A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF SEPARATE
INTERLOCAL COOPERATION AGREEMENTS BY AND BETWEEN THE CITIES
OF ALLEN AND PLANO WITHTEXAS HEALTH PLANO, PLANO INDEPENDENT
SCHOOL DISTRICT, AND WITH THE CITES OF PARKER AND MURPHY FOR
THE USE OF THE RADIO SYSTEM THAT IS JOINTLY OWNED BY THE CITY OF
ALLEN AND THE CITY OF PLANO; AUTHORIZING EXECUTION OF THE
INTERLOCAL AGREEMENTS BY THE CITY MANAGER; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, authorizes
governmental entities to contract with each other to perform government functions and services under the terms
thereof; and,
WHEREAS,the City Council authorized an Interlocal Agreement by and between the Cities of Allen and Plano
providing terms and conditions for the purchase and operation of a joint radio system for Municipal Services
with such Agreement being approved by the Allen City Council on September 11, 2018, through Resolution
No. 3603-9-18(R); and,
WHEREAS, Allen, Plano, Parker, Lucas, and Plano Independent School District are political subdivisions
within the State of Texas and are all engaged in the provision of governmental services for the benefit of their
citizens; and,
WHEREAS,Texas Health Center for Diagnostics and Surgery Radio Systems is a division of the Texas Health
Resource System,a non-profit health delivery service organization,that serves residents of North Texas; and,
WHEREAS, Allen and Plano desire to enter into separate Interlocal Agreements with Parker, Lucas, Plano
Independent School District and Texas Health Center for Diagnostics and Surgery Radio Systems for the use
of the Plano/Allen jointly owned radio system pursuant to Chapter 791 of the Texas Government Code; and,
WHEREAS, upon full review and consideration of the attached Interlocal Agreements, and all matters
attendant and related thereto, the City Council is of the opinion that the terms and conditions of the attached
Interlocal Agreements should be approved, and that the City Manager should be authorized to execute the
attached Interlocal Agreements on behalf of the City of Allen.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS,THAT:
SECTION 1. The terms and conditions of the Interlocal Agreements with the Cities of Parker and Lucas,
Plano Independent School District, and Texas Health Center for Diagnostics and Surgery Radio Systems,
attached hereto as Exhibit"A,"having been reviewed by the City Council of the City of Allen and found to be
acceptable and in the best interest of the City of Allen and its citizens,be, and the same is hereby, in all things
approved.
SECTION 2. The City Manager or designee is hereby authorized to execute the attached Interlocal
Agreements and all other documents in connection therewith on behalf of the City of Allen, substantially
according to the terms and conditions set forth in these Interlocal Agreements.
SECTION 3. This Resolution shall become effective from and after its passage.
