AN ORDINANCE ESTABLISHING A SPEED ZONE IN THE
100 BLOCK THROUGH THE 200 BLOCK OF EAST MCDERMOTT
STREET; PROVIDING FOR SIGNS SHOWING THE SPEED
LIMIT IN SUCH ZONE; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; PRESCRIBING PENALTIES FOR THE
VIOLATION THEREOF; PROVIDING FOR THE PUBLICATION
OF THE CAPTION OF THIS ORDINANCE AND THE EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS:
A
SECTION 1: That from and after the effective date of
this Ordinance, it shall be unlawful for any person to drive
a vehicle on that part of East McDermott Street from its
100 Block through its 200 Block situated in the City of
Allen at a speed that is greater than is reasonable under
the circumstances then existing, having regard to the
actual and potential hazards when approaching and crossing
the intersection or when special hazards exist with respect
to pedestrians or other traffic or by reason of weather or
highway conditions; and in the event speed shall be so
controlled as may be necessary to avoid colliding with
any person, vehicle or other conveyance on or entering
any speed zone as hereinafter shown on those portions of
the aforementioned street and highways in compliance with
legal requirements and the duty of all persons to use due
care.
SECTION 2: When no special hazards exist that require
lower speeds for compliance with Section 1, of this Ordinance,
the speed of any vehicle not in excess of the limits specified
in this Section shall be lawful, but any speed in excess of

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS:

SECTION 2: When no special hazards exist that require
lower speeds for compliance with Section 1, of this Ordinance,
the speed of any vehicle not in excess of the limits specified
in this Section shall be lawful, but any speed in excess of
the limits in said speed zone specified in this Section
shall be prima facie evidence at the speed is not
reasonable or prudent and that it is unlawful; said
zone extends from the 100 Block of East McDermott
through the 200 Block of East McDermott, the limit
of which shall be no greater than 15 miles per hour.
SECTION 3: Signs shall be placed at each entrance
to the zone herein specified which shall show the speed
limit for the zone.
SECTION 4: All provisions of any Ordinance- in
conflict herewith are hereby repealed so far only as it affects
only that portion described herein.
SECTION 5: Any person who violates any provision of
this Ordinance shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be fined any sum not
exceeding two hundred dollars ($200.00).
SECTION 6: The caption of this Ordinance shall be
published one time in a newspaper having general
circulation in the City of Allen and shall be effective
immediately upon its passage and publication.
