R-588-2-85RESOLUTION NO. 588-2-85(R) A RESOLUTION OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS OPPOSING THE RETROACTIVE RATE INCREASES IMPLEMENTED BY GENERAL TELEPHONE COMPANY OF THE SOUTHWEST ON FOREIGN- EXCHANGE LINES AND REQUESTING THAT THE PUBLIC UTILITIES COMMISSION VACATE THEIR ORDER ALLOWING THESE RATE CHANGES. WHEREAS, The City of Allen became aware of rate changes being imposed by General Telephone Company of the Southwest that have the net effect of substantially increasing the rates charged to customers using foreign exchange lines; and, WHEREAS, City Council has become aware that the Public Utilities Commission did not approve a rate increase for General Telephone Company but only allowed adjustments in certain tariffs; and, WHEREAS, Before any rate change could be approved by the Public Utilities Commission proper procedure and public hearing would be held at which time interested individuals and others would have an opportunity to comment on those proposed rate changes; and, WHEREAS, No such procedure or public hearing was held on the tariff changes requested by General Telephone Company; and, WHEREAS, It is obvious and clear that General Telephone Company has, through the guise of a tariff change, actually implemented new rates when new rates had not been approved; and, WHEREAS, Adding insult to injury, General Telephone Company has implemented these new rate changes retroactively beginning September 26, 1984; and, WHEREAS, The City Council finds that the public interest has not been served by the procedure used by the Company in securing these new rates; and, WHEREAS, Residents and individuals within the City of Allen have been harmed resulting from the net effect of the rate change increasing telephone bills by as much in some cases as 3000; NOW, THEREFORE, BE IT RESOLVED BY -THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: RESOLUTION NO. 588-2-85(R) Page 2 Section I. The above statements are fully incorporated into this resolution. Section II. The Public Utilities Commission is requested to vacate the new rates implemented by General Telephone Company for foreign exchange lines until proper hearings and procedures have been met. Section III. The PUC should direct that General Telephone Company rescind their present billing and reinstate the old base rate billing charge system and refund any amounts paid by customers in the interim. Section IV. The staff is--directed--to work with -the Texas Municipal League, Public Utilities Commission, or any other groups or individuals to assist in carrying out those items cited in Sections II or III of this resolution.
