O-598-4-85ORDINANCE NO. 5 9 8- 4- 8 5 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF ALLEN, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOWING -DESCRIBED TRACT OF LAND FROM THE CURRENT ZONING DISTRICT CLASSIFICATIONS OF "R-2" (RESIDENTIAL) TO "R-5" (RESIDENTIAL WITH DEED RESTRUITInNR) ANn i.0 (r.n(- a r. RETAIL), SAID TRACT OF LAND BEING DESCRIBED AS FOLLOWS: APPROXIMATELY 9.18 ACRES MORE OR LESS, OUT OF THE PETER FISHER SURVEY, ABSTRACT NO. 324, COLLIN COUNTY, TEXAS; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE; PROVIDING AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR PUBLICATION OF A CAPTION. WHEREAS, the City Zoning Commission of the City of Allen, and the governing body of the City of Allen, in compliance with the laws of the State of Texas and the ordinances of the City of Allen, have given the requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all the property owners generally and to all persons interested and situated in the affected area and in the vicinity thereof, and in the exercise of its legislative discretion, have concluded that Comprehensive Zoning Ordinance should be amended; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: Section 1. That the Comprehensive Zoning Ordinance No. 366-10-81 of the City of Allen, Texas, as heretofore amended, be and the same is hereby amended by amending the Zoning Map of the City of Allen on a 9.18 acre tract of land described in Exhibit "A" attached hereto and made a part hereof for all purposes, by changing the zoning classifications from "R-2" (Residential) to give the following -described tracts of land the following zoning classifications, to -wit: That these areas be and the same are hereby zoned as follows: Tract A 5.0 Acres "R-5" Residential Tract B 4.1 Acres "LR" Residential Ordinance No. 598-4-85 - Page 1 i See Exhibit 1113" attached hereto and made a part hereof for all purposes showing the land use map for the property described in Exhibit "A" which shall be adhered in its entirety for purposes of development of said 9.18 acres of land. Section 2. That all ordinances of the City of Allen in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other provisions of said ordinance shall remain in full force and effect. Section 3. That the above-described tracts of land shall be used in the manner and for the purposes provided for by the Comprehensive Zoning Ordinance of the City of Allen, as heretofore amended, and as amended herein by granting of this zoning classification. Section 4. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of Allen, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each offense. Section 5. Whereas, it appears that the above-described property requires that it be given the above zoning classifications in order to permit its proper development and, in order to protect the public interest, comfort and general welfare of the City of Allen, creates and urgency and an emergency for the preservation of the public health, safety, and welfare, and requires that this ordinance shall take effect immediately from and after its passage and the publication of the caption of said ordinance, as the law in such cases provided.
