Min - Board of Adjustment - 1986 - 02/11 - RegularI ALLEN BOARD OF ADJUSTMENT REGULAR MEETING FEBRUARY 11, 1986 Present• John Karlsruher, Chairman George Chrisman Rick Alexander Harold Biggs John Cahill (arrived 7:40) Staff: Mel Hilkemeier, Code Inspector Sally Leeper, Secretary The Regular meeting of the Allen Board of Adjustment was called to order by Chairman Karlsruher at 7:33 p.m. in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Approve Minutes January 14, 1986 (Agenda item II) Chairman Karlsruher read the agenda item into the record as follows: "Approve minutes of January 14, 1986, Regular Meeting." MOTION: Upon a motion by Board Member Chrisman and a second by Board Member Alexander, Board voted 4 FOR and 0 AGAINST, with Board Member Cahill arriving later, to approve Agenda Item II. The motion carried. Public Hearing Gemcraft Homes (Agenda Item III) Chairman Karlsruher read the agenda item into the record as follows: "Public Hearing - Consider a request for a building line variance on an irregular shaped lot from 25' to 20' on the Jupiter Road side of Lot 20, Block 15, Section 5 of Cottonwood Bend, 601 Aldenwood Street." EI Chairman Karlsruher opened the Public Hearing. ALLEN BOARD OF ADJUSTMENT REGULAR MEETING FEBRUARY 11, 1986 11 PAGE TWO Public Hearing Gemcraft Homes (Cont.) (Agenda Item III) Mr. Fred Phillips, 414 Feathercrest, Dallas, with Gemcraft Homes, spoke in favor of this request on behalf of Gemcraft Homes. He stated they were attempting to place their smallest home on this lot, and do not anticipate any problems of this nature with any other lots. Chairman Karlsruher asked if they had considered building a custom home that was smaller on this lot. It was noted that this home is 1539 sq. ft. The minimum house size allowed in this PD (PD 13) is 1450 sq. ft. Most of the houses being built are in the 1600 to 1900 sq. ft. range. Mr. Phillips said that a smaller home could be built, but Gemcraft did not feel that the smaller size would blend with the neighborhood as it is being developed. With no one else to speak FOR or AGAINST this proposal, Chairman Karlsruher closed the public hearing. Mr. Hilkemeier advised the board that this is an odd -shaped lot and would provide a problem for whoever would build on it. The only area that would encroach the building line is one corner of the garage. He stated staff considers this to be a hardship circumstance. Board Member Cahill questioned the distance of the encroachment. Mr. Phillips stated approximately 3' feet. Board Member Alexander stated that a variance could be considered at the point of encroachment only rather than a complete building line variance. Board Member Chrisman discussed the problems involved with catching these situations at the time of platting. Board discussed the distance required for the driveway and it was noted that the 20 foot requirement is satisfied. MOTION: Upon a motion by Board Member Alexander and a second by Board Member Chrisman, Board voted 4 FOR and 1 AGAINST with Board Member Karlsruher voting AGAINST, to grant a variance at the point designated on Gemcraft's drawing, and only at that point, on Lot 20, Block 15, Cottonwood Bend 5, 101 Aldenwood Street.
