O-1503-6-97CITY OF ALLEN THE STATE OF TEXAS § COUNTY OF COUJN § CITY OF ALLEN § This amendment (Ordinance No. 1503-6-97) to the Code of Vehicle and Traffic Ordinances (Ordinance No. 259) has been duly adopted by the governing body of the City of Allen on this 5th day of June, A.D., 1997, in the manner required by law and does hereby amend Chapter 9, Article IX, Division 2 of the Allen Code of Ordinances and Article XI, Division 2 of the Allen Vehicle and Traffic Code, also known by its short title of "Allen Traffic Ordinances," and shall become effective immediately from and after its passage and publication`as required by law. Mayor, City of Allen, Texas ATTEST: (S'L Ci ecre ,City of Allen, Texas ONE BUTLER CIRCLE ALLEN, TEXAS 75002 214/727-0100 ORDINANCE NO. 1503-&97 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING CHAPTER 9, "MOTOR VEHICLES AND TRAFFIC," ARTICLE IX, "STOPPING, STANDING AND PARING GENERALLY," DIVISION 2, "PROHIBITED IN SPECIFIED PLACES," OF THE ALLEN CODE OF ORDINANCES AND ARTICLE XI, DIVISION 2, OF THE ALLEN VEHICLE AND TRAFFIC CODE, ORDINANCE NO. 259, AS PREVIOUSLY AMENDED, BY ADDING A SECTION PROHIBITING PARKING OF MOTOR VEHICLES ON A CERTAIN SECTION OF RIVERCREST BOULEVARD WITHIN THE CITY LIMITS OF THE CITY OF ALLEN, DECLARING IT UNLAWFUL AND A MISDEMEANOR TO PARK MOTOR VEHICLES UPON SAID PORTIONS OF SAID ROADWAY WITIHN THE LIMITS HEREIN DEFINED; PROVIDING A REPEALER CLAUSE; PROVIDING FOR A PENALTY, PROVIDING FOR AN DATE; AND PROVIDING FOR PUBLICATION OF THE CAPTION. WHEREAS, the City Council of the City of Allen finds it necessary to prohibit parking of motor vehicles along and upon certain sections of Rivercrest Boulevard within the city limits of the City of Allen, in order to provide for the safety of the general public within the area; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1: Chapter 9, "Motor Vehicles and Traffic," Article V, "Operation of Vehicles," Division 2, "Speed Regulations," of the Allen Code of Ordinances and Ordinance No. 259, as previously amended, of the City of Allen, Texas, and particularly Article XI, Division 2, of the Allen Vehicle and Traffic Code, are hereby amended to add a new Section 9-247 (Section 1-80.1 of the Allen Vehicle and Traffic Code) as follows: Sec. 9-247. Specified roadways during school days. "Parking shall be prohibited along and upon the north and south sides of Rivercrest Boulevard, from its intersection with Roaring Springs Drive easterly to its intersection with Sandy Creek Drive, from 7:00 a.m. to 9:00 a.m. and 2:00 p.m. to 4:00 p.m. on school days. School days is defined as each Monday through Friday throughout the calendar year when the school nearest the area defined in this section is in session." SECTION 2: The Traffic Engineer of the City of Allen is hereby authorized and directed to cause placement of traffic control signs at each approach to the portions of the roadway described herein, and said sign shall give notice to all persons of the prohibition against parking this area. SECTION 3: Any violation of the provisions of Article XV shall be punishable by a fine not to exceed Five Hundred Dollars ($500.00) and each day such violation shall continue shall constitute a separate offense. SECTION 4: If any provision, section, subsection, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances is for any reason held to be unconstitutional, void or invalid, the validity of the remaining portions of this ordinance or their application to other persons or sets of circumstances shall not be affected thereby, it being the intent of the City Council in adopting this ordinance that no portion thereof, or provision, or regulation contained herein shall become inoperative or fail by reason of any unconstitutionality of any other portion hereof and all provisions of this ordinance are declared to be severable for that purpose. SECTION 6. This ordinance shall take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained.
