O-782-3-87ORDINANCE NO. 7 8 2- 3- 8 7 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING COMPREHENSIVE ZONING ORDINANCE NO. 366- 10-81, AS PREVIOUSLY AMENDED, SO AS TO CHANGE THE FOLLOWING -DESCRIBED TRACT OF LAND FROM "A-0" AGRICULTURE -OPEN SPACE TO "PD" PLANNED DEVELOPMENT NO. 44 TO INCLUDE SINGLE FAMILY, MULTY-FAMILY, AND SHOPPING CENTER USES, SAID TRACT OF LAND BEING DESCRIBED AS A 41.6 ACRE TRACT OF LAND LOCATED IN THE WILLIAM SNIDER SURVEY, ABSTRACT NO. 821, COLLIN COUNTY, TEXAS, AND RECORDED IN VOLUME 672, PAGE 82, DEED RECORDS, COLLIN COUNTY, TEXAS; PROVIDING FOR DEVELOPMENT CRITERIA; PROVIDING FOR LAND USE REGULATIONS; PROVIDING FOR A LAND USE PLAN; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE; PROVIDING FOR A SEVERABII,ITY CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE OF SAID ORDINANCE. WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen, in compliance with the laws of the State of Texas and the ordinances of the City of Allen, have given the requisite notice by publication and otherwise; and after holding due hearings and affording a full and fair hearing to all the property owners generally and to all persons interested and situated in the affected area and in the vicinity thereof, and in the exercise of its legislative discretion, have concluded that Comprehensive Zoning Ordinance No. 366-10-81, as previously amended, should be amended; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1. That Comprehensive Zoning Ordinance No. 366-10-81 as previously amended, be, and the same is hereby amended, by amending the Zoning Map of the City of Allen on a 41.6 acre tract of land located in the William Snider Survey, Abstract No. 821, Collin County, Texas, recorded in Volume 672, Page 82, Deed Records, Collin County, Texas, said tract of land being described in Exhibit "A" attached hereto and made a part hereof for all purposes and being further described as being the southwest corner of F.M. 2551 and F.M. 2170, by changing the zoning Ordinance No. 782-3-87 - Page 1 classification from "A -O" Agriculture -Open Space to "PD" Planned Development No. 44. SECTION 2. That the Use Regulations and Development Criteria described as Exhibit "B" and attached hereto and made a part hereof for all purposes shall be the governing regulations for "PD" Planned Development No. 44. SECTION 3. That the Land Use Plan approved and described as Exhibit "C" attached hereto and made a part hereof for all purposes shall be adhered to in its entirety for the purposes of development of "PD" Planned Development No. 44. SECTION 4. That all ordinances of the City of Allen in conflict with the provisions of this ordinance shall be, and the same are hereby repealed; provided however, that all other provisions of said ordinances not in conflict herewith shall remain in full force and effect. SECTION 5. That the property described in Exhibit "A" attached hereto shall be used in the manner and for the purposes provided for as approved by the attachments of Exhibits "B" and "C,►. SECTION 6. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in Comprehensive Zoning Ordinance No. 366-10-81, as previously amended, and upon conviction shall be punished by a fine not to exceed the sum of one thousand dollars ($1,000.00) for each offense. SECTION 7. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and if any phrase, clause, sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council hereby declares it would have passed the remaining portions even though it had known the affected parts would be held unconstitutional. SECTION 8. That this ordinance shall take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained. INTRODUCTION AND DEVELOPMENT CONCEPT Stonebrook, an approximate 41.6 acre site, is located at the southwest corner of F.M. 2170 and F.M. 2551. A Planned Development, to include Single Family, Multi -Family and Shopping Center uses is proposed. The proposed Planned Development is located within Neighborhood Planning - Area 26 according to the Comprehensive Plan for the City of Allen. Neighborhood Planning Area 26 contains approximately 896 acres of land, of which 481 have already been zoned. The remaining 415 acres, according to the Comprehensive Plan for the City of Allen, are designated for the following land uses: Low density residential - approximately 286 acres, Medium density residential - approximately 38' acres, High density residential - approximately 25 acres, Open Space - approximately 51 acres, and Commercial - approximately 14.5 acres. The proposed Planned Development is located at the intersection of two future six lane, divided thoroughfares. F.M.. 2551 will be realigned, as shown on the City of Allen Thoroughfare/ Comprehensive Plan, to create this intersection. After the newly aligned F.M. 2551 has been platted and construction is completed, the existing curved section of the road will be abandoned as indicated on the attached Zoning Exhibit. The Comprehensive Plan shows this intersection as the only remaining area within Neighborhood Planning Area 26 designated for commercial zoning. With this information as background, Stonebrook, a Planned Development, is proposed as outlined herein. 