O-3986-2-23ORDINANCE NO. 3986-2-23 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP, AS PREVIOUSLY AMENDED, BY AMENDING THE REGULATIONS RELATING TO THE USE AND DEVELOPMENT OF 7.459+/- ACRES OUT THE RUFUS SEWALL SURVEY, ABSTRACT NO. 875; PRESENTLY LOCATED IN PLANNED DEVELOPMENT “PD” NO. 4 SHOPPING CENTER ADOPTING A ZONING EXHIBIT, DEVELOPMENT REGULATIONS, A CONCEPT PLAN, BUILDING ELEVATIONS, AND A LANDSCAPE PLAN; PROVIDING FOR A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen, Texas, in compliance with the laws of the State of Texas and the ordinances of the City of Allen, Texas, have given the requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all the property owners generally and to all persons interested and situated in the affected area, and in the vicinity thereof, and in the exercise of its legislative discretion, have concluded that Allen Land Development Code Zoning Regulations and Zoning Map of the City of Allen, Texas, as previously amended, should be amended. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. The Allen Land Development Code Zoning Regulations and the Zoning Map of the City of Allen, Collin County, Texas, as previously amended, are hereby further amended by amending as set forth in Section 2, below, the regulations relating to the development and use of 7.459+/- acres out of the Rufus Sewall Survey, Abstract No. 875, City of Allen, Collin County, Texas, more fully described and depicted in Exhibit “A,” attached hereto and incorporated herein by reference (the “Property”), which is presently zoned as Planned Development “PD” No. 4 Shopping Center. SECTION 2. The Property shall be developed and used in accordance with the provisions of the Allen Land Development Code, as amended, (“ALDC”) and Planned Development “PD” No. 4 as set forth in Ordinanc e No. 369-10-81, as amended, except to the extent modified below: A. CONCEPT PLAN: The Property shall be developed in general conformance with the Concept Plan attached hereto as Exhibit “B” and incorporated herein by reference (the “Concept Plan”). B. LANDSCAPE PLAN: The installation of landscaping and related irrigation system shall be installed in general conformance with the Landscape Plan attached hereto as Exhibit “C” and incorporated herein by reference (the “Landscape Plan”) prior to the issuance of a certificate of occupancy for any building constructed on the Property. C. BUILDING ELEVATIONS: The buildings constructed on the Property shall be designed and constructed to appear in general conformance with the Building Elevations attached hereto as Exhibit “D” and incorporated herein by reference (the “Building Elevations”). ADDITIONAL USES: In addition to the uses for which property located within a Shopping Center “SC” district may be developed by right or following approval of a specific use permit pursuant to ALDC Section 4.20.2, Buildings “A” and “B,” as depicted on the Concept Plan, may be developed and used for the following uses: (1) Permitted Uses: The following uses shall be permitted. (a) Electronic Manufacturing and Assembly (b) Apparel and Related Manufacturing (c) Drugs and Pharmaceutical Manufacturing (d) Gymnastics and Sports Training Facility (e) Pest Control Service (f) Service Contractor (2) Specific Use Permit: The Property may be used and developed for Light Manufacturing upon approval of a Specific Use Permit for such use. E. HEIGHT, AREA, AND SETBACK REGULATIONS: Buildings constructed on the Property shall comply with the height, area, and setback regulations of the Shopping Center (SC) District except as follows: (1) Rear Setback: Lots adjacent to a single-family neighborhood shall have a rear yard setback of not less than 40 feet as shown on the Concept Plan. (2) Landscape Buffer: Installation of a 40-foot landscape buffer adjacent to the single-family neighborhood located adjacent to the east boundary of the Property, as shown on the “Concept Plan” shall be completed prior to issuance of a certificate of occupancy for any building constructed on the Property. No more than 10 feet of the width of said landscape buffer shall be encumbered by utility, drainage, or other easements; provided, however, such encumbrance restriction shall not include the width of any fire access hammerhead. F. SCREENING STANDARDS: All landscape buffers, tree placement, parking tree requirements, and screening shall comply with applicable provisions of the ALDC except as follows: (1) Screening is required to be installed within the 40-foot rear yard setback and landscape buffer in general conformance with the Landscape Plan prior to the issuance of a certificate of occupancy for any building constructed on the Property. (2) The end of parking rows within the interior truck court shall not be required to be constructed with parking lot islands as shown on the Concept Plan. (3) The number of parking lot trees required to be planted within the interior truck court may be reduced by one for every one tree planted elsewhere on the Property in addition to the trees already required to be planted at other locations on the Property. (4) Mechanical and Service Screening shall be required as follows: Ordinance No. 3986-2-23, Page 3 (a) All buildings shall be designed such that no mechanical equipment (HVAC, etc.) is visible from any public street or alley, open space, or adjacent property; whether the equipment is located on the ground, exterior wall, or roof; (b) Rooftop mechanical equipment must be screened by a parapet raised at least one foot above the top of the mechanical equipment; and (c) All ground mounted mechanical equipment will be screened with opaque fencing, masonry wall, or landscaping in the form of one shrub planted every four linear feet around the boundary of equipment, each such shrub being not less than five-feet tall at time of planting. G. DEVELOPMENT PHASING: No Certificate of Occupancy shall be granted for Building A or Building B as designated on the Concept Plan until Commencement of Construction has occurred on Building C, Building D, and Building E as designated on the Concept Plan. For purposes of this Section 2.G, the phrase "Commencement of Construction" with respect to a building means (i) the plans have been prepared and all approvals thereof required by applicable governmental authorities have been obtained for construction of the building; (ii) all necessary permits for the construction of the building have been issued by the applicable governmental authorities; and (iii) construction of the building slab is complete and construction of the vertical elements of the building has commenced. SECTION 3. To the extent of any irreconcilable conflict with the provisions of this Ordinance and other ordinances of the City of Allen governing the use and development of the Property and which are not expressly amended by this Ordinance, the provisions of this Ordinance shall be controlling. SECTION 4. Should any word, sentence, paragraph, subdivision, clause, phrase or section of this Ordinance, or of the Allen Land Development Code Zoning Regulations, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Allen Land Development Code Zoning Regulations, as amended hereby, which shall remain in full force and effect. SECTION 5. An offense committed before the effective date of this Ordinance is governed by prior law and the provisions of the Allen Land Development Code Zoning Regulations, as amended, in effect when the offense was committed, and the former law is continued in effect for this purpose. SECTION 6. Any person, firm or corporation violating any of the provisions or terms of this Ordinance shall be subject to the same penalty as provided for in Allen Land Development Code Zoning Regulations of the City of Allen, as previously amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000) for each offense. SECTION 7. This Ordinance shall take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained.
