AN ORDINANCE adopting and levying a sales and use tax
authorized by Vernon's Ann. Civ. St., Article
5190.6, Section 4B, as amended; resolving other
matters incident and related thereto; and providing
an effective date.
WHEREAS, in accordance with the provisions of Vernon's Ann.
Civ. St., Article 5190.6, Section 4B, as amended (the "Act") and
V.T.C.A., Tax Code, Chapter 321, an election was held in the City
of Allen, Texas on May 4, 1996, to submit the question on the levy
and collection of an additional one-half of one percent sales and
use tax within the City of Allen pursuant to the Act for use and
application in the manner and to the purposes authorized by Section
4B of the Act; and
WHEREAS, on the 9th day of May, 1996, the City Council adopted
a resolution canvassing the returns of such election and declaring
the total number of votes cast "FOR" such proposition was 763 and
the total number of votes cast "AGAINST" such proposition was 511,
and the number of votes by which the proposition was approved was
252; and
WHEREAS, the City Council of the City hereby finds and
determines that provision should be made for the imposition and
levy of the sales and use tax authorized pursuant to the "Act and
approved by voters at the aforesaid election; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS:
SECTION 1: There shall be and is hereby imposed, adopted and
levied an additional sales and use tax within the City pursuant to
authority conferred by the Act at a rate of one-half of one percent
on the sales of items at retail and a use tax at the same rate on
the use, storage or other consumption within the City of Allen,
Texas of tangible personal property purchased, leased or rented
from a retailer during such time as such tax is effective within
the City. Such tax shall be imposed, computed, administered,
collected and remitted in accordance with V.T.C.A., Tax Code,
Chapter 321, except as inconsistent with Section 4B of the Act.
SECTION 2: The City Secretary is hereby authorized and
directed to immediately notify the Comptroller of Public Accounts
in the manner required by V.T.C.A., Tax Code, Section 321.405 of
the imposition, adoption and levy of the additional sales and use
tax within the City of Allen, Texas by causing a certified copy of
the resolution canvassing the returns and declaring the result of
the sales and use tax election held May 4, 1996, together with a
map of the City and a copy of this Ordinance, to be sent to the

ORDINANCE NO. 1433-6-96
Comptroller of Public Accounts, and upon such notification to the
comptroller occurring prior to June 30, 1996, the additional sales
and use tax approved at said election and imposed, adopted and
levied by this Ordinance shall take effect within the City on
October 1, 1996, as provided in the Act and V.T.C.A., Tax Code,
Section 321.102(b).
SECTION 3: It is officially found, determined, and declared
the meeting at which this Ordinance is adopted was open to the
public and public notice of the time, place, and subject matter of
the public business to be considered at such meeting, including
this Ordinance, was given, all as required by V.T.C.A., Government
Code, Chapter 551, as amended.
SECTION 4: This Ordinance shall be in force and effect from
and after its passage on the date shown below and it is so
ordained.
