O-1409-3-96ORDINANCE NO. 1409-3-96 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING COMPREHENSIVE ZONING ORDINANCE NO. 829-11-87, AS PREVIOUSLY AMENDED, TO CHANGE THE ZONING FROM RESIDENTIAL -4, MULTIFAMILY -2, OFFICE, AND PLANNED DEVELOPMENT NO. 21 TO A MIXED USE FLOOD PLAIN -PLANNED DEVELOPMENT NO. 58 (FP -PD -58) INCLUDING SHOPPING CENTER, SINGLE FAMILY, MULTI -FAMILY AND COA04UNITY FACILITIES ON THE FOLLOWING -DESCRIBED TRACT OF LAND: APPROXIMATELY 457.9 ACRES OF LAND OUT OF THE HENRY WEI'SEL SURVEY, ABSTRACT NO. 1026, THE L. K. PEGUES SURVEY, ABSTRACT NO. 702, THE LEWIS WEI'SEL SURVEY, ABSTRACT NO. 978, AND THE JAMES REED SURVEY, ABSTRACT NO. 758, CITY OF ALIEN, COLLIN COUNTY, TEXAS; PROVIDING FOR EXHIBIT 'A' LAND USE PLAN; PROVIDING FOR EXHIBIT 'B" AREA AND USE REGULATIONS AND EXHIBIT "C" LEGAL DESCRIPTION, PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS (52,000.00) FOR EACH OFFENSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR THE EFFECT DATE OF SAID ORDINANCE WHEREAS, the Planning and Zoning Commission of the City of Allen, and the governing body of the City of Allen, in compliance with the laws of the State of Texas and the ordinances of the City of Allen, have given the requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all the property owners generally and to all persons interested and situated in the affected area and in the vicinity thereof, and in the exercise of its legislative discretion, have concluded that Comprehensive Zoning Ordinance No. 829-11-87, as previously amended, should be revised. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, THAT: SECTION 1: Comprehensive Zoning Ordinance No. 829-11-87, as previously amended, be and the same is hereby revised by changing the zoning classification from Residential -4, Multi -family -2, Office and Planned Development No. 21 to a mixed use Flood Plain -Planned Development No. 58 (FP -PD -58) that includes Shopping Center, Single Family, Multi -family and Community Facilities on the following tract of land: approximately 457.9 acres of land out of the Henry Wetsel Survey, Abstract No. 1026, the L. K. Pegues Survey, Abstract No. 702, the Lewis Wetsel Survey, Abstract No. 978, and the James Reed Survey, Abstract No. 758, City of Allen, Collin County, Texas. SECTION 2. The approved Land Use Plan and Development Standards, attached hereto as Exhibits "A" and "B," respectively, and made a part hereof for all purposes, shall be adhered to in their entirety. SECTION 3: The property described in Exhibit "C," legal description, attached hereto and made a part hereof for all purposes, shall be used in the manner and for the purposes provided for as approved herein. SECTION 4: All ordinances of the City of Allen in conflict with the provisions of this ordinance shall be, and the same are hereby, repealed; provided, however, that all other provisions of said ordinances not in conflict herewith shall remain in full force and effect. SECTION 5: Any person, firm, or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in Comprehensive Zoning Ordinance No. 829-11-87 of the City of Allen, as previously amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense. SECTION 6: It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause, sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council hereby declares it would have passed the remaining portions even though it had known the affected parts would be held unconstitutional. SECTION 7: This ordinance shall take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained. APPROVED: oe Farmer, MAYOR APPROVt'O AS TO FORM: ATTEST: Ordinance No. 1409-3-96 Page 2 Ordinance No. 1409-3-96 Enhibit "B" REQUEST FOR A PLANNED DEVELOPMENT DISTRICT 462.1 ACRE TRACT NORTH AND SOUTH OF EXCHANGE PARKWAY, BETWEEN U.S. 75 AND GREENVILLE AVENUE TRACT 1 SC 28.7±AC 18.2±AC F.P. 10.5±AC NET PURPOSE: Tract 1 was originally zoned as part of P.D. 21. This tract contained 30.5 acres and was zoned for Commercial uses. This district permitted such uses as boat sales, office showroom, wholesale establishments, and various industrial uses by specific use permit. This request is to establish Shopping Center District zoning to allow for retail development to provide the basic retail services for the neighborhood residents, park users, school students and staff as well as to take advantage of the visibility and accessibility from Central Expressway and Exchange Parkway. The uses allowed in the SC district would be permitted, plus drive-in restaurants, service stations, hotel/motel, and auto sales and repair (new and used), which would be appropriate along this freeway. GENERAL REGULATIONS: The development of this property shall be in accordance with the provisions of the "SC" Shopping Center District Regulations as set forth in Section 3.01(P) of the Allen