AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS,
AMENDING ORDINANCE NO. 429-2-83, AS PREVIOUSLY AMENDED BY
ORDINANCE NO. 721.8-86, AND CHAPTER 7, ARTICLE I, SECTION 7-2, OF THE
ALLEN CODE OF ORDINANCES BY PROVIDING A SCHEDULE OF FINES AND
FEES TO BE CHARGED FOR THE LATE RETURN, LOSS OR DAMAGE OF
LIBRARY MATERIALS; PROVIDING FOR APPROPRIATE PROCEDURES TO BE
FOLLOWED IN THOSE CASES WHERE OVERDUE LIBRARY MATERIALS HAVE
NOT BEEN RETURNED; AND PROVIDING FOR, AN EFFECTIVE DATE.
WHEREAS, the Allen Public Library Board has reviewed the present library fines and fees structure
for overdue, damaged and lost library materials; and,
WHEREAS, a survey of other area public libraries has revealed the Allen Public Library fines
structure to be out of line; and,
WHEREAS, the Allen Public Library Board deems charging fines for overdue materials to be a fair
and necessary method of encouraging the prompt return of library materials; and,
WHEREAS, the Allen Public Library Board has determined that it is in the best interests of the city
to establish procedures for use within the Library Department and, therefore, advises and recommends
that the City Council of the City of Allen, Texas, approve this ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCEL OF THE CITY OF ALLEN,
TEXAS:
From and after the effective date of this ordinance, Ordinance No. 429-2-83, as previously
amended by Ordinance No. 721-8-86, and Chapter 7, Article I, Section 7-2 of the Allen Code of
Ordinances are hereby amended as follows:
SECTION 1: That application to borrow materials and equipment from the library shall require the
applicant to present whatever documents are deemed necessary by the librarian for adequate
identification of the applicant. The initial borrower's card is free of charge; a fee of $2.00 will be
required for replacement of a valid card.
SECTION 2: That fines shall be collected for failure to return, at the due date, any books or other
library materials and equipment which have been loaned to holders of library cards. The schedule for
fines and fees is attached hereto as Exhibit "A" and made a part hereof for all purposes.
SECTION 3: That fees for repair or replacement of damaged or lost library materials or equipment
shall be collected according to the schedule attached hereto as Exhibit "A." Payment for lost
materials shall be reimbursed to the payer upon recovery within six months by the Allen Public
Library. Processing fees will not be reimbursed.
SECTION 4: That the failure to return library materials which have been borrowed from the Allen
Public Library shall result in loss of borrowing privileges until the materials are returned or otherwise
resolved.
SECTION 5: That any fines and/or payments for lost, damaged or overdue materials shall be
collected by the librarian or library staff.
SECTION 6: That the suspension of all fines may be allowed by the Library Director no more than
once a year to encourage the return of overdue library materials.
SECTION 7: That it is the intention of the City Council that this ordinance, and every provision
thereof, shall be considered severable; and the invalidity of any section, clause or provision of this
ordinance shall not affect the validity of any other portion of this ordinance.
SECTION 8: That this ordinance shall become effective immediately upon its passage and
publication as required by law.
