AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING
SECTIONS 6-85(h), 9-151, AND 9-206 TO REPLACE THE PHRASE “CENTRAL
BUSINESS DISTRICT” WITH THE PHRASE “DOWNTOWN DISTRICT” AND
AMENDING CHAPTER 9 “MOTOR VEHICLES AND TRAFFIC,” SECTION 9-2
“DEFINITIONS” BY DELETING THE DEFINITION FOR “CENTRAL BUSINESS
DISTRICT” AND ADDING A DEFINITION FOR THE PHRASE “DOWNTOWN
DISTRICT”; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING
CLAUSE; PROVIDING A PENALTY OF FINE IN ACCORDANCE WITH SECTION 1-4
OF THE CODE OF ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Allen, Texas (“City Council”) has adopted an ordinance
amending the Allen Land Development Code (“ALDC”) to adopt renaming the zoning district known as the
“Central Business District” to be now known as the “Downtown District” and amending the development and
use regulations for property within the Downtown District; and,
WHEREAS, the City Council finds it to be in the public interest to amend various provisions of the Code of
Ordinances to conform to the amendments to the ALDC.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The Code of Ordinances of the City of Allen, Texas, be, and the same is hereby amended by
replacing the phrase “Central Business District” with the phrase “Downtown District” where the phrase
“Central Business District” appears in the caption and/or text of the following sections:
A. Section 6-85 (h);
B. Section 9-151; and,
C. Section 9-206.
SECTION 2. The Chapter 9 “Motor Vehicles and Traffic,” Section 9-2 “Definitions” of the Code of
Ordinances of the City of Allen, Texas, be, and the same is hereby amended by deleting the definition of the
phrase “Central Business District” and adding a definition for the phrase “Downtown District” to read as
follows:
Downtown District means the area within the city located within the boundaries of the
Downtown District “DD” as set forth on the city's zoning district map as adopted and
amended from time to time pursuant to the Allen Land Development Code.
SECTION 3. Should any word, sentence, paragraph, subdivision, clause, phrase, or section of this
Ordinance, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the
remaining portions of said Ordinance, as amended hereby, which shall remain in full force and effect.
SECTION 4. All ordinances of the City of Allen, Collin County, Texas, in conflict with the provisions of
this Ordinance be, and the same are hereby, repealed; provided, however, that all other provisions of said
ordinances not in conflict with the provisions of this Ordinance shall remain in full force and effect.
