O-474-11-83ORDINANCE NO. 474-11-83 16314 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, WAIVING ITS EXTRATERRITORIAL JURISDICTION TO AND OVER A TOTAL OF 310.085 ACRES OF LAND OUT OF THE THOMAS G. KENNEDY SURVEY, ABSTRACT NO. 500, AND THE DANIEL ROWLETT SURVEY, ABSTRACT NO. 738, COLLIN COUNTY, TEXAS, TO THE CITY OF PLANO, TEXAS; PROVIDING THAT SAID TERRITORY MAY BE ANNEXED TO AND MADE A PART OF THE CITY OF PLANO, TEXAS; PROVIDING FOR REVOCATION OF THE WAIVER, RELINQUISHMENT AND CONSENT OF THE CITY OF ALLEN HEREIN CONTAINED IF ANNEXATION PROCEEDINGS OF THE CITY OF PLANO, TEXAS, FOR THE SUBJECT PROPERTY ARE NOT COMPLETED WITHIN 180 DAYS AFTER PASSAGE OF THIS ORDINANCE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the owners of an approximate 870 acre tract of land, described by metes and bounds on Exhibit "A" attached hereto, being adjacent to the current city limits of the City of Plano, desire that said property be annexed into the corporate limits of the City of Plano; and, WHEREAS, the said property lies within the extraterritorial jursidiction of the City of Allen, Texas; and, WHEREAS, the City of Allen has been requested to, relinquish and waive its extraterritorial jurisdiction over said territory; and, WHEREAS, upon consideration of said request by the City Council, the said City Council, on behalf of the City of Allen, Texas, desires to relinquish and waive its extraterritorial jurisdiction over said territory unto the City of Plano, Texas, in accordance with the provisions of Article 970 (a) of Vernon's Revised Civil Statutes of Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, THAT: SECTION 1. The City of Allen, Texas, hereby waives and relinquishes unto the City of Plano, Texas, its extraterritorial jurisdiction in accordance with the Ordinance No. 474-11-83 - Page 1 OL 185Vrr.!'�_835 provisions of Article 970 (a) of Vernon's Revised Civil Statutes of Texas to all that territory consisting of 310.085 acres and described by metes and bounds on Exhibit rrBrr attached hereto and made a part hereof for all purposes. SECTION 2. The City of Allen hereby waives any objection to the annexation of the above-described property by the City of Plano, Texas, and does hereby consent and agree to such annexation by the City of Plano, Texas. SECTION 3. Nothing in this Ordinance is intended to nor shall have the affect of waiving or relinquishing any extraterritorial right or jurisdiction of the City of Allen to the property described in Section 1 hereof to any entity other than the City of Plano, Texas, and nothing in this Ordinance is intended to nor shall have the affect of constituting consent of the City of Allen to the annexation of the herein -described property by any entity other than the City of Plano, Texas. SECTION 4. Should the City of Plano, Texas, fail to complete the annexation proceedings for the hereinabove described property within 180 days after passage of this Ordinance, all waivers and relinquishments of extraterritorial rights and consent to annexation granted by this Ordinance shall be automatically revoked without further action of the City of Allen and this Ordinance shall become null and void. SECTION 5. This Ordinance shall take effect immediately in accordance with the provisions of the Allen City Charter and subject to the execution by all parties of the contract attached hereto as Exhibit "C" and made a part hereof for all purposes. Attachment to Ordinance No. 474-11-83, adopted on 11/3/83 Exhibit "C" October 25, 1983 Mr. Jon McCarty, City Manager City of Allen, Texas One Butler Circle Allen, Texas 75002 Dear Mr. McCarty: `gni 189-1-1-844 This letter will serve as a recitation of the agreement between the City of Allen, Collin County, Texas (hereinafter the "City"), and Cambridge Breezeway Joint Venture (hereinafter the "Joint Venture") with reference to the release by the City of all dominion and control over its extraterritorial jurisdiction (hereinafter referred to as its "ETJ") over a portion of the property owned by the Joint Venture, which is described more particularly hereinafter, in order to expedite annexation and zoning of said property by the City of Plano, Collin County, Texas. Now, therefore, the parties agree as follows: LETTER AGREEMENT 1. The parties hereto are the City of Allen, Collin County, Texas, a home rule municipality, acting by and through its City Manager, Jon McCarty, and Cambridge Breezeway Joint Venture, acting by and through its principals, Charles J. Wilson and William D. Parsons. 