" AN ORDINANCE AMENDING ORDINANCE NO. 48 TO
THE CITY OF ALLEN, TEXAS, BY CHANGING SECTIONS 802
AND 1706 OF THE STANDARD BUILDING CODE AND ARTICLES
200-337 OF NATIONAL ELECTRICAL CODE; PROVIDING FOR
A PENALTY FOR A VIOLATION OF THIS ORDINANCE; PROVIDING
FOR READOPTION; PROVIDING FOR THE PUBLICATION OF THE
CAPTION HEREOF; AND PROVIDING FOR AN EFFECTIVE DATE."
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS:
SECTION I: That from and after the effective date of
this Ordinance, Section 802.1Bd of the Standard Building
Code is hereby amended and shall read as follows, to -wit:
"Section 802.1Bd: Chimneys shall extend at least three
feet above the highest point where they pass through the
roof of the building and'at least two feet higher than
any ridge within ten feet of such chimney and at least
twelve inches higher than the highest point of the
building."
SECTION II: That from and after the effective date of
this Ordinance, Section 1706 is hereby amended and shall read
as follows, to -wit:
"Section 1706: Any other requirement contained herein
notwithstanding, studs located in exterior and interior
walls shall be spaced not more than sixteen inches apart."
SECTION III: That from and after the effective date of
this Ordinance, Articles 200-337 are hereby amended and shall
read as follows, to -wit:
"Article 200: Any other requirements contained in Articles
200-337 notwithstanding, all premises wiring systems shall
use not less than size 12-2 copper wiring only with ground."
SECTION IV: Any person, parties in interest, or corporation
who shall violate any of the provisions of this Ordinance
or fail to comply therewith or with any of the requirements
thereof shall be subject to a misdemeanor prosecution and
upon conviction shall be punished by a fine of not less than
five dollars nor more than two hundred dollars, and each day that
such vilation shall be permitted to exist or continue shall
constitute a separate offense.' In the event a corporation is
the violator of any of the provisions of this Ordinance, each
officer, agent and employee of such corporation who is
responsible for or contributes to such violation in any manner
shall be individually and severally liable for the penalties
herein prescribed. 'rft2ere any person is acting solely as
agent for the party in ownership, no penalties under this
section shall be assessed against such agent as such.
SECTION V: Ordinance No. 48 of the City of Allen,
Texas, as so amended is hereby readopted by the City Council
of the City of Allen.
SECTION VI: The caption of this Ordinance shall be
Published one (1) time in a weekly newspaper published in the
City of Allen, and shall be effective immediately upon its
passage and publication.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS, on this 20th day of November , 1975
