A RESOLUTION OF THE CITY COUNCIL, CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AGREEMENT, A RELEASE OF LIEN, AND OTHER DOCUMENTS ASSOCIATED
WITH THE PARTIAL PAYMENT OF A PAVING ASSESSMENT ON PROPERTY
LOCATED AT THE SOUTHEAST INTERSECTION OF S.H. 5 AND EXCHANGE
PARKWAY.
WHEREAS, on November 14, 1979, Brian P. Crow did
execute a contract, a real estate lien note and a deed of
trust in favor of the City of Allen, with respect to a
paving assessment on his property located at the southeast
corner of the intersection of Exchange Parkway and S.H. 5;
and,
WHEREAS, on January 5, 1984, Mr. Crow requested that
the City Council approve a site plan and preliminary and
final plat on a portion of that property stating that all
assessments, interest, taxes, and other pending obligations
would-be paid from the proceeds of that sale; and,
WHEREAS, subsequent to that City Council action, Mr.
Crow has requested to be allowed to make a partial payment
on the paving assessment and in return he would execute a
real estate lien note and a deed of trust on the remainder
of the property in favor of the City of Allen.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ALLEN, TEXAS.
SECTION 1. The City Manager is hereby authorized to execute
an agreement, a release of lien, and any other documents
associated with the partial payment of a paving assessment
by Mr. Brian P. Crow.
SECTION 2. The City Manager is also directed to secure a
lien on the remaining approximate 4 acres of land to secure
the remainder of the paving assessment.
