AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, WAIVING ITS
EXTRATERRITORIAL JURISDICTION TO AND OVER CERTAIN PROPERTY OUT OF
THE JOSEPH RUSSELL SURVEY, ABSTRACT NO. 775, THE DANIEL BADGLEY
SURVEY, ABSTRACT NO. 111, AND THE GRIZZELL KENNEDY SURVEY, ABSTRACT
NO. 499, COLLIN COUNTY, TEXAS, TO THE CITY OF PLANO, TEXAS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Plano, Texas, has been petitioned to
annex a total of 1,029 acres of land, more or less, out of the
Joseph Russell Survey, Abstract No. 775, the Daniel Badgley Survey,
Abstract No. 111, and the Grizzell Kennedy Survey, Abstract No. 499,
Collin County, Texas; and
WHEREAS, a portion of said property, hereinafter described,

lies within the extraterritorial jurisdiction of the City of Allen,
Texas; and
WHEREAS, the City of Allen has been requested to relinquish
and waive its extraterritorial jurisdiction over said territory; and
WHEREAS, upon consideration of said request by the City
Council, the said City Council, on behalf of the City of Allen,
Texas, desires to relinquish and waive its extraterritorial juris-
diction over said territory unto the City of Plano, Texas, in
accordance with the provisions of Article 970a of Vernon's Revised
Civil Statutes of Texas:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PLANO,
TEXAS, THAT:
Section I. The City of Allen, Texas, hereby waives and
relinquishes unto the City of Plano, Texas, its extraterritorial
jurisdiction in accordance with the provisions of Article 970a of
Vernon's Revised Civil Statutes of Texas, to all that territory
described as follows:
BEING a tract of land situated within the Joseph Russell
Survey, Abstract No. 775, the Daniel Badgley Survey, Abstract
No. 111, and the Grizzell Kennedy Survey, Abstract No. 499,
j Collin County, Texas, and lying west of Alma Road, South of
Hedgcoxe Road, and east of Custer Road (FM 2478).
Section II.
The City of Allen hereby waives any objection to
the annexation of the above-described property by the City of Plano,
Texas, and does hereby consent and agree to such annexation by the
City of Plano, Texas.

Section III. This ordinance shall take effect immediately
from and after its passage, as the law in such case is provided.
