O-1062-11-91ORDINANCE NO. 1062-11-91 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, REPEALING ORDINANCE NO. 71 AND ARTICLE VI, 'BILLIARD TABLES, - CHAPTER 8, OF THE CODE OF ORDINANCES, CITY OF ALLEN, TEXAS, AND AMENDING SECTION 14 OF ORDINANCE NO. 393-5-82 AND SECTION 8-39, -RESPONSIBILITY OF PERMITTEE,- DIVISION 2, -SKILL OR PLEASURE MACHINES,- ARTICLE H, -COIN-OPERATED MACHINES,- CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF ALLEN, TEXAS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1: That from and after the effective date of this ordinance, Ordinance No. 71 and Article VI, `Billiard Tables," Chapter 8, of the Code of Ordinances, City of Allen, Texas, are hereby repealed. SECTION 2: That from and after the effective date of this ordinance, Section 14 of Ordinance No. 393-5-82 and Section 8-39, "Responsibility of permittee," Division 2, "Skill or Pleasure Machines," Article II, "Coin -Operated Machines," Chapter 8 of the Code of Ordinances, City of Allen, Texas, are hereby amended to read as follows: "Responsibility of permittee. A permittee under this division shall not permit any of the following activities within the permitted premises: (1) The sale, purchase, possession or consumption of any alcoholic beverages, as defined by the Texas Alcoholic Beverage Code, unless the premises are licensed under the provisions of said code and the ordinances of the city for the sale, purchase, possession or consumption of alcoholic beverages. (2) Employment of an operator who is under eighteen (18) years of age. (3) Prostitution. (4) Gambling. (5) Violation of any possession, sale or delivery provision in Subchapter 4 of the Texas Controlled Substances Act. (6) The operation of any skill or pleasure coin-operated machine by a person under 17 years of age after midnight. (7) The operation of any skill or pleasure coin-operated machine by a student of any public or private elementary or secondary school on school days during the hours when school is in session and the student is required to be in attendance." SECTION 3: That it is the intention of the City Council that this ordinance and every provision thereof shall be considered severable and the invalidity of any section, clause, provision, or part or portion of any section, clause, or provision of this ordinance shall not affect the validity of any other portion of this ordinance. SECTION 4: That this ordinance shall become effective from and after the date of its passage and publication as required by law.
