AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, AMENDING
SECTION 1-41 OF ORDINANCE NO. 259, AND THE CITY OF ALLEN
CODE OF ORDINANCES, CHAPTER 9, "MOTOR VEHICLES AND
TRAFFIC", ARTICLE V, "OPERATION OF VEHICLES", DMSION 2,
"SPEED REGULATIONS", SECTION 9-136. "EXPRESSWAYS;
FREEWAYS", SO AS TO CONFORM TO THE TEXAS MOTOR VEHICLE
LAWS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Allen, Texas, finds it necessary to
amend Section 1-41 of Ordinance No. 259, and Chapter 9, "Motor Vehicles and Traffic,
Article V, "Operation of Vehicles", Division 2, "Speed Regulations", Section 9-136,
"Expressways; freeways", of the City of Allen Code of Ordinances, so as to conform the
Texas Motor Vehicle Laws;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS, THAT:
SECTION 1. Section 1-41 of Ordinance No. 259, and Chapter 9, "Motor
Vehicles and Traffic", Article V, "Operation of Vehicles", Division 2, "Speed
Regulations", Section 9-136, "Expressways; freeways", of the City of Allen Code of
Ordinances are hereby amended in the following manner and shall read as follows,
to -wit:
"Sec. 9-136. Expressways; freeways.
A person commits an offense if he operates or drives a vehicle on
the following designated roads or highways at a speed greater than is
reasonable and prudent under the circumstances then and there existing.
Any speed in excess of the limit provided in this section shall be prima
facie evidence that the speed is not reasonable or prudent and that it is
unlawful:

SECTION 2. This ordinance shall be in full force and effect immediately
from and after its adoption.
