Min - Board of Adjustment - 1986 - 11/11 - RegularALLEN ZONING BOARD OF ADJUSTMENT REGULAR MEETING NOVEMBER 11, 1586 ATTENDANCE• Board Members Present: John Karlsruher, Chairman John Cahill, Vice -Chairman Harold Biggs George Chrisman Dan Contreras Board Members Absent: Rick Alexander City Staff Present: Mel Hilkemeier, Code Inspector Sally Leeper, Secretary Bill Petty, Director of Community Development Arne Johnson, Plans Examiner Joseph Del Ferro, Environmental Health Inspector CALL TO ORDER: (Agenda Item I) The Allen Zoning Board of Adjustment was called to order at 8:05 p.m. at the City Council Chambers, Allen Municipal Annex, One Butler Circle, Allen, Texas, on November 11, 1986. Approve Minutes October 14, 1986 (Agenda Item II) Chairman Karlsruher read the agenda item into the record as follows: "Approve minutes of October 14, 1986, Regular Meeting." Board Member Cahill noted that a correction should be made on page two in the motion to close nominations for Vice Chairman. The motion was seconded by Board Member Biggs rather than Board Member Cahill. MOTION: Upon a motion by Board Member Chrisman and a second by Board Member Cahill, the Board voted 5 FOR and 0 OPPOSED to approve the minutes of the October 14, 1986 meeting, as corrected. The motion carried. A A ALLEN ZONING BOARD OF ADJUSTMENT NOVEMBER 11, 1986 PAGE TWO Public Hearing Richie Leafgreen - 500 West Main (Agenda Item III) Chairman Karlsruher read the agenda item into the record as follows: "Public Hearing - Consider request by Mr. Richie Leafgreen for a variance to Section 3.01(U) Central Business District regulations of the City of Allen Comprehensive Zoning Ordinance requiring 100% masonry exterior walls." Mr. Richie Leafgreen presented the request to the Board. He stated his company would like to restore this residence to its original character and not be required to brick the exterior of the house. He presented a rendering of the house as proposed. Chairman Karlsruher opened the public hearing. The following persons spoke against the request: Mary Hemby 505 W. Main Mr. Hemby 505 W. Main Mr. Alfred Bolin 405 W. Main Chairman Karlsruher closed the public hearing. Bill Petty discussed the Central Business District zoning regulations and the purpose of the district. He stated that the district is zoned for commercial use and an office would be allowable under this zoning. He added that regardless of whether this variance is granted or not, the remainder of the structure would have to be brought up to City building codes, including off-street parking requirements. He stated he had asked proponent to attempt to show that there is a significant need for historic designation. Board Member Chrisman provided the Board with information he had obtained from the State regarding requirements for State Historic Markers. Chairman Karlsruher reminded the Board that any action by this Board requires four concurring votes. Mary Brinley, resident in the area, stated that any improvement to the structure would be better than what is presently there. ALLEN ZONING BOARD OF ADJUSTMENT NOVEMBER 11, 1986 PAGE THREE Public Hearing Richie Leafgreen (Cont.) (Agenda Item III) Board Member Cahill questioned whether the structure is considered habitable at this time. He stated he had viewed the property and did not see anything unique about the structure from those surrounding it. He was not able to find any information which would give historic preference to the structure. He stated further that there was no place for a parking lot on this property and added that the house had been added to from time to time through its history. Chairman Karlsruher stated that Mr. Leafgreen's letter indicated that the request would meet the parking requirements. Board Member Chrisman stated he had viewed the property, and had seen nothing to give support to the request for historic preservation. He felt that historic preservation should include some worthy event taking place, or some important person having lived there. Board Member Contreras stated he had viewed the property and had tried to discover historic information regarding the property. He had not been able to do so. Board Member Biggs stated he would like to see the house re- stored as a residence, but did not feel this house should be afforded historic designation. Chairman Karlsruher asked Mr. Leafgreen if he had been able to obtain additional facts regarding this property. Mr. Leafgreen stated he had not been able to find anything at this time, and his main concern was with the character of the architecture itself. Chairman Karlsruher stated he did not feel that the Central Business District was zoned to encourage small businesses in residential homes, but for redevelopment of large blocks. He did not feel there was sufficient evidence to establish historic significance of this property. MOTION: Upon a motion by Board Member Chrisman and a second by Board Member Cahill, the Board voted 5 FOR and 0 OPPOSED to deny the request for variance by Mr. Richie Leafgreen. The motion carried and the request was denied.
