Min - City Council - 1966 - 03/17 - RegularREGULAR MEETING CITY COUNCIL, CITY OF ALLEN, TEXAS March 17, 1966 Present: Mayor Gentry Jones Aldermen: Dan Strong, R.B. Whisenant, Ken Posey Absent: B.J. Enloe, Jimmy Gantt Meeting called to order and minuetes from lase meeting read and approved. Mr. Betts of Betts & Smith, Engineers gave report on Federal Aid concerning water and sewer for the city of Allen. Mr. Betts states the Government will make a 50% grant on water and sewer providing the city of Allen is elidible. Mr. Betts states that there would be a government representative come to Allen in the near future to check our eligibility. Mr. Betts states there is no grant for street improvements but the government will make the city a loan at 4% interest and a 40 year loan. Discussion concerning Hwy. #2170, to check with Hwy. Department to see about paving and guttering inside city limits. Mayor Jones cleared the statment that had been misrepresented regarding the government refuning 75% of the street cost. This the government will not do. Mr. Gooch from McKinney presented to the Mayor and councilmen a sketch of the building he had asked for a permit to build on his property which is located ajacent to the Conoco Station which he also owns. Mayor Jones read letter (attached) and there was a lengthly disucssion reagarding the type of entertainment, who would be supervising it, and the type of entertainment, who would be supervising it, and the type of equipment to be installed. There were several citizens present and their personal opinions was voiced. Motion: By Mayor Jones a permit be denied Mr. Gooch. Motion second by Dan Strong, Motion passed, Ayes 3, Opposed 0. Mayor Gentry Jones read letter (attahced) that he wrote to the people of Allen, concerning the 1965 progress. The letter was approved by the council. Motion: By Dan Strong to get bid on fence around water tower. Second by R.B. Whisenant. Motion passed, Ayes 3, Opposed 0. Motion: By R.B. Whisenant to pay bills presented by Secretary. Second by Dan Strong. Motion passed, Ayes 3, Opposed 0. Motion that meeting adjourned by Mayor Jones, second by Dan Strong. These minutes read and approved this the 7 day of April 1966. FIRST CHRISTIAN CHURCH P.O Box 6 Allen, Texas AT THE MONTHLY BOARD MEETING OF THE FIRST CHRISTIAN CHURCH, A MOTION IN OPPOSITION TO THE ISSUANCE OF A PERMIT FOR A "RECREATION" CENTER WAS UNANIMOUSLY PASSED. WE THE UNDERSIGNED ADD OUR VOICE TO THIS RESOLUTION, AND GO ON RECORD OPPOSING SUCN AN ESTABLISHMENT UNLESS PROPERLY SUPERVISED AND GOVERNED. (24 signatures appear on original) an additional 11 signatures apper on original petition 1965 Progress Report for the City of Allen Water taps-----42 Building permits issued-----37 Amount-----$578,830.11 Population increased-----126 42 new water meters Lake Lavon water approved and right of way received for future lines from State Highway Dept. Betts & Smith, Reg. Consulting Engineers were employed by the City of Allen, for the purpose of working out a Workable Program for Community Improvements, under the Urban Renewal Development Program, sponsored by the United States Government. We have received from the department of Housing and Urban Development a certificate which reads a follows, "This certifies that Allen, Texas has presented an acceptable workable program for the prevention and elimination of slums and blight under terms of the Housing Act and is hereby qualified during the effective period of this certification to apply for special Federal assistance and support in achieving its community improvment objectives." Under this program the city will be eligable for federal grants to improve our streets, housing, water, drains, sewer lines, individual owned homes, parks, and numberous other objectives as the city of Allen needs arises. Purchase of 129 acres of land for the new sewer plant location was completed. The City of Plano incorporating with the citizens of the area in which we located our future plant, took the area into their incorporated area by request of those citizens specifically for the purpose of protecting them from having our sewer plant lcated there. Plano filed suit in the District Court against Allen and the District Court was in favor of Allen, Texas. Plano filed and appeal to the court of Civil Appeals for a hearing, the Court of Civil appeals reversed the decision then Allen appealed the decision to the Supreme Court of Texas, the Supreme Court upheald the decision of the appellet court so we lost. Now we have 129 acres of land that belongs to the city which we feel that in the resale of this property will make the City of Allen a nice profit. A Planning Commission was organized, consisting of three members. The purpose of the planning commission was to fulfill any obligation to carry out the Urban Renewal Development Program as required by the Secretary of the Department of Housing and Urban Development. The planning commission will assist the City Council in the future growth of Allen regarding areas of street improvements, water improvements sercuring new lands to be incorporated into the City of Allen, parks, city hall, libraries, new housing for Fire Dept., and many other items essential to the future growth of Allen. Ordinances passed and approved by the City Council of Allen An ordinance annexing certain territory contiguous to and adjoining the Town of Allen, Texas, providing for A zone G for said property, providing for an effective date of this ordinance and declaring an emergency. An ordinance confirming contract and authorizing issuance of street improvement warrants. An ordinance establishing minimum health and housing standards, provid- ing for an enforcing official creating a board of housing appeals, providing for the inspection of dwellings and promises and for other purposes. An ordinance providing for fire limits and regulations governing the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures. You are advised that a portion of Article 1901 (10) (B) of Vernon's Annotated Civil Statutes : ". . . all cities and towns whether incorporated under general or special law shall have the power and authority to levy and collect a tax equal to one-half of the amount herein levied and may ban, prohibit, regulate, supervise, control or license any person, firm, association of persons or corporation owning or operating a billiard table within the incorporated limits of such city or town. . . .".
