AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AMENDING ORDINANCE NO. 3653-4-19 BY CORRECTING A
SCRIVENER ERROR RELATING TO THE DESIGNATED NUMBER FOR THE
SPECIFIC USE PERMIT GRANTED BY SAID ORDINANCE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A CONFLICTS RESOLUTION CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 3635-1-19, approved January 8, 2019, granted a specific use permit that was
designated as"Specific Use Permit No. 166;"and,
WHEREAS, as the result of a scrivener's error, Ordinance No. 3653-4-19, approved on April 9, 2019,
incorrectly designated the specific use permit granted by said ordinance as"Specific Use Permit No. 166"instead
of correctly designating it as"Specific Use Permit No. 171";and,
WHEREAS,the City Council fords it to be in the public interest to amend Ordinance No. 3653-4-19 to correct
the above-described scrivener's error.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY,TEXAS,THAT:
SECTION 1. Ordinance No. 3653-4-19 is amended by changing all occurrences of the phrase "Specific Use
Permit No. 166"to read"Specific Use Permit No. 171."
SECTION 2. To the extent of any irreconcilable conflict with the provisions of this ordinance and other
ordinances of the City of Allen governing the use and development of the Property and which are not expressly
amended by this ordinance,the provisions of this ordinance shall be controlling.
SECTION 3. Should any word,sentence,paragraph, subdivision,clause,phrase or section of this ordinance,or
of the Allen Land Development Code Zoning Regulations, as amended hereby,be adjudged or held to be void or
unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Allen
Land Development Code Zoning Regulations,as amended hereby,which shall remain in full force and effect.
SECTION 4. This ordinance shall take effect immediately from and after its passage and publication in
accordance with the provisions of the Charter of the City of Allen,and it is accordingly so ordained.
