department had received. He stated that he discussed the proposed rezoning with Allen School District administration. The school district has used the Future Land Use Plan to calculate district capacities. Therefore, the school district has already planned on this property converting to a Single Family Residential zoning district. Staff recommends approval. Commissioner Kizer stated that one of the citizen response letters referred to the surrounding zoning as Single Family Residential R-4 He asked for clarification. Mr. Bass specified the surrounding zoning as Single Family Residential R-5. lie reminded the Commission that the typical Single Familv Residential in Allen is R-5 zoning. Chairman Wendland opened the Public Hearing. With no one wishing to speak, Chairman Wendland closed the Public Hearing. David Hicks, 401 Woodlake Dr, Allen, TX, applicant representative, addressed the Commission. He stated a number of corporate users have shown interest in the property south of Kittyhawk However, the airport was a deterrent. He described working with the Kittyhawk Estates homeowners and stated that this zoning change is really good for the City of Allen. Chairman Wendland re -opened the Public Hearing Richard L. Garcia, 2122 Arches Park Drive, Allen, TX, spoke in opposition to the case. He described his concern for the capacity of the elementary school in the district and the vehicle access into and out of the site. With no one else wishing to speak, Chairman Wendland closed the Public Hearing. Commissioner Ogrizovich asked Mr. Bass if there were any opportunities for Planning Department staff to keep the residents more informed throughout the development process. Mr. Bass answered that the City is not obligated to contact the residents outside the Public Hearing process However, the adjacent subdivisions are welcome to stay in contact with staff to get an update on the progress of this site. 2nd Vice Chair Mangrum stated that she is in support of the zoning change Commissioner Kizer stated that he believes this is a perfect location for Single Family Residential; clearly R-5. He stated that he has a child at Cheatham Elementary School. He believes school boundaries are drawn to be redrawn He cannot see any better use of this property except residential. Commissioner Trahan stated that he believes the zoning change is the highest and best use of this property. He is in support of the request. Chairman Wendland reiterated that the dominant size of lots within the city meet R-5 zoning standards and the proposed change is compatible with the surrounding area He stated that times change and he has no objection to this zoning change. Commissioner Trahan inquired about Lot 2 protruding into Lot 1 I Mr Bass explained that each lot has been deeded partial ownership of the runway (Lot 11). Motion: Upon a motion by Commissioner Trahan, and a second by Commissioner Ogrizovich, the Commission voted 6 IN FAVOR, and 0 OPPOSED to approve the rezoning for property currently zoned Agriculture -Open Space AO to Single Family Residential R-5 for Kittyhawk Estates The motion carried. Agenda Item #6 Public Hearing — Conduct a Public Hearing and consider a request to amend the Concept Plan and Development Regulations for a portion of Planned Development PD No. 54 for Multi -family Residential MF -I8 for assisted living/memory care and senior independent living. The property, is 10.986± acres situated in the Catherine Parsons Survey, Abstract No 711, also known as Lot IR, Block C, Bray Central One; located west of Watters Road and north of Bray Central/Junction Drive (Z-9/30/11-164) [Franklin Park Twin Creeks] — withdrawn by applicant Chairman Wendland announced that Agenda Item 46 had been withdrawn by the applicant. Agenda Item #7 Preliminary Plat — Consider a Revised Preliminary Plat for Greenville Center Addition, Lots 9-13, Block A The property is 7 4524± acres located in the Henry Weisel Survey, Abstract No. 1026, James T Roberts Survey, Abstract No 777; south of Stacy Road and west of Greenville Avenue (PP -11/22/11-184) [Greenville Center Addition] Patrick Blaydes, Planner, presented to the Commission. The property is located west of Greenville Avenue and south of Stacy Road. The property is zoned Shopping Center SC A General Development Plan and Preliminary Plat for Lots 1-13 were approved in 2007 and 2008. Since that time Lots 1-8 have been final platted and the majority of the lots have developed. In May of this year a revised General Development Plan was approved; which showed a change in the lot configuration and included an additional lot. This revised Preliminary Plat is the second step in the development process for these remaining lots. The revised Preliminary Plat shows five (5) lots The additional lot (Lot 14) is the site for Taco Bueno and has been final platted Access is provided from one offsite connection with Lot 8 on Stacy Road, one shared drive on Stacy Road, one access point on Greenville Avenue, and one offsite connection with the adjacent property on Greenville Avenue A detention pond on Lot 13 will serve the drainage needs for these lots. The revised Preliminary Plat has been reviewed by the "Technical Review Committee, is consistent with the revised General Development Plan and meets the requirements of the Allen Land Development Code Staff recommends approval. Motion: Upon a motion by Commissioner Platt, and a second by 21" Vice Chair Mangrum, the Commission voted 6 IN FAVOR, and 0 OPPOSED to approve the Revised Preliminary Plat for Greenville Center Addition, Lots 9-13, Block.
