O-913-3-8930AJ303 1999 APR 24 Ptd 4: 29 COLL114 01IN1 iC,'{A s ; ORDINANCE NO. 913-3-89 HY DIFI IT AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ACCEPTING THE IMPROVEMENTS ON A PORTION OF JUPITER ROAD, FURTHER DESCRIBED AS BEING A PORTION OF JUPITER ROAD FROM F.M. 2170 TO THE INTERSECTING POINT OF THE CONCRETE IMPROVED ROAD SECTION NORTH OF WHITE OAK DRIVE, SAID PORTIONS BEING HEREINAFTER DESCRIBED AND IN THE CITY OF ALLEN, COLLIN COUNTY, TEXAS; PROVIDING FOR THE ATTACHMENT OF EXHIBIT "A" CORRECTING THE ROLLS AND ESTIMATES THEREOF; AMENDING CITY OF ALLEN ORDINANCE NO. 760-11-86, SECTION 5(D), ORDINANCE NO. 764-11-86, SECTION 3(d), AND ORDINANCE NO. 770-12-86, SECTION 7, BY ALTERING THE TIME AND MANNER FOR PAYMENTS OF SUCH ASSESSMENTS; DECLARING AN EMERGENCY; AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UPON ITS PASSAGE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1. That a portion of Jupiter Road described as being a portion of Jupiter Road from F.M. 2170 to the intersecting point of the concrete improved road section north of White Oak Drive has been improved in accordance with the plans and specifications thereof and as required by contract. The Department of Engineering has examined and inspected the completed improvements and it is hereby found that said work and improvements have been performed and completed in compliance with the terms of said contract and are hereby accepted and approved by said City Council. SECTION 2. That the City of Allen hereby approves the corrected Engineer's Roll and completes the levying of assessments as described in Exhibit "A" attached hereto and made a part hereof. SECTION 3. That from and after the effective date of this ordinance, a necessity exists to amend City Ordinance No. 760-11-86, Section 5(D), Ordinance No. 764-11-86, Section 3(d), and Ordinance No. 770-12-86, Section 7, by amending the time and manner proposed for payments of such costs, to wit: When the improvements herein ordered have been completed and accepted by the City of Allen, the amount of the assessment against each property abutting thereon, and the real and true owners thereof, shall be and Ordinance No. 913-3-89 - Page 1 4'P 0' 5 become payable in five (5) equal annual installments due respectively one year, two years, three years, four years, and five years from the date of acceptance by the City of Allen, together with interest on the unpaid balance that accrues beginning one year after the date of acceptance until paid at the rate of eight (8) percent per annum, payable annually; provided, however, that the owners of any said property shall have the privilege of paying all or any of said installment at any time before maturity thereof by paying the total amount of such installment together with the interest accrued thereon to the date of payment. Further, if default be made on the payment of any of said installment of principal or interest promptly as the same matures, then at the option of the City of Allen the entire amount of the assessment upon which default is made, together with reasonable attorney's fees, and all collection costs incurred, shall be and become immediately due and payable. SECTION 4. That the City Manager is hereby authorized and directed to initiate or cause to be initiated procedures to collect the first and subsequent installments in accordance with the amended terms of Ordinance No. 760-11-86, Section 5, Ordinance No. 764-11-86, Section 3, and Ordinance No. 770-12-86, Section 7, with regard to the prescribed assessments. SECTION 5. That in order to protect the public interest, comfort, and general welfare of the City of Allen, the adoption of this ordinance creates an emergency for the preservation of the public health, safety, and welfare, and requires that this ordinance shall take effect immediately from and after its passage and the publication of the caption of said ordinance as the law in such cases provides.
