Consent Agenda MOTION: Upon a motion made by Councilmember Clemencich and a second by Mayor Pro Tem Schulmeister, the Council voted seven (7) for and none (0) opposed, to approve all items on the Consent Agenda as follows: 5.1 Approve minutes of the August 19-20,2022,City Council Budget Workshop. 5.2 Approve minutes of the August 23,2022,Regular City Council Meeting. 5.3 Adopt a Resolution designating The Allen American and The Dallas Morning News as the official newspapers of the City of Allen for Fiscal Year 2022-2023. RESOLUTION NO.3938-9-22(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, DESIGNATING THE ALLENAMERICAN AND THE DALLAS MORNING NEWS AS THE OFFICIAL NEWSPAPERS OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, FOR FISCAL YEAR 2023; AND PROVIDING AN EFFECTIVE DATE. 5.4 Award bid and authorize the City Manager to execute an annual contract with Standard Utility Construction, Inc., for maintenance of city-owned street lights for an annual amount not to exceed$325,000. 5.5 Award bid and authorize the City Manager to execute a contract with Infra Construction, LLC,for the construction of the Bethany Lakes Loop Trail for$522,362. Mayor Fulk announced Agenda Items 6.3 and 6.4. 6.3 Conduct a Public Hearing on the Fiscal Year 2022-2023 Budget as required by Article IV, Section 4.04 of the Allen City Charter and adopt an Ordinance approving the Fiscal Year 2022-2023 Budget,amending the Fiscal Year 2021-2022 Budget,and approving the 2023-2027 Capital Improvement Program. 6.4 Conduct a Public Hearing regarding the Fiscal Year 2022-2023 City Tax Rate and adopt an Ordinance setting the Tax Rate for the Fiscal Year 2022-2023 Budget. The motion failed. MOTION: Upon a motion made by Councilmember Trahan and a second by Councilmember Shafer, the Council voted four (4) for and three (3) opposed with Mayor Fulk, Mayor Pro Tern Schulmeister, and Councilmember Clemencich casting the negative votes, to reconsider the previous vote to ratify the increase in property tax revenues reflected in the Fiscal Year 2022- 2023 budget. The motion carried. MOTION: Upon a motion made by Councilmember Trahan and a second by Councilmember Shafer, the Council voted three (3) for with Councilmembers Meis, Corneae, and Shafer voting in favor and four (4) opposed with Mayor Fulk, Mayor Pro Tem Schulmeister, and Councilmembers Clemencich and Trahan casting the negative votes, and to ratify the increase in property tax revenues reflected in the Fiscal Year 2022-2023 budget. The motion failed. The motion carried. ORDINANCE NO.3942-9-22: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, LEVYING THE AD VALOREM TAXES FOR THE TAX YEAR 2022 (FISCAL YEAR 2022-2023) AT A RATE OF $0.429 PER ONE HUNDRED DOLLARS($100)ASSESSED VALUATION ON ALL TAXABLE PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY OF ALLEN AS OF JANUARY 1, 2022, TO PROVIDE REVENUE FOR THE PAYMENT OF CURRENT EXPENSES; PROVIDING FOR AN INTEREST AND SINKING FUND FOR ALL OUTSTANDING DEBT OF THE CITY OF ALLEN; PROVIDING FOR DUE AND DELINQUENT DATES TOGETHER WITH PENALTIES AND INTEREST; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Mayor Pro Tern Schulmeister and a second by Councilmember Trahan, the Council voted four (4) for with Mayor Fulk, Mayor Pro Tern Schulmeister, and Councilmembers Clemencich and Trahan voting in favor and three (3) opposed with Councilmembers Meis, Cornette, and Shafer casting the negative votes, to adopt a tax rate of $0.429, and adopt Ordinance No. 3942-9-22, as previously captioned, setting that tax rate for the Fiscal Year 2022-2023. The motion failed. Per State law, if a proposed tax rate exceeds the no-new-revenue tax rate, at least 60 percent of the governing body must vote in favor of the ordinance by a record vote. Mayor Fulk recessed the Regular Meeting at 11:16 p.m. and reconvened the Regular Meeting at 11:26 p.m. Mayor Fulk, with the concurrence of the Allen City Council, set aside the rule governing the standard time of adjournment. MOTION: Upon a motion made by Mayor Pro Tern Schulmeister and a second by Councilmember Clemencich,the Council voted seven(7) for and none(0) opposed,to reconsider the previous vote to approve the City Manager's original budget of$305,102,552 and approve Ordinance No. 3941-9-22, as previously captioned, approving the Fiscal Year 2022-2023 budget, amending the Fiscal Year 2021-2022 budget, and approving the 2023-2027 Capital Improvement Program. The motion carried. MOTION: Upon a motion made by Mayor Pro Tem Schulmeister and a second by Councilmember Clemencich,the Council voted six(6)for with Mayor Fulk,Mayor Pro Tern Schulmeister,and Councilmembers Clemencich, Cornette, Shafer, and Trahan voting in favor and one (1) opposed with Councilmember Meis casting the negative vote, to approve a budget of $302,652,181 which is a .055 percent increase, and to approve Ordinance No. 3941-9-22, as previously captioned, approving the Fiscal Year 2022-2023 budget, amending the Fiscal Year 2021-2022 budget, and approving the 2023-2027 Capital Improvement Program. The motion carried.
