O-411-9-82ORDINANCE NO. 411-9-82 AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, REPEALING ORDINANCES NO. 193, NO. 211, AND NO. 228, OF THE CITY OF ALLEN, TEXAS; PROVIDING FOR RATES TO BE CHARGED FOR WATER AND SEWER SERVICE; PROVIDING FOR COLLECTION OF SUCH RATES; PROVIDING FOR DISCONNECTION OF SERVICE; PROVIDING FOR WATER AND SEWER TAP RATES; PROVIDING FOR PENALTY OF VIOLATION OF THIS ORDINANCE; PROVIDING FOR A DEPOSIT FEE, AND INTEREST THEREON; PROVIDING FOR TEMPORARY WATER AND SEWER CONNECTION FEE; PROVIDING FOR METER SETTING CHARGE; AND PROVIDING FOR A PENALTY CLAUSE, A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. WHEREAS, a water and sewer rate study has been commissioned by and presented to the Allen City Council which indicates that net revenues to the water and sewer fund under the present rate structures will not be sufficient to produce the revenues needed to finance proposed and necessary improvements to the water system, support outstanding and authorized bond indebtedness, and to finance the increasing costs of operating the water system; and, WHEREAS, the Allen City Council desires to comply with the applicable provisions of the laws, rules, and regulations of State and Federal Agencies pertaining to the establishment of rate schedules and be in compliance with the City's bond ordinances; and, WHEREAS, after due consideration, the City Council of the City of Allen, Texas, has determined that the public -welfare would be best served by amending the present water and sewer rate structure to insure that the water and sewer systems will be self supporting. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: Ordinance No. 411-9-82 Page 2 WATER SERVICE CHARGES SECTION 1. There shall be charged and collected each month by the City from the consumers of water service, the amount of money hereinafter set out, based upon the following rates: The minimum monthly charges for standard 3/4" metered water service shall be $4.95, For a 1" meter service shall be $ 7.25 For a-12" meter service shall be $ 14.70 For a 2" meter service shall be $ 23.50 For a 3" meter service shall be $ 44.10 For a 4" meter service shall be $ 68.60 For a 6" meter service shall be $147.00 for which amount each customer will be allowed 1500 gallons of water. For larger consumption the rate shall be as follows: The next 8,500 gallons of water at $1.75 per thousand; The next 10,000 gallons of water at $1.10 per thousand; The next 10,000 gallons of water at $ .95 per thousand; In excess of 30,000 gallons of water at $ .60 per thousand; SANITARY SEWER SERVICE CHARGES SECTION 2. There shall be charged and collected each month by the City for sanitary sewer service the amounts of money here- inafter set out based on the following rates: (a) The minimum monthly sewer charge for any user shall be $6.45, which shall be charged any user whose water consumption for the month does not exceed 1500 gallons. Ordinance No. 411-9-82 Page 3 For larger consumption, the monthly sewer rate shall be as follows: The next 8500 gallons of water, $ .35 per 1000 gallons for all separately metered single family dwelling units or other residential dwelling units separately metered for water. The maximum charge for single family residential sewer service shall be $9.40 per month. All over 10,000 gallons of water, $ .35 per 1000 gallons for other than residential use, including mobile home parks, apartment complexes, commercial and industrial customers. (b) All mobile home parks, apartment complexes, commercial and industrial sewer customers shall be billed monthly on their total volume of water consumption. Water used in direct manufacturing process and/or irrigation can be exempted from sewer charges upon request and approval of the City in writing. (c) All industrial customers shall be billed an additional cost recovery charge of $ .04 per 1000 gallons. SECTION 3. That such rates and charges hereby shall be mailed by the City of Allen and shall be due and payable by the customers of the Waterworks and Sanitary Sewer System 12 days after billing date. Should the amount due upon the 12th day -not be paid in full, a ten percent (.100) penalty shall be added to the amount past due and unpaid, and a disconnection notice will be mailed to the customer stating the date which service will be discontinued if said bill remains unpaid. SECTION 4. The City shall simultaneously collect the respective amounts due the City for services supplied by the Waterworks and Sanitary Sewer System, and shall refuse to accept Ordinance No. 411-9-82 Page 4 partial payment for a part of such service, except upon approval by the city manager or the designated representative of same. SECTION 5. Should service be discontinued to any user or customer herein and the amount past due and delinquent be paid thereafter, such service may be resumed, but there shall be charged and collected a $10.00 fee for reconnection to the Waterworks System. There shall (be_a $20.00 fee for recon- nection to the Waterworks System after regular City Hall working hours. The reconnection charge for sewer service shall not be less than the actual cost to the City for disconnecting and reconnecting sewer service. SECTION 6. The Waterworks System shall be operated on a fully metered basis, to be in accordance with contractual agreements and bond indentures; therefore, no free service shall be allowed, and to the extent the City or any of its agencies or instrumentalities avail themselves of the services and facilities provided by the Waterworks and Sanitary Sewer System, they shall pay, therefore, the actual cost of service. SECTION 7. Before any customer, except as -provided for in Section 9, may obtain services from the Waterworks and Sanitary Sewer System, said customer must have on deposit with the City of Allen $35.00. Said deposit shall be returned when final service is rendered. (a) Beginning January 1, 1983, the Waterworks of the City will pay interest on deposits at a rate and in a manner to be determined by the City Council. SECTION 8. The tapping fee applicable to users of the City's Waterworks and Sanitary Sewer System shall be as follows: Ordinance No. 411-9-82 WATER 3/4 inch 1 inch 12 inch 2 inch 4 inch 6 inch SEWER 4 inch 6 inch Page 5 $ 205.00 $ 335.00 $ 465.00 $ 690.00 $2,625.00 $3,760.00 $ 175.00 $ 200.00 SECTION 9. There will be a temporary connection fee of $15.00 for persons requiring service for 7 days or less. The temporary connection service may be renewed in seven day increments to a maximum of 28 consecutive days. Water used in excess of 1,500 gallons will be billed according to the schedules set out in Sections 1 and 2 of this ordinance. SECTION 10. There will be a one-time meter setting charge of $80.00 for new residential service to be collected upon issuance of a building permit. . SECTION 11. Any person, firm or corporation who violates any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction, therefore, shall be fined any sum not to exceed $200.00 and each and every day that such violation continues shall be construed to be a separate offense; provided, however, that nothing contained herein shall preclude the municipality of bringing suit for injunction for the prevention of any threatened violation or the removal of any structure in violation of this ordinance. SECTION 12. This ordinance and the rates and charges herein prescribed shall be in effect from the November 1, 1982 billing. As of the effective date of this ordinance any and all Ordinance No. 411-9-82 Page 6 ordinances, resolutions and any orders in conflict herewith are repealed to the extent of the conflict. SECTION 13. That if any paragraph, section, clause, phrase or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part of provision thereof, other than the part so decided to be invalid or unconstitutional.
