O-790-5-87ORDINANCE NO. 790-5-87 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, REPEALING ORDINANCE NO. 671-1-86, AND AMENDING PLANNED DEVELOPMENT ZONING ORDINANCE NO. 507-5-84, TO INCLUDE THE ATTACHMENT OF EXHIBIT "E", AMENDED APPROVED CONCEPT PLAN, LAND USE, AND AREA REGULATIONS FOR DEVELOPMENT OF THE 356.7 ACRES OF LAND OUT OF THE 408.57 ACRE TRACT LOCATED IN THE G. W. FORD SURVEY, ABSTRACT NO. 328, AND THE R. C. WHISENANT SURVEY, ABSTRACT NO. 1012, COLLIN COUNTY, TEXAS, PRESENTLY DELINEATED ON THE OFFICIAL ZONING MAP AS PLANNED DEVELOPMENT NO. 22; PROVIDING FOR A PENALTY; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION OF THE CAPTION. WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen, in compliance with the laws of the State of Texas and the ordinances of the City of Allen, have given the requisite notices by publication and otherwise; and, WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen have held due hearings and afforded a full and fair hearing to all the property owners generally and to all persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen, in the exercise of its legislative discretion, have concluded that Ordinance No. 671-1-86 should be repealed and have further concluded that Planned Development Zoning Ordinance No. 507-5-84 should be amended to include the attachment of Exhibit "Ell, amended approved concept plan, land use plan, and area regulations for development of 356.7 acres of land out of the 408.57 acre tract located in the G. W. Ford Survey, Abstract No. 328, and the R. C. Whisenant Survey, Abstract No. 1012, Collin County, Texas, presently delineated on the Official Zoning Map as Planned Development No. 22. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: Ordinance 790-5-87 - Page 1 SECTION 1. That from and after the effective date of this ordinance, Ordinance No. 671-1-86 is hereby repealed. SECTION 2. That Planned Development Zoning Ordinance No. 507-5-84 of the City of Allen is hereby amended to include the attachment of Exhibit "E", amended approved concept plan, land use plan, and area regulations for development of 356.7 acres of land out of the 408.57 acre tract located in the G. W. Ford Survey, Abstract No. 328, and the R. C. Whisenant Survey, Abstract No. 1012, Collin County, Texas, presently delineated on the Official Zoning Map as Planned Development No. 22. SECTION 3. That all ordinances of the City of Allen in conflict with the provisions of this ordinance shall be, and the same hereby are, repealed; provided, however, that all other provisions of said ordinances not in conflict herewith shall remain in full force and effect. SECTION 4. That the above-described tract of land shall be used in the manner and for the purposes provided for by Planned Development Zoning Ordinance No. 507-5-84 of the City of Allen as amended herein by the approval of the attachment of Exhibit "Ell. SECTION 5. That any person, firm, or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in Planned Development Zoning Ordinance No. 507-5-84 of the City of Allen, and upon conviction shall be punished by a fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each offense. SECTION 6. That it appears the above-described property requires a concept plan, a land use plan, and area regulations in order to permit its proper development and in order to protect the public interest, comfort, and general welfare of the City of Allen, creates an urgency and an emergency for the preservation of the public health, safety and welfare, and requires that this ordinance shall take effect immediately from and after its passage and publication of the caption of said ordinance as the law in such cases provides. This document is an amendment to the existing planned development that was finalized on January 2nd, 1986. Our amendment does not include any changes in the existing multi -family or shopping center areas. The request is for the purpose of rearrangement of uses on the Southern portion of the community and more detailed definement of the Site Plan due to floodplain and engineering elements of finalization These adjustments to the Site Plan continue to keep the Heritage Park Community attuned to the current market demands and overall camlunity needs. With this continued effort by the Bethany 409 Development and the City of Allen, the Heritage Park Community will continue to grow at a rapid pace. Without the flexibility of Planned Development adjustments and continued awareness of market needs and trends this needed growth will falter and cane to an abrupt halt. The following items represent the highlights of the four year comamittment of the Bethany 409 Group as the ocimiunity has progressed. I. Development of the major infrastructure that borders the community, Bethany Road Bridge, Bethany Road, and Allen Heights Drive resulting in 21 million Dollars in development costs. II. Development of Heritage Park Phase One, 268 Units, consisting of 8000 to 12000 S.F. Lots. III. Working in conjunction with the City of Allen Parks Department in develop- ment of the perimeter roadways surrounding Pete Ford Park. - IV. Dedication of a Fire Station at the corner of Bethany Road and Heritage Parkway. V. Final design plans prepared for development of the Open Space corridor of 33.209 acres in accordance with the new City of Allen Greenbelt and Linear Park Study criteria. VI. Final design plans prepared for developnent of the Phase ZWo, ZWirrPlex project consisting of 22.8 acres and 152 units. VII. Final design plans prepared for development of Phase Three, Single Family project 'consisting of 57.0 acres and 209 units. -1- The following items represent primary elements of the amendments involved. The details of each request are provided in the submittal package. I. Elimination of an over abundance -of the Turin-Plex Product on the Southern portion of the camnunity. II. Provisions for a continuation of Single Family Detached product, that encanpasses 95% of the residential uses. III. Provisions of Oanmunity Design that will continue to allow the Heritage Park catmunity to develop at a well paced standard IV. Adhering to the oanprehensive plan for low density residential uses. V. Providing a variation of lot sizes with innovative planning and design techniques. VI. Providing a committment of constructing two lanes of Chaparral Road extending to the Eastern property line of Cottonwood Bend Phase Four, consisting of approximately 4800 L.F.. If for political reasons there are P.O.W. & property acquisition problems and this cannot be acconplished, as an alternate the Bethany 409 Joint Venture will provide the construc- tion of an eight foot pedestrian path encompassing the Mustang Branch Cottonwood Creek Drainage Basin involving our property limits. This Linear Path System will consist of approximately 12,000 L.F. costing approximately $200,000. General: This tract is designated for single family use. The maximum number of units in this Tract shall not exceed two hundred sixty-eight (268) 2.