2. The Joint Venture represents that it presently owns the tract of land described in Exhibit "A" attached hereto and made a part hereof for all purposes, and further represents that in order to expedite annexation and zoning by the City of Plano, Collin County, Texas, it will be necessary for the City, prior to November 7, 1983, to release all dominion and control over, in and to that property presently situtated in the City's ETJ, and more particularly described in Exhibit "B" attached hereto and made a part hereof for all purposes, which, for the consideration hereinafter enumerated, the City hereby agrees to do. 3. The consideration for the City's agreement to release its dominion and control over, in and to that property more particularly described in Exhibit "B" attached hereto is as follows: Attachment to Ordinance No. 474-11-83, adopted on 11/3/83 Exhibit "C",' Mr. Jon McCarty October 25, 1983 Page 2 VOL 18501-- ,,i 845 a. The Joint Venture hereby grants to the City a 30' water line easement, a copy of which is attached hereto as Exhibit "C" and made a part hereof for all purposes, said easement being more particularly described in the attachment to Exhibit "C", in, to and across the property described in Exhibit A, said easement to be granted to the City immediately upon execution of this Letter Agreement. Provided, however, that in the event the City does not, by appropriate action on the part of its City Council, release, by November 7, 1983, its dominion and control over, in and to the property described in Exhibit "B" which is presently situated in the City's ETJ, then, in that event, the easement granted hereunder shall be null and void, and the Joint Venture shall be released from any and all obligations created by virtue of this Letter Agreement. Further provided, however, in the event the City does perform all obligations required by it hereunder on or before November 7, 1983, but fails to exercise the option to purchase, as detailed more particularly hereinafter, the four acre tract described more particularly below, then, in that event, the easement granted hereunder shall be null and void, and the Joint Venture shall be released from any and all obligations created by virtue of this Letter Agreement. b. The Joint Venture hereby grants to the City an option to purchase, for a period not to exceed twenty-four (24) months from the effective date the City releases its dominion and control over that property described in Exhibit "B" hereto, at a designated price of $60,000.00 per acre, four acres of land more particularly described in Exhibit "D" attached hereto and made a part hereof for all purposes. The City agrees that the designated use of the four acre tract described in Exhibit "D" shall be for ground storage, water tanks and all necessary ancillary structures attendant thereto. Provided, however, that in the event the City, within eighteen (18) months of the City's exercise of the option to purchase in question, has not let bids on the entire length of water line to be constructed within said 30' water easement and construction begun on said line, then the easement granted hereunder shall be null and void and the Joint Venture released from performance of all obligations thereunder. C. The Joint Venture hereby acknowledges that the City's willingness to accept the option to purchase the four -acre tract designated in Exhibit "D", as opposed to other, more preferable locations which the City might have purchased, will cause the City to incur additional construction costs associated with extending the City's water supply line, as discussed hereinafter. The Joint Venture agrees to reimburse the City for 100% of any such additional constructions costs associated with extending the City's point of delivery from the facility presently provided by the North Texas Municipal Water District, presently located approximately 300 feet west of the west right-of-way line of U.S. Highway 75, to the four acre site described in Exhibit "D" hereto. 4. In the event the City timely exercises the option to purchase the four acre tract granted hereunder, but thereafter fails, within eighteen (18) months of the exercise of the option to purchase, to let bids on the entire length of water line to be constructed and begin, within said eighteen (18) month period, construction on said line, then, in that event, the City hereby grants the Joint Venture the right, for a period of two (2)years, to repurchase the four acre tract described in Exhibit "D" hereto at the City's acquisition cost plus appreciation of ten percent (10%) annually from the date of purchase. City agrees that the easement herein granted to City is granted subject to the conditions that City: (a) In the exercise and use of the rights and privileges herein granted, will not create a nuisance; (b) Will, at City's sole cost and expense, maintain and repair the water line; and, (c) Will expedite the construction, repair, and/or maintenance of the water line so as to minimize any disruption of or interference with other persons' use of the Easement Tract and/or the property adjacent thereto, and will promptly restore said Easement Tract as closely as possible to its condition prior to such maintenance, replacement, removal or installation. 6.
