R-3781-9-20 RESOLUTION NO.3781-9-20(R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING THE CREATION OF THE COVID-19 EMERGENCY UTILITY ASSISTANCE PROGRAM TO PROVIDE RELIEF FOR ALLEN RESIDENTS FACING FINANCIAL HARDSHIP DUE TO COVID-19; AUTHORIZING THE USE OF CARES ACT COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS (CDBG-CVFUNDS)FOR THE EMERGENCY UTILITY ASSISTANCE PROGRAM; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE;AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) authorized Community Development Block Grant Coronavirus funds(CDBG-CV Funds)to be made available from the United States Department of Housing and Urban Development(HUD)to be allocated to prevent,prepare for, and respond to the COVID-19 Pandemic; and, WHEREAS,the City of Allen has been allocated CDBG-CV Funds in the amount of$256,477; and, WHEREAS,in response to the growing effects of the COVID-19 Pandemic,including loss of income resulting in financial hardships in the Allen community,the City Council desires to implement the COVID-19 Emergency Utility Assistance Program using the CDBG-CV Funds to assist households affected by COVID-19. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY,TEXAS,THAT: IISECTION 1. The City Council hereby establishes the COVID-19 Emergency Utility Assistance Program consisting of up to six months of subsistence payments to eligible families to bridge a financial crisis directly related to a COVID-19 financial loss initially consisting of funding for City utility bills. If the funding is not depleted through addressing delinquent City utility bills, then the City will consider providing rent/mortgage and other utility assistance to qualified applicants. Applicants will have to meet federal income eligibility guidelines to qualify and be a resident of Allen; have delinquent City water utility bill that was billed after March 1,2020;demonstrate an income loss related to COVI D-19;meet CDBG program and income eligibility requirements. Assistance is provided for up to 6 months of payments for City delinquent utility accounts (charges of water,wastewater,waste services,drainage,HHW and taxes for utility bill),waiver of late fees and penalties (water charges will be adjusted to full amount of minimum water bill each month and $2.99/1,000 gallons for consumption above 1,500 gallons for monthly water use over 1,500 gallons), and (wastewater charges will be adjusted to the monthly wastewater minimum bill and $1.24 per 1,000 gallons of water use above 1,500 gallons up to the 10,000 maximum amount of water used to calculate wastewater charges). Applications will be made directly to the Community Enhancement Department through a standard application form online or by written application reviewed by Community Enhancement Department for eligibility and to facilitate completion of the application process. SECTION 2. The CDBG-CV Funds shall be used for a Fiscal Year 2020-21 COVID-19 Emergency Utility Assistance Program in accordance with the CARES Act, and applicable CDBG-CV and HUD regulations. SECTION 3. The City Manager of the City of Allen, or designee, is authorized to execute any agreements or certifications on behalf of the City of Allen to implement the COVID-19 Emergency Utility Assistance Program. SECTION 4. All prior Resolutions of the City of Allen,Collin County,Texas,in conflict with the provisions of this Resolution, be and the same are hereby repealed; provided, however, that all other provisions of said Resolutions not in conflict with the provisions of this Resolution shall remain in full force and effect. SECTION 5. Should any word,sentence,paragraph,subdivision,clause,phrase or section of this Resolution, be adjudged or held to be void or unconstitutional,the same shall not affect the validity of the remaining portions of said Resolution, which shall remain in full force and effect. SECTION 6. This Resolution shall take effect immediately from and after its passage, and it is so duly resolved.
