Min - City Council - 1970 - 11/19 - RegularREGULAR MEETING November 19, 1970 City Council, City of Allen Allen, Texas Present: Mayor Frank Dugger Councilmen: Roy Ewen, C.D. Whitaker, Bob Lowman, Mack Holloway & Clifford Hart Motion Bob Lowman Second Roy Ewen that minutes of previous meeting be approved as read by City Secretary. Motion Carried 5 For 0 Against. W.E. Ford appeared before Council and spoke in behalf of the insurance company that he represents assuming the insurance on the Municipal Building and Fire Station when the present policy expires. Mr Ford agreed to contact the McDermott Foundation and find out if they intended to continue paying the premimum on the insurance policy to these buildings. Mr Ford also stated that his Company could write a policy for a period of 3 years on the same coverage that is now held for the sum of $1934.00. Council agreed that this project should be tabled untill the next meeting so as to allow Mr Ford to contact the McDermott's. Mrs Janis Adcock, representing the MYF of the First United Methodist Church, appeared before Council and read a letter from Mrs Margaret McDermott in regard to this organization planting a live evergreen tree to be used as a community Christmas tree, Mrs McDermott stated in the letter that she felt this to be a worthwhile project and also that the apporiate site would be at the New Municipal Building location. Mrs McDermott also asked that she be allowed to contact the Contractor that done the landscaping on the present facilities as to his reccomend- ation as to the site and the type of tree to plant, At this time Mrs Adcock had not heard from the landscaper, but she asked Council if December 6 at 8:30 P.M. would be an appropiate time to have a community lighting of the tree. Council gave their approval of this date and time provided everything could be worked out and the tree planted. Mayor Dugger informed Council that the base work on the streets was almost Com- pleted. Council agreed, upon the reccommendation of the contractor and other qualified people, that the topping of the streets should be postponed until the winter season is over. William H. Dean, Jr. appeared before Council to protest the dismissial of Patrolman Dub Martin. Mr Dean stated that he knew Officer Martin before he moved to Allen, that he was a resident of Plano and that Officer Martin was a member of the Plano Police Department. Mr Dean spoke of his belief of the kind of character and qualifications of Officer Martin. Mr Dean asked if he might ask Chief Burton some questions about why Officer martin was Discharged. Mayor Dugger informed him that he might do so. Question No.1 by Mr Dean, Was it because of Officer Martin's dogs running loose the only reason that he was fired? Answer by Chief Burton, It was. Question No.2 by Mr Dean, Was Officer Martin fired because he gave one of our most respected citizens sons a ticket? Mayor Dugger answered at this point and assured Mr Dean that this was not so. That the City intended to fight this case in court if necessary and do anything that was possible to bring about a conviction on this case; Mayot Dugger also stated that there never had been a ticket torn up under his administeration and also that as long as he held office there never would be one torn up or excused. Officer Dub Martin appeared before Council and asked that Council have Chief Burton reinstate him to his job if the only reason that he was dismissed was 25 because of his dogs running loose. Officer Martin did not think this to be sufficient reason for his dismissial. George W. Martin appeared before Council and spoke in high regard for the Allen Police Department, Chief Burton and also Officer Martin. He praised Chief Burton for the good job that he thought that he was doing and also he felt that Officer Martin was a fine Officer. Mr Martin asked if some solution could be worked out so that Officer Martin could be reinstated to his job, Mayor Dugger asked Chief Burton if he would like to speake at this time. Chief Burton stated that he had made an explanation to Mr. Dean and also to Officer Martin and if the Council did not want a public explanation on the matter he would not make one; however Chief Burton stated that he wanted it to be made as Public Record that the only reason that he dismissed Officer Martin was that his dog was running loose after he had been told several times to keep them chained or penned. Chief Burton also stated that as long as Officer Martin or any other employee of the Police Department worked for the City of Allen that he expected them to obey his orders. Chief Burton also asked that it be made a part of the record that he felt no animosity or had any hard feelings toward Officer Martin. Mayor Dugger expressed his appreciation to Mr Dean, Mr Geo. Martin and Officer Martin for coming to the Council and expressing their views on this matter. Council voted to uphold the dismissial of Officer Martin and gave Chief Burton a full vote of Confidence. Tom Hunsaker appeared before Council add asked permission to move a Skating Rink for a period of 5 or 6 months, the location to be at the intersection of South Dogwood Drive and East McDermott Drive. Council gave Mr. Hunsaker permission to open the rink if it did not conflict with any of the City's Ordinances. Council discussed the request for a Salary increase from Water Supertendent Eugene Ereckson. Council voted that Mr. Erecksons request be denied at this time. Motion Clifford Hart Second Bob Lowman that the fee for a water tap and meter setting be increased to $80.00. Motion Carried 5 For 0 Against. Motion Bob Second C.D. Whitaker that W.A. Eubanks be employed to set all water meters for the City at a price of $7.50 per meter set. Motion Carried 5 For 0 Against. Motion Bob Lowman Second Roy Ewen that bills presented be approved, Motion Carried 5 For 0 Against. Motion C.D. Whitaker Second Bob Lowman that meeting be adjourned. Motion Carried 5 For 0 Against.
