Min - Board of Adjustment - 1982 - 12/13 - CalledD ZONING BOARD OF ADJUSTMENT CALLED MEETING DECEMBER 13, 1982 Present: An�rd Mom6ovc• Donald Kirkindoll, Chairman John Karlsruher, Vice Chairman Wayne Armand Don Lewis Rick Alexander City Staff: Bill Petty, Director of Community Development Sherry Massett, Secretary On November 29, 1982, by a majority of the Board, the Public Hearing was changed from December 14, 1982, to December 13, 1982, due to a conflict on that night. The newspaper and all appropriate parties interested were notified of the change. The Called Meeting of the Allen Zoning Board of Adjustment was called to order by Chairman Kirkindoll at 7:30 p.m. on Monday, December 13, 1982, at Reed Elementary School, 1200 Rivercrest, Allen, Texas. Approval of Minutes: November 9. 1982 (Agenda Item II) Chairman Kirkindoll read the agenda item into the record as follows: "Approve minutes of November 9, 1982, Called Meeting." MOTION: Upon a motion by Board Member Karlsruher and second by Board Member Armand, the Board voted five (5) for and none (0) opposed to approve the minutes as presented. The motion carried. Public Hearing - On Variance Request for Block H, Lots I & 2, Timbercreek Addition (Agenda Item III) Chairman Kirkindoll read the request into the record as follows: �3 ZONING BOARD OF ADJUSTMENT DECEMBER 13, 1982 PAGE 2 Public Hearing - On Variance Request for Block H, Lots 1 & 2, Timbercreek Addition (Cont.) "Public Hearing - On variance request for Block H, Lots 1 & 2, Timbercreek Addition." Chairman Kirkindoll opened the Public Hearing. Mrs. Bob Carr spoke for the variance request. She told the Board that they have had some plans drawn up by an architect for building a structure on the lots, but the building line prevents them from building anything suitable on the lots because of their location in relation to Cottonwood Creek. Chairman Kirkindoll closed the Public Hearing. There was some discussion of the uses in townhouse zoning as it is stated in the present Zoning Ordinance and how this request would be affected by the lot size in the townhouse district; how the floodplain would affect the building of any dwelling unit on the lots; if the variance were approved, who would be liable for any damage if part of the dwelling unit were to be in danger of dropping off in the creek. MOTION: Upon a motion by Board Member Lewis and second by Board Member Armand, the Board voted five (5) for and none (0) opposed to grant this variance. The motion carried. General Discussion: There was some discussion on the intent of the Zoning Ordinance in granting variances of the above type. Adjournment: MOTION: Upon a motion by Board Member Armand and second by Board Member Lewis, the Board voted five (5) for and none (0) opposed to adjourn the Called Meeting of the Allen Zoning Board of Adjustment at 7:53 p.m. The motion carried.
