R-633-9-85RESOLUTION NO. 633-9-85(R) A RESOLUTION OF THE CITY COUNCIL, THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING AND ACCEPTING THE PROVISIONS OF THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION COMMISSION MINUTE ORDER NO. 83501 AND DIRECTING THAT A COPY OF THIS RESOLUTION BE FORWARDED TO THE APPROPRIATE STATE OFFICIALS. WHEREAS, on June 22, 1985, the voters of the City of Allen did approve all propositions of a bond program; and, WHEREAS, one of the propositions was for the improvement of thoroughfares and roadways within the City of Allen in the amount of $9,970,000; and, WHEREAS, on July 25, 1985, the City of Allen did propose to the Highway Commission that certain state roadways within the City of Allen be improved within the next five year period; and, WHEREAS, through city bond funds, county bond funds and developer contributions, the city agreed to fund certain of those projects; and, WHEREAS, the Highway Commission has by Minute Order No. 83501 approved the proposal of the City of Allen subject to their acceptance of the provisions of the Minute Order, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF ALLEN, THAT: Section 1. By this action, the City Council does accept the provisions calling for the right-of-way acquisition and construction of the projects contained in Minute Order No. 83501. Section 2. The City Secretary is hereby directed to forward copies of this Resolution to appropriate members of the State Department of Highways and Public Transportation, including the Engineer Director and the District Engineer. Furnish all required right of way free of cost and clear of obstructions. 2. Adjust all utilities as necessary. 3. Furnish or provide for all preliminary engineering including construction plans, specifications and estimates, all subject to review and approval by the Department. 4. Provide for all construction. For Projects 9 and 10 - 1. Secure all necessary right of way according to policies of the State Department of Highways and Public Transportation with acquisition proce- dures to be in accordance with applicable Federal and State laws governing the acquisition policies for acquiring real property. Maintain that portion of the work which is its responsibility in accordance with present maintenance agreement and agree to regulate traffic and pre- vent encroachment on the right of way, all in accordance with governing policies and regulations of the Department. The State Department of Highways and Public Transportation will: For Projects 5 through 10 - 1. Prepare construction plans, specifications and estimates. 2. Provide for all construction. For Projects 9 and 10 - 0 1. Participate in the purchase of right of way and provide relocation assistance as may be determined to be eligible under the Relocation Assistance Program. For Projects 1 through 10 - 1. Maintain that portion of the work which is its responsibility in accordance with present maintenance agreement. .�+ Form 330-4 Rev. 5145 COLLIN District No STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION 18 aunty MINUTE ORDER Page of_5 Pages Upon acceptance of the provisions of this Order by the appropriate officials of the City of Allen, the Engineer -Director is directed to enter into contractual agreements for acquisition of the required right of way for Projects 9 and 10, to proceed with development of plans for construction and after the City has fulfilled its respon- sibilities, proceed with construction in the most feasible and economical manner, financing the cost of Projects 5 through 10 in the next appropriate program. It is understood that the City may discharge its construction obligations as outlined heren in any manner as they may elect. If the City desires to construct or let contracts for construction of Projects 1 through 4, the Department will have full authority to inspect, accept or reject all such construction. In the event the City desires the State to include its portion of work in the State's construction contract, the Engineer -Director is hereby authorized to enter into agreement with the City for such work and its cost as may be agreed upon. This Order shall become operative upon acceptance by the City of Allen and if not accepted within 90 days of the date hereof, trhe action herein contained shall be automatically cancelled.
