Call to Order and Announce a Ouorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:06 p.m. on Tuesday, January 26, 2016, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Pledge of Allegiance Public Recognition ALLEN CITY COUNCIL REGULAR MEETING JANUARY 26, 2016 1 1. Citizens' Comments. PAGE 2 Amber Pizano, 201 Worchester Lane, Allen, Texas, presented recommendations to the ordinance that restricts backyard chickens in residential neighborhoods and mentioned that she had started an online petition in support of her request The following individuals also spoke in support of the proposal. Jennifer Rerotel, 1304 Capstan Drive, Allen, Texas, and, Gerad Housley, 646 Valley View Drive, Allen, Texas Charleen Donelson. 142 West Way Drive, Allen, Texas, spoke regarding the declining condition of her neighborhood. MOTION: Upon a motion made by Counedmember Obermeyer and a second by Councilmember Brooks, the Council voted seven (7) for and none (0) opposed to adopt all items on the Consent Agenda as follows 2. Approve Minutes of the January 12, 2016, Regular Meeting of the Allen City Council. 3. Approve Minutes of the January 16, 2016, Special Called City Council Workshop for Strategic Planning. 4. Authorize the City Manager to Execute a License Agreement with New Cingular Wireless PCS, LLC for Cellular Antennae to be placed on the Prestige Water Tower. 5. Authorize the City Manager to Execute an Arena License Agreement with Championship Sports Group Inc., doing business as Texas Revolution, to base a Professional Championship Indoor Football League (CIFL) Team at Allen Event Center. 6. Authorize the City Manager to Execute an Amendment to the Licensed User Agreement with Ticketmaster LLC, to Continue Providing Ticket Sales and Distribution Services for Events at Allen Event Center. 7. Award Rid and Authorize the City Manager to Execute a Contract with Classic Protective Coatings, Inc. in the Amount of $304,600 for the Custer Elevated Tower Interior Repaint Project and Establish a Project Budget in the Amount of $373,600. S. Authorize the City Manager to Execute a Public Improvement Agreement with Wretched Land L.P., Related to the Required Traffic Improvements for the Development of Montgomery Ridge. 9. Receive the Capital Improvement Program (CIP) Status Reports. 10. Conduct a Public Forum Regarding the 2016 Capital Improvement Program (CIP) Steering Committee's Recommendation Regarding General Obligation Bonds. Mayor Terrell announced the public forum and asked anyone wishing to speak on this item to do so at this time. Lyle Addicks, 6019 Bnan Boulevard, Allen, Texas, questioned if these projects could be funded without the need for the issuance of bonds. Cath} Broxterman. aka Forest Viridian, 910 Wandering Wav Drive, Allen, Texas, addressed Council regarding public transportation needs in Allen. Mayor Terrell and Council commended the Capital Improvement Program (CIP) Steering Committee and the volunteers for their outstanding work in pulling together the proposed recommendation 12. Conduct a Public Hearing and Adopt an Ordinance to Change the Base Zoning from Agriculture Open Space AO to Single -Family Residential District R-7, and Adopt a Concept Plan, Development Regulations, and Building Elevations for a 74.601± acre portion of Planned Development PD No. 105, generally located south of Bethany Drive and east of Brett Drive. Montgomery Farm Estates. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. ALLEN CITY COUNCIL REGULAR MEETING JANUARY 26, 2016 PAGE 4 It was moved by Councilmember Herald and seconded by Councilmember Brooks to deny the zoning request Council discussion included tabling action on this item to allow an opportunity for the developer to meet with the surrounding neighborhoods The motion was amended as follows MOTION: Upon a motion made by Councilmember Herald and a second by Councilmember Obermeyer, the Council voted seven (7) for and none (0) opposed to reopen and continue the public hearing on this item to the February 23, 2016, regular meeting The motion carried.
