Conduct a Public Hearing and Adopt an Ordinance to Amend Specific Use Permit No. 152 for a Gymnastics or Sports Training Facility Use to Increase the Area Subject to the SUP and Update the Parking Study for an Approximately 20,866± Square Foot Portion of a Building Generally Located North of Bethany Drive and West of Greenville Avenue(and Commonly Known as 718 S. Greenville Avenue, Suite 150). [Alliance Cheer-Expansion] Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. ORDINANCE NO. 3676-6-19: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY,TEXAS,AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP, AS PREVIOUSLY AMENDED, BY AMENDING ORDINANCE NO. 3452- 2-17 GRANTING SPECIFIC USE PERMIT NO. 152 TO EXPAND THE PORTION OF THE BUILDING LOCATED ON LOT 1, BLOCK A, ALLEN BUSINESS CENTER II (ALSO KNOWN AS 718 S. GREENVILLE AVENUE, SUITE 150)WHICH MAY BE USED FOR A GYMNASTICS AND SPORTS TRAINING FACILITY USE IN AN APPROXIMATELY 20,866± SQUARE FOOT PORTION OF THE BUILDING; PROVIDING A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. Conduct a Public Hearing and Adopt an Ordinance to Establish a Planned Development Zoning District with a Base Zoning of Corridor Commercial and to Adopt Development Regulations, Concept Plan, Building Elevations, and a Landscape Plan for the Property Generally Located South of Ridgeview Drive and West of U.S.Highway 75. [Tractor Supply] It was noted that Ms.George had accepted and verified written opposition from a property owner within 200 feet of the zoning request property and Mr.Kurbansade,Director of Community Development,has confirmed that 23.95% of the 200-foot protested area was computed. The Council must have a super majority vote in order to approve the zoning request as required by Section 4.06, Changes and Amendments, of the Allen Land Development Code. Conduct a Public Hearing and Adopt an Ordinance to Amend the Development Regulations of Sub-Area 1 of Planned Development No. 45 Shopping Center and to Adopt a Base Zoning of Townhome, Concept Plan, Building Elevations, Open Space and Screening Plan, Lot Typicals, and Cross Sections for the Property Generally Located South of W.Stacy Road and West of U.S. Highway 75. [Cambridge Townhomes at Stacy Green] Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. MOTION: Upon a motion made by Councilmember Schulmeister and a second by Councilmember Doherty, the Council voted seven(7) for and none(0) opposed to adopt Ordinance No. 3677- 6-19,as previously captioned,to amend the Development Regulations of Planned Development PD No.45 Shopping Center and adopt a base zoning of Townhome, Concept Plan, Building Elevations,Open Space and Screening Plan,Lot Typicals,and Cross Sections for Lot 7,Block B, Stacy Green, for Cambridge Townhomes at Stacy Green, with the deviation of the Concept Plan from the applicant. The motion carried. 11. Adopt a Resolution Amending the Building Permit and Inspection Fees Associated with Residential Dwellings. RESOLUTION NO.3678-6-19(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING ANNUAL CONTRACTOR REGISTRATION FEES IN ACCORDANCE WITH CHAPTER 4 OF THE CODE OF ORDINANCES AND SECTION 3.10 OF THE ALLEN LAND DEVELOPMENT CODE, AS AMENDED, AND BUILDING PERMIT AND INSPECTION FEES PURSUANT TO ARTICLE III OF THE ALLEN LAND DEVELOPMENT CODE, AS AMENDED; AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Terrell announced the Executive Session then recessed the Regular Agenda at 9:44 p.m. Executive Session In accordance with the Texas Government Code, the Allen City Council convened into Executive Session at 9:59 p.m. on Tuesday,June 11,2019, in the Council Conference Room, 305 Century Parkway,Allen,Texas, in order to discuss matters pertaining to: 16. Pursuant to Section 551.074 of the Texas Government Code,for Personnel Matters: • Discussion Regarding Election of Mayor Pro Tern. • Discussion Regarding Appointment of City Manager and Approval of Employment Agreement. The Executive Session adjourned at 10:40 p.m. on Tuesday,June 11, 2019. 17. Reconvene and Consider Action on Items Discussed During Executive Session. The Allen City Council reconvened into the Regular Meeting at 10:42 p.m. on Tuesday, June 11, 2019. The following action was taken on items discussed during Executive Session. 12. Election of Mayor Pro Tem. Mayor Terrell called for nominations from the Council for the position of Mayor Pro Tern. Councilmember Brooks nominated Councilmember Caplinger. With no other nominations offered,Mayor Terrell closed the call for nominations. MOTION: Upon a motion by Councilmember Brooks and a second by Councilmember Clemencich, the Council voted seven(7)for and none(0)opposed to elect Councilmember Caplinger as Mayor Pro Tem. The motion carried. 13. Appointment of City Manager and Approval of Employment Agreement. MOTION: Upon a motion by Councilmember Clemencich and a second by Councilmember Brooks, the Council voted seven(7) for and none(0) opposed to appoint Eric Ellwanger as City Manager for the City of Allen effective June 11, 2019 in accordance with the terms and conditions set forth in the City Manager employment agreement and authorize the Mayor to negotiate and execute the City Manager employment agreement on behalf of the City of Allen.