1 II. ZONING DISTRICTS A. "SF -D" SINGLE FAMILY DETACHED DISTRICT (TRACT "A") 1. Purpose - This district will be composed of single family, detached dwellings within four Sub -districts ( "A-1", "A-2", "A-3" and "A-4"). These Sub -districts will allow for flexibility in design and a balance of dwelling types and sizes, appropriate for their location in relation to the proposed development and to adjacent land uses. This entire district, including Sub -districts "A-1", "A-2"3- "A-3" and "A-4" will provide for 3.5 dwelling units per gross acre or a maximum of sixty-seven (67) units. 2. Use Requirements - Unless otherwise noted in Sub -district "A-1", "A-2", "A-3" or "A-4", a building or premise shall be used only for the following purposes: a. Single family, detached units as outlined herein b. Uses as provided in Article III, Section 3.01(B), No. 2 "Use Regulations" as established in the Comprehensive Zoning Ordinance for the City of Allen, Ordinance No. 366-10-81 c. Such uses as may be permitted under the provisions of Section 2.06, Specific Use Permits, of the Comprehensive Zoning Ordinance for the City of Allen, Ordinance No. 366-10-81 3. Height Requirements - No building shall exceed thirty (30) feet or two and one-half (2-1/2) stories in height. 4. Area Requirements - Shall be as noted for each Sub -district. 5. Building Materials - All main buildings shall have exterior construction of a minimum of 75% brick, tiles, cement, concrete, stone, or similar materials. 2 Sub -district "A-1" Single Family Detached A. Area Requirements 1. Size of Yards: 1 (a) Front Yard - There shall be a front yard having a depth of not less than twenty-five (25) feet. (b) Side Yard - There shall be a side yard on each side of the lot having a width of not less than ten (10) percent of the lot width. A side yard adjacent to a side street shall not be less than fifteen (15) feet. (c) Rear Yard - There shall be a rear yard having a depth of not less than fifteen (15) feet. 2. Site of Lot: (a) Lot Area - No building shall be constructed on any lot less than seven thousand, two hundred (7,200) square feet. The average lot size in this Sub -district shall be seven thousand, five hundred (7,500) square feet. (b) Lot Width - The width of any lot shall not be less than sixty-five (65) feet, except that a corner or cul-de-sac lot may have a minimum width of fifty-five (55) feet at the building line provided that other requirements of this section are fulfilled. (c) Lot Depth - The depth of any lot shall not be less than one hundred ten (110) feet, except that a corner or cul-de-sac lot may have'a minimum depth of one hundred (100) feet provided that other requirements of this section are fulfilled. 3. Minimum Dwelling Size - The minimum floor area of any dwelling unit shall be one thousand, two hundred (1,200) square feet. 4. Lot Coverage - In no case shall more than forty (40) percent of the total lot area be covered by the combined area of the main building and the accessory buildings. 3 Sub -district "A-2" Single Family Detached A. Area Requirements 1. Size of Yards: (a) Front Yard - There shall be a front yard having a depth of not less than twenty-five (25) feet. (b) Side Yard - There shall be a side yard on each side of the lot having a width of not less than ten (10) percent of the lot width. A side yard adjacent to a side street shall not be less than. fifteen- (15) feet. (c) Rear Yard - There shall be a rear yard having a depth of not less than fifteen (15) feet. 2. Size of Lot: (a) Lot Area - No building shall be constructed on any lot less than seven thousand, five hundred (7,500) square feet. Lots adjacent to the west property line, as indicated on the attached Zoning Exhibit, shall have a minimum of eight thousand (8,000) square feet. (b) Lot Width - The width of any lot shall not be less than sixty-five (65) feet, except that a corner or cul-de-sac lot may have a minimum width of fifty-five (55) feet at the building line provided that other requirements of this section are fulfilled. (c) Lot Depth - The depth of any lot shall not be less than one hundred ten (110) feet, except that a corner or cul-de-sac lot may have a minimum depth of one hundred (100) feet provided that other requirements of this section are fulfilled. 3. Minimum Dwelling Size - The minimum floor area of any dwelling unit shall be one thousand, two hundred (1,200) square feet. The minimum unit size on lots adjacent to the west property line shall be one thousand, four hundred (1,400) square feet. 4. (c) Lot Depth - The depth of any lot shall not be less than one hundred ten (110) feet, except that a corner or cul-de-sac lot may have a minimum depth of one hundred (100) feet provided that other requirements of this section are fulfilled. 3. Size of Lot: (a) Lot Area - No building shall be constructed on any lot less than ten thousand (10,000) square feet. Lots adjacent to the west property line, as indicated on the attached Zoning Exhibit, shall have a minimum of fourteen thousand (14,000) square feet. (b) Lot Width - The width of any lot shall not be less than seventy-five (75) feet, except that a corner or cul-de-sac lot may have a minimum width of sixty-five (65) feet at the building line provided that other requirements of this section are fulfilled. (c) Lot Depth - The depth of any lot shall not be less than one hundred twenty (120) feet. 3. Minimum Dwelling Size - The minimum floor area of any dwelling unit shall be one thousand, eight hundred (1,800) square feet. The minimum unit size on lots adjacent to the west property line shall be two thousand (2,000) square feet. 4. Lot Coverage - In no case shall more than thirty-five (35) percent of the total lot area be covered by the combined area of the main building and the accessory buildings. 