A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS, SUSPENDING THE OPERATION OF PROPOSED RATE INCREASE
SCHEDULES FILED BY LONE STAR GAS COMPANY, A DIVISION OF
ENSERCH CORPORATION, FOR A PERIOD OF ONE HUNDRED TWENTY
(120) DAYS BEYOND THE DATE OF WHICH SUCH SCHEDULES WOULD
OTHERWISE GO INTO EFFECT.
WHEREAS, Lone Star Gas Company, a Public Utility under
Article 6050, et. seq. V.A.C.S. and Article 1446C of Vernon's
Annotated Civil Statutes (Supplement 1976) did on March 19, 1981,
file a schedule of rates for gas service within the City of Allen
to become effective April 24, 1981; and,
WHEREAS, the City of Allen acting under the Constitution and
Laws of the State of Texas and under the Charter of the City does
have authority to regulate public utility rate requests; and,
WHEREAS, after having reviewed the materials presented to the
Council and having heard the presentation of Lone Star Gas Company,
it is the opinion of the City Council of the City of Allen, that
such schedule of rates should be suspended for a period of 120 days
from April 24, 1981, for further study, investigation, presentation
of evidence, and public hearing.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS, THAT:
Section 1. Pursuant to Section 43(D) of the Public Utility
Regulatory Act, the operation of the Lone Star Gas Company's proposed
rate schedules filed with the City of Allen, March 19, 1981, is
hereby suspended for a period of One Hundred Twenty (120) days from
April 24, 1981 for further study, investigation, presentation of
evidence, and public hearing.
Section 2. The City Secretary is directed to provide a copy
of this resolution to Lone Star Gas Company after passage.
