Min - Board of Adjustment - 1987 - 12/01 - Special CalledALLEN ZONING BOARD OF ADJUSTMENT CALLED SPECIAL MEETING j DECEMBER 1, 1987 ATTENDANCE: Board Members Present: John Karlsruher, Chairman Galen Clay Tom Visage Bill Roberge Les Garrett Board Members Absent: Ed Lynge City Staff Present: Arne Johnson, Assistant Building Official Sally Leeper, Secretary CALL TO ORDER: The Allen Zoning Board of Adjustment was called to order at 7:30 P.M. on December 1, 1987, at the Allen Municipal Annex, City Council Chambers, One Butler Circle, Allen, Texas. Approve Minutes September 1, 1987 (Agenda Item II) Chairman Karlsruher read the agenda item into the record as follows: "Approve minutes of September 1, 1987, Called Special Meeting." MOTION: Upon a motion by Board Member Clay and a second by Board Member Garrett, the Board voted 5 FOR and 0 OPPOSED to approve the minutes of September 1, 1987, as presented. The motion carried. ALLEN ZONING BOARD OF ADJUSTMENT DECEMBER 1, 1987 PAGE 2 Election of Officers (Agenda Item III) Chairman Karlsruher read the agenda item into the record as follows: "Election of Officers: Chairman, Vice -Chairman." Board Member Clay nominated John Karlsruher for the office of Chairman. With no other nominations for the office of Chairman, John Karlsruher was elected by acclamation. Board Member Visage nominated Galen Clay for the office of Vice -Chairman. Board Member Roberge volunteered his name for nomination. With a vote of 4 in favor of Galen Clay and 1 for Bill Roberge, Galen Clay was elected to the office of Vice -Chairman. Public Hearing Sonic Drive -In (Agenda Item IV) Chairman Karlsruher read the agenda item into the record as follows: "Public Hearing - Consider a request by Mr. J. C. Winterringer, repre- senting the Sonic Drive-in, located at 707 E. Main, Allen, Texas, for a variance to Section 3.01(P) Shopping Center District Regulations of the City of Allen Comprehensive Zoning Ordinance No. 829-11-87, to allow vinyl siding over the existing masonry on the existing structure (approximately 90%) and vinyl siding on new addition (approximately 10%)." Chairman Karlsruher requested input from staff at this time. Mr. Arne Johnson stated that Section 3.01(P), Paragraph 5a, of the Comprehensive Zoning Or- dinance No. 829-11-87 states that all main buildings in a shopping center district shall be constructed of stone, brick, tiles, glazing, cement, concrete, or similar materials. Section 4.04-3-b-5 states that the Board may permit alternate building materials in a zoning district other than residential if such alternate material is in general compliance with and does not conflict with adjacent property. Chairman Karlsruher asked Mr. Johnson if he had seen any other Sonic Drive-ins with vinyl siding, and he replied that he had seen one in Plano with vinyl siding, and it appeared to be a professional job. Board Member Clay asked if the proponent was requesting to increase the area of the structure. Mr. Johnson stated that they were, by approximately 10%. Chairman Karlsruher opened the public hearing. Mr. Jim Winterringer, owner of the property, residing in Shawnee, Oklahoma, introduced the following persons: ALLEN ZONING BOARD OF ADJUSTMENT DECEMBER 1, 1987 PAGE 3 Public Hearing Sonic Drive -In (Cont.) (Agenda Item IV Mr. Ray Cresap, contractor for this proposed addition. Mr. Dick Lear, co-owner of the property. Mr. Bill Hollaway, operator of Sonic in Allen. Mrs. Winterringer. He presented the Board with a letter showing the number of retrofits that have been completed and their location by State. He displayed a sample of the siding in question. He stated they will be using double insulated glass, and plan to build a small foyer in front of the existing structure. He presented before and after pictures of the proposal. Neon lights will allow the canopy to show up better. They will also be completing some concrete repair work. No one spoke in opposition to the request. Chairman Karlsruher closed the public hearing. The Board discussed the sections of the Zoning Ordinance referred to above, allowing for alternate building materials, and also 4.04-3-c-2, which refers to the granting of a variance for the reason of hardship or unusual and practical difficulties, and not for convenience only. Board Member Clay stated he had questioned the reason for this request. He stated that the proponent could probably do most of the retrofitting job without covering the existing brick. Board Member Roberge asked what the life expectancy on the vinyl siding is. Mr. Johnson stated he felt it is very substantial. Mr. Winterringer stated the material is warranted for 20 years. He added it will be easy to maintain. He also stated that they are planning to put a new ceiling in the interior of the existing structure. Board Member Visage questioned whether this plan had been provided by Sonic Industries. Mr. Winterringer stated that Sonic Industries had provided the plan. The Board discussed the surrounding businesses, and the construction of those businesses. It was stated that the existing area is generally masonry at this time. Chairman Karlsruher asked the proponent if a denial of this request would create an unusual or detrimental situation between the business and Sonic. Mr. Winter - ringer stated he did not know. This package is not mandatory. I I ALLEN ZONING BOARD OF ADJUSTMENT DECEMBER 1, 1987 PAGE 4 Public Hearing Sonic Drive -In (Cont.) (Agenda Item IV) The proponent was asked if alternate plans have been adopted in other cities where the vinyl siding was denied. Mr. Winterringer stated that yes, it could be stuccoed and painted gray. Mr. Dick Lear, 1318 N. Irving Heights, Irving, Texas, co-owner of the establish- ment, stated that he has a store in DeSoto where he painted the brick and he felt it defeated his intended purpose. He stated that the brick here and in DeSoto is weathered. This keeps them from putting in the insulation they need, and they do not have the image they are looking for. He stated that this plan has proven to save about $250 per month on utilities. He stated that the store in Allen does not look good at this time. They want to improve the look and become a viable part of Allen, Texas. He has not been pleased with the look gained in their DeSoto store. MOTION: Board Member Roberge made a motion to approve this request for special exception by Sonic to install the vinyl siding over the exterior portion of the building. The motion died for lack of a second. Upon a motion by Board Member Visage and a second by Board Member Clay, the Board voted 4 FOR and 1 OPPOSED to adopt a resolution denying the request for special exception by Sonic Drive -In. The request was denied.