0 B. "MF" MULTI -FAMILY RESIDENTIAL DISTRICT (TRACT "C") 1. Purpose - This district provides a higher -density dwelling classification in the form of attached dwelling units. This district will provide for a maximum of 198 dwelling units. 2. Use Requirements - A building or premise shall be used only for the following purposes: a. Any use permitted in the Single Family Detached zoning district including Sub -districts "A-1", "A-2", "A-3" and "A-4" b. Multi -family dwellings as outlined herein c. Any use permitted in the "MF -3" Multi -Family Residential District of the Comprehensive Zoning Ordinance for the City of Allen as indicated below in Section 4 NOTE:, All uses that are permitted within this district shall be governed by the requirements as set forth for that particular type of use which is proposed for development. 3. Area and Building Requirements a. Requirements -All sites and buildings shall be developed in accordance with those area and building requirements as established for the "MF -3" Multi -Family Residential District in the Comprehensive Zoning Ordinance for the City of Allen as indicated below in Section 4, unless otherwise noted above. 4. "MF -3" Multi -Family 3 District Regulations a. Use Regulations - A building or premise shall be used only for the following purposes: I. Any use permitted in District "MF -1". 2. Multi -family dwellings. 3. Dormitories for students. 4. Fraternity or sorority houses. 5. Accessory buildings and uses, customarily incident to the above uses and located on the same lot therewith not involving the conduct of a retail business. 6. Such uses as may be permitted under the provision of Section 2.06, Specific Use Permits. b. Height Regulations - No building shall exceed thirty (30) feet or two and one-half (2-1/2) stories in height, except that a building may be erected to a height of eighty (80) feet and eight (8) stories if set back from all required yard lines a distance of one (1) foot for each two (2) feet of additional 7 height above thirty (30) feet. c. Area Regulations - 1. Size of Yards (a) Front Yard - There shall be a front yard having a required depth of not less than twenty (20) feet. (b) Side Yard - There shall be a side yard on each side of the lot having a width of not less than ten (10) feet. A side yard adjacent to a side street shall not be less than fifteen (15) feet. (c) Rear Yard - There shall be a rear yard having a required depth of not less than twenty (20) feet. 2. Size of Lots (a) Lot Area - No building shall be constructed on any lot less than fourteen thousand (14,000) square feet. Such lot shall have a minimum buildable area of fifty- six hundred (5,600) square feet. No lot shall contain less than twenty-four hundred (2,400) square feet per dwelling unit. (b) Lot Width - The width of the lot shall not be less than eighty-five (85) feet at the front street building line. (c) Lot Depth - The depth of the lot shall not be less than one hundred five (105) feet. 3. Lot Coverage - In no case shall more than fifty (50) percent of the total area be covered by the combined area of the main buildings and the accessory buildings. 4. Minimum Dwelling Size - The minimum floor area of any dwelling unit shall be 500 square feet, with an average of no less than 775 square feet, exclusive of garages, breezeways, and porches. d. Building Regulations - I. Type of Materials - All main buildings shall have an exterior construction of a minimum of 75 percent brick, tiles, cement, concrete, stone, or similar materials. P. C. "SC" SHOPPING CENTER DISTRICT (TRACT -B") 1. Purpose - This district provides for medium intensity concentrations of shopping and related commercial activity characteristic of the trend of urban development to the decentralization of retail business facilities. The requirements in this district are designed to make permissible uses compatible with and serving the adjacent residential areas. 2. Use Requirements - A building or premise shall be used only for the following purposes: a. Any use as permitted in the "SC" Shopping Center District, Section 3.01 (M), of the Comprehensive Zoning Ordinance for the City of Allen, Ordinance No. 366-10-81 b. Such uses as may be permitted under the provisions of Section 2.06, Specific Use Permits, of the Comprehensive Zoning Ordinance for the City of Allen, Ordinance No. 366-10-81. NOTE: All uses that are permitted within this district shall be governed by the requirements as set forth for that particular type of use which is proposed for development. 3. Height Requirements - No building shall exceed thirty (30) feet or two (2) stories in height. 4. SITE PLAN REVIEW No building permit shall be issued for the construction of buildings within a development area until a detailed site plan of the development area has been submitted to and approved by the Allen Planning and Zoning Commission and City Council as being in compliance with the development concept and the approved Planned Development Ordinance. At the time of platting and/or site plan review, plans for drainage and management of storm water runoff must be submitted and approved by the Allen City Staff. No building permit shall be issued until this step is taken.
