O-307-7-80l ORDINANCE NO. 307 AN ORDINANCE PROVIDING FOR OUTSIDE WATERING AND LANDSCAPE IRRIGATION; DECLARING AN EMERGENCY; PROVIDING AN EFFECTIVE DATE; PROVIDING A PENALTY FOR THE VIOLATION HEREOF; PROVIDING FOR FOR SEVERABILITY AND PUBLICATION OF THE CAPTION HEREOF WHEREAS, extreme weather conditions have generated unprecedented demands on area water storage capabilities; and, WHEREAS, the North Texas Municipal Water District has instituted a fifteen percent (150) curtailment on water availability in the northern portion of the District system; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: Section 1. That outside watering and landscape irrigation shall be prohibited between the hours of 10:00 a.m. and 10:00 p.m. each day with said time of usage curtailment to be enforced by the City Manager or employees so assigned. Section 2. That the public interest in maintaining adequate water storage for fire protection necessitate that an emergency be declared and that the ordinance shall become effective immediately upon passage until August 31, 1980 at which time this ordinance shall automatically expire. Section 3. That the penalty for violation of this ordinance shall be between $5.00 and $200.00 per violation occurance. Section 4. If any section, sub -section, sentence, clause, or other portion of this ordinance is found to be invalid by any competent regulatory agency, the remaining portions of this ordinance are declared to be severable and shall remain in full force and effect. Section 5. The caption of this Ordinance shall be published one time in a weekly newspaper published in the City of Allen, Texas, and shall be effective immediately upon its passage and such publication.