Comprehensive Zoning Ordinance #829-011-87, except as specifically provided herein: a. Permitted Uses: All uses permitted in the SC District plus drive-in restaurants, service stations, hotel/motel, and auto sales and repair (new and used). TRACT 2 MF 47.2± AC 7.8± AC F.P. 2.2±ACR.O.W. 37.2± NET PURPOSE: L.L.G.'s land holdings in this area, included a 33.5 acre tract zoned W-2, along Greenville Avenue. This tract is not appropriate for higher density single family given its linear CAWPFM Ec\AUEMREASONS.ZON Febwry 16,1996 configuration as well as its proximity to existing and proposed single family developments. This request is to relocate this MF -2 to an area which is more appropriate for this use. The proposed 40.7 acre tract is located between the Southern Pacific Railroad track and flood plain and a proposed residential collector street. This property is planned for higher density residential development to provide for a buffer between the proposed single family to the east and the railroad, planned retail uses and Central Expressway to the west. This tract will also be separated from single family by the proposed collector street. This street as well as Exchange Parkway will provide adequate access to the multifamily planned for this area. GENERAL REGULATIONS: The development of this property shall be in accordance with the provisions of the Multi -family - 2 Residential "MF -2" District Regulations as set forth in Section 3.01(n of the Allen Comprehensive Zoning Ordinance #829-011-87. The open space requirements of Section 3.01(x) 4. of the Zoning Ordinance will be complied with. TRACT 3 SF -1 73.0± AC 2.1f AC F.P. 2.2 f AC R.O.W. 68.7±AC NET PURPOSE: Tract 3 is being planned for "conventional' single family based on the R-5 District regulations. However, given current market demands for homes in this area, additional conditions are being requested. The R-5 District requires the minimum house size to be 1,200 square feet. This request is to increase minimum house size to 1,600 square feet, with an average house size of 1,700 square feet. The R-5 district currently requires a lot width of 65 feet, depth of 110 feet and a minimum lot size of 7,500 square feet. To provide for maximum flexibility in lotting arrangements, a minimum lot width of 62 feet is being requested, and a minimum depth of 115 feet. However, in no event shall a lot be less than 7,500 square feet. GENERAL REGULATIONS: The development of this property shall be in accordance with the provisions of the R-5 District Regulations as set forth in Section 3.01(3) of the Allen Comprehensive Zoning Ordinance #829-011-87, except as specifically provided herein; a. Lot Width: - The width of the lot shall be not less than sixty-two feet at the front street building line, nor shall its average width be less than sixty-two(62) feet. b. Minimum Dwelling Unit Size: The minimum floor area of any dwelling shall be 1,600 square feet, with an average house size of 1,700 square feet. C. The open space requirements of Section 3.01(x) 4. of the Zoning Ordinance will be complied with. 2 CAWPFILMALLENUZEASONS.ZON February 15, 1996 TRACT 4 SF -2 20.1±AC 3.3fAC F.P. 16.8±AC NET PURPOSE: This 20.1 acre tract is currently zoned for office uses. This request is to establish appropriate zoning to allow for the development of approximately 84 Garden Homes on this tract. The GH District regulations will be adhered to except that the required minimum house size of 1,000 square feet is being requested to be increased to a minimum of 1,300 square feet, with a minimum average of 1,400 square feet. GENERAL REGULATIONS: The development of this property shall be in accordance with the provisions of the GH District Regulations as set forth in Section 3.01(F) of the Allen Comprehensive Zoning Ordinance #829-011-87, except as specifically provided herein; a. Minimum Dwelling Unit Size: The minimum floor area of any dwelling shall be 1,300 square feet, with an average house size of 1,400 square feet. b. The open space requirements of Section 3.01(x) 4. of the Zoning Ordinance will be complied with. TRACT 5 SC 14.7±AC PURPOSE: Tract 5 is currently zoned for office and shopping center uses. The purpose of this request to expand the SC zoning to 14.7 acres which will allow the development of neighborhood serving retail at this intersection of two major thoroughfares. The depth of this SC district has been designed to allow for access from eastbound Exchange Parkway via a median opening. TRACT 7 CF 177.9 ±AC 8.1 ±AC F.P. 169.8fAC NET (AI.S.D.) PURPOSE: AI. S.D. is in the process of acquiring this tract for the development of middle and high school and related facilities to serve this area of the City of Allen. Under the existing zoning, this property could be developed for 1,322 dwelling units, over 60% of which would be apartment units.
