Environmental Health Inspector CALL TO ORDER AND ANNOUNCE A OUORUM With a quorum of the Board present, the Sign Control Board was called to order at 7:30 p.m. by Chairperson Jones at the City Council Chambers, One Allen Civic Plaza, Allen, Texas. CONSENT AGENDA. (Agenda Item 1-6) 1. Approve minutes of July 8, 2000 Regular Meeting. 2. Consider renewal of Class 4 on-site temporary promotional sign for Beazer Homes located at 805 Big Bend Drive 3. Consider renewal of Class 4 on-site temporary promotional sign for Lermar Homes located at 104 Alder Drive. 4. Consider renewal of Class 4 on-site temporary promotional sign for D. R. Horton located at the northeast comer of Bethany Drive and Bethany Creek Drive. 5. Consider renewal of Class 4 on-site temporary promotional sign for Huntington Properties located on Lot 6, Allen Village, at the southeast comer of McDermott Drive and Alma Dnve, 6. Consider renewal of Class 4 on-site temporary promotional sign for Twin Mills located at 741 Heritage Parkway. Ms. Sally Leeper advised that the signs on the consent agenda are in good condition. MOTION: Upon a motion by Board Member Harvey and a second by Board Member Moore, the Board voted 5 FOR and 0 OPPOSED to approve the consent agenda. PAGE Consider request for Class 4 off-site temporary promotional sign for Centex Homes/Ryland Homes to be located at the southwest comer of Stacy Road and Malone Road. Consider request for Class 4 off-site temporary promotional sign for Centex Homes/Ryland Homes to be located at the southeast comer of Stacy Road and US 75, Ms. Tem Phillips, representing Centex/Ryland, requested two off-site signs (Agenda Item No. 7 and Agenda Item No. 8). Both signs would be 32 sq. ft. as required by the Sign Ordinance. She stated their intention is to direct potential customers to the Lost Creek Development from US 75. Both signs would be placed in accordance with ordinance requirements. MOTION: Upon a motion by Board Member Lewis and a second by Board Member Brown, the Board voted 5 FOR and 0 OPPOSED to approve the request for the off-site sign to be located at the southwest comer of Stacy Road and Malone Road. MOTION: Upon a motion by Board Member Harvey and a second by Board Member Brown, the Board voted 5 FOR and 0 OPPOSED to approve the request for the off-site sign to be located at the southeast comer of Stacy Road and US 75 9. Public Hearing — Consider a request by SPS Mann for a variance to Sign Ordinance No. 1630-9- 98 to allow an identification sign at the office complex located at 1504-1506 N. Greenville Avenue. Ms. Leeper presented the request to the Board. The applicant was not present at the meeting. The Board discussed construction details and requirements for anchoring the base of the sign. Board members stated a preference for the base of the sign to be constructed to match the exterior of the buildings. The Board discussed whether there was a real need for this sign, being an identification of the complex, when each of the individual buildings are allowed a multi -use tenant sign. Discussion was held regarding the proposed size of the sign. Chairman Jones opened the Public Hearing With no one wishing to speak for or against the request, Chairman Jones closed the public hearing. MOTION: Upon a motion by Board Member Lewis and a second by Board Member Moore, the Board voted 3 FOR and 2 OPPOSED, with Chairman Jones and Board Member Harvey voting against, to recommend approval of the request. Public Hearing — Consider a request by Mid States Realty, LLC for a variance to Sign Ordinance No. 1630-9-98 to allow a Class 5 monument sign to be placed 4 feet from the property line and 24 feet from the back of the curb. Ms. Leeper presented the request to the Board. Mr. Ray Sanders, Mid States Realty, LLC, spoke to the Board and stated that the proposed sign would have been in compliance with the Ordinance except that the City had requested that their driveway be realigned to match the median cut, and this has necessitated relocation of their proposed sign. Chairman Jones opened the public hearing. With no one wishing to speak for or against the request, Chairman Jones closed the public hearing. The Board discussed the merits of the request and noted that the sign would be placed behind the required visibility triangle and would not obstruct the vision of traffic in any way. Although the sign is only 4 feet back from the property line, it is 24 feet from the back of the curb as a result of the extra right-of-way at this location. MOTION: Upon a motion by Board Member Harvey and a second by Board Member Lewis, the Board voted 5 FOR and 0 OPPOSED to recommend approval of the request. The motion carred it. Discussion — Sign Ordinance Definitions, Prohibited Signs, and General Regulations Ms. Sukup presented preliminary suggestions concerning revised Definitions, Prohibited Signs, and General Regulations sections of the Sign Ordinance. The following comments and suggestions were discussed or made by the Board. 1. Agreement that additional definitions are needed for words such as canopy or awning sign. 2. Ordinance should be considered for presentation in a tabular form with allowance for specific comments 3 Prohibition of weekend directional (bandit) signs. 4. Regulations should be drafted to address time, place and manner rather than message content. 5. Signs should be completely prohibited in City right-of-way, including garage sale signs, and political signs. 6. Length of time to allow political signs is too long. Should consider 30 days prior to election and 10 days after election. 7 Discussion of the possibility of prohibiting banners entirely. 8. A new definition was proposed for official signs. These would be the only signs allowed in the right-of-way. Traffic signs are official signs. 9. We should consider limiting window signs. This could be a creme prevention issue. 10. Evaluate present definition of sign area. A decision should be made as to measuring one or both sides of a back-to-back or V-shaped sign. 11. Consider possibility of amending garage sale regulations. Consider allowing only city - provided signs with a permit. 12. Clarify "sign height." The top of the sign should be stated as the "highest point of the sign, or overall height." 13. Consider using a site visibility triangle as a setback requirement from the Land Development Code, Article VII, Zoning Development Standards, Section 7 07, paragraph Le and l.d. 14. Review regulations for murals. ADJOURNMENT MOTION: Upon a motion by Board Member Brown and a second by Board Member Moore, the Board voted 5 FOR and 0 OPPOSED to adjourn the August 8, 2000, meeting of the Sign Control Board at 9:35 p.m. The motion carred. Regulations regarding flyers — which should include flyers attached to homes and cars. 17 Large tethered balloons — consider eliminating these or limiting them to 3-7 days. 18. Consider a grand opening package, limited to no more than 3 days, to include flags, pennants, and any other items that would be allowed. 19 Define subdivision markers or wall signs to identify a particular subdivision, limited to the name of the subdivision, not the name of all the builders within the subdivision. 20. Consider prohibiting all off -premise signs. It was noted that this aught be excessive if weekend directional signs are prohibited also. 21. Enforcement issues were discussed. 22. Vehicles being used for advertising might be required to be puked within a certain number of feet of the business. 23 Define seasonal decorations within public rights-of-way ADJOURNMENT MOTION: Upon a motion by Board Member Brown and a second by Board Member Moore, the Board voted 5 FOR and 0 OPPOSED to adjourn the August 8, 2000, meeting of the Sign Control Board at 9:35 p.m. The motion carred.
