O-721-8-86ORDINANCE NO. 7 21- 8 - 8 6 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING SECTIONS 1, 2, AND 4 OF ORDINANCE NO. 429-2-83 AND ADDING THERETO SECTION 7a, FOLLOWING SECTION 7, OF ORDINANCE NO. 429-2-83 OF THE CITY OF ALLEN, TEXAS; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1. That from and after the effective date of this Ordinance, Sections 1, 2, and 4 of Ordinance No. 429-2-83 are hereby amended in the following manner and shall read as follows, to -wit: SECTION 1. Any overdue library material belonging to the collection of the Allen Public Library shall be subject to fines at the rate of $0.05 daily for each item up to $1.00 per item for children's materials, and of $0.10 daily for each item up to $3.00 per item for adult materials. SECTION 2. Any overdue videocassette housed in the Allen Public Library as part of a circulating collection shall be subject to fines at the rate of $0.50 per day. SECTION 4. Any library material belonging to the collection of the Allen Public Library that is lost shall be subject to payment of the current replacement price of the item in Books in Print. Such payment shall be reimbursed to the payer upon recovery of the item by the Allen Public Library. Should any lost library material no longer be available for purchase, replacement cost shall be determined by the librarian, based on the current Books in Print price of a comparable item on the same topic. SECTION 2. That from and after the effective, date of this Ordinance, Ordinance No. 429-2-83 is hereby amended by adding thereto and inserting therein, following Section 7 thereof, the following section to be known as Section 7a: SECTION 7a. Application to borrow materials from the library shall require the applicant to present whatever documents are deemed necessary by the librarian for adequate identification of the applicant. Initial borrower's card is free of charge; a fee of $2.00 will be charged for a replacement card. SECTION 3. That this ordinance shall be in full force and effect Ordinance No. 721-8-86 - Page 1 immediately from and after its adoption. Don Crowd , City Att6lRy Ordinance No. __ 721-8-86 - Page 2 ORDINANCE NO. 429-2-83 AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, ESTABLISHING A SCHEDULE OF FINES TO BE LEVIED FOR OVERDUE LIBRARY MATERIALS, DAMAGED LIBRARY MATERIALS, AND LOST LIBRARY MATERIALS; AND, PROVIDING FOR APPROPRIATE PROCEDURES TO BE FOLLOWED IN THOSE CASES WHERE OVERDUE LIBRARY MATERIALS HAVE NOT BEEN RETURNED. WHEREAS, the Allen Public Library Board has reviewed the present library fines and charges structure for overdue, damaged, and lost library materials; and, WHEREAS, a survey of other area public libraries has revealed the Allen Public Library fines structure to be out of line; and, WHEREAS, the Allen Public Library Board deems charging fines for overdue materials to be a fair and necessary method of encouraging the prompt return of library materials; and, WHEREAS, the Allen Public Library Board has determined that it is in the best interests of the City to establish procedures for use within the Library Department and, therefore, advises and recommends that the City Council of the City of Allen, Texas, approve this ordinance; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, THAT: SECTION 1. Any library material belonging to the collection of the Allen Public Library that is overdue shall be subject to fines at the rate of $0.05 daily for each item up to $1.00 per item. SECTION 2. Any video cassette housed in the Allen Public Library as part of a circulating collection that is overdue shall be subject to fines at the rate of $0.25 per day. SECTION 3. Any library material belonging to the collection of the Allen Public Library that is damaged beyond repair shall be subject to collection of damage Ordinance No. 429-2-83 - Page 1 charges up to its current price in Books in Print. Damaged materials which may be repaired by library staff shall be assessed a fine of $1.00. SECTION 4. Any library material belonging to the collection of the Allen Public Library that is lost shall be subject to payment of the current replacement price of the item in Books in Print. Such payment shall be reimbursed to the payer upon recovery of the item by the Allen Public Library. SECTION 5. Any fine monies and/or payments for lost, damaged, or overdue materials shall be collected by the librarian or library staff. SECTION 6. The failure to return overdue library materials which have been borrowed from the Allen Public Library will result in loss of borrowing privileges until the materials are returned or otherwise resolved. SECTION 7. The suspension of all fines may be allowed by the Library Director no more than once a year to encourage the return of overdue library materials. SECTION 8. It is the intention of the City Council that this ordinance, and every provision thereof, shall be considered severable, and the invalidity of any section, clause or provision of this ordinance shall not affect the validity of any other portion of this ordinance. SECTION 9. This ordinance shall become effective immediately upon its passage and publication as required by law.
