A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS,
AUTHORIZING THE EXECUTION OF CERTAIN CONTRACTS CONCERNING THE
CONSTRUCTION AND RECONSTRUCTION OF A PORTION OF BETHANY ROAD
IN THE CITY OF ALLEN.
WHEREAS, the City of Allen is in the process of acquiring, by
dedication, certain tracts of land for the purpose of
realigning Bethany Road, between U. S. Highway 75 and
the Southern Pacific Railroad Tracks, in Allen, Texas;
and,
WHEREAS, the City Council has determined that this portion of
Bethany Road should be constructed and reconstructed
to current City specifications; and,
WHEREAS, the City Council has authorized the preparation of
engineering drawings for such construction and recon-
struction, reviewed and approved the specifications,
and authorized the solicitation of bids on this and
other projects; and,
WHEREAS, the abutting property owners are desirous that the
City undertake this project; and,
WHEREAS, the abutting property owners have stated their intent
to pay their proportional share of such construction
and reconstruction; and,
WHEREAS, it is in the best interest of the City that such
abutting property owners enter into a contract with
the City of Allen contractually committing them to
the payment for their proportional share and to insure
that proper payments will be made in accordance with
construction schedules;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS, THAT:
The City Council of the City of Allen authorizes the
City Manager to execute, in their behalf, such contracts
between the City of Allen and Exxon Corporation and
Charles A. Forbes, Trustee, committing these abutting
property owners to pay their proportional share of such
construction and reconstruction based upon a payment
schedule to be delineated in the contract.
