This amendment (Ordinance No. 1074-2-92) to the Code of Vehicle and Traffic
Ordinances (Ordinance No. 259, as previously amended by Ordinance No. 777-2-87) has
been duly adopted by the governing body of the City of Allen on this 6th day of February,
A.D., 1992, in the manner required by law and does hereby amend Chapter 9, Article V,
Division 2, Section 9-136 of the Allen Code of Ordinances and Article VI, Division 2,
"Speed Regulations," Section 1-41, "Expressways and Freeways," of the Allen Vehicle
and Traffic Code, also known by its short. title of "Allen Traffic Ordinances," and shall
become effective immediately from and after its passage and publication as required by
law., �

AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, AMENDING CHAPTER 9,
-MOTOR VEHICLES AND TRAFFIC,- ARTICLE V, "OPERATION OF
VEHICLES," DIVISION 2, -SPEED REGULATIONS,- SECTION 9-136,
"EXPRESSWAYS; FREEWAYS,- OF THE ALLEN CODE OF ORDINANCES SO AS
TO CONFORM TO THE TEXAS MOTOR VEHICLE LAWS; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Allen, Texas, finds it necessary to amend Chapter 9,
"Motor Vehicles and Traffic," Article V, "Operation of Vehicles," Division 2, "Speed Regulations,"
Section 9-136, "Expressways; freeways," of the Allen Code of Ordinances so as to conform to the
Texas Motor Vehicle Laws;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS:
SECTION 1: That Chapter 9, "Motor Vehicles and Traffic," Article V, "Operation of Vehicles,"
Division 2, "Speed Regulations," Section 9-136, "Expressways; freeways," of the Allen Code of
Ordinances, and any other ordinance, or portion thereof, in conflict herewith, be and the same is
hereby amended in the following manner and shall read as follows, to -wit:
"Sec. 9-136. Expressways; freeways.
A person commits an offense if he operates or drives a vehicle on the following
designated roads or highways at a speed greater than is reasonable and prudent under
the circumstances then and there existing. Any speed in excess of the limit provided
in this section shall be prima facie evidence that the speed is not reasonable or prudent
and is unlawful:

All portions within the city

As set forth in compliance
with the speed limits set by
the State of Texas in Vernon's
Annotated Civil Statutes."
SECTION 2: This ordinance shall become effective immediately from and after its passage and
publication as required by law.
