A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS,
APPROVING AND AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
AGREEMENT WITH THE CITY OF PLANO THAT WOULD ALLOW THE TRANSFER
OF THE 7.5 mgd WATER PIPELINE CAPACITY IN THE NORTH PLANO
PIPELINE TO THE CITY OF PLANO.
WHEREAS, the City of Allen, in June, 1980, contracted with
the North Texas Municipal Water District for 7.5 mgd (million
gallons per day) of water from the "North Plano Pipeline"; and,
WHEREAS, the City of Allen wishes to release this 7.5 million
gallons per day capacity to the City of Plano; and,
WHEREAS, the City of Plano has agreed to accept this
additional water; and,
WHEREAS, upon review and consideration of this matter, the
City Council is of the opinion that the agreement should be
approved and that the City Manager should be authorized to
execute the agreement on behalf of the City of Allen.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS, THAT:
Section 1. The issue of transferring the remaining water
minimums presently contracted for by the City of Allen from
the North Plano Pipeline to the City of Plano has been reviewed
by the City Council and found to be acceptable and in the best
interest of the City of Allen.
Section 2. The City Manager is hereby authorized to execute
an agreement with the City of Plano transferring the 7.5 mgd water
to the City of Plano.
Section 3. This Resolution shall become effective October 1,
1985.

AGREEMENT
THIS AGREEMENT made by and between the CITY OF PLANO, TEXAS,
a home rule municipal corporation (called "Plano"), and the CITY
OF ALLEN, TEXAS, a home rule municipal corporation (called
"Allen").
WHEREAS, in 1980 Allen and the North Texas Municipal Water
District (called "District") entered into an Agreement providing
for Allen to receive 7.5 MGD of water from the "North Plano
Pipeline" (called "Original Agreement"); and
WHEREAS, Allen now has the opportunity to gain another water
distribution access point, which makes Allen's need for the
Original Agreement obsolete; and
WHEREAS, Plano has no objection to accepting Allen's
original obligation to the District to accept 7.5 MGD of water
from the North Plano Pipeline;
NOW, THEREFORE, in consideration of the foregoing and the
mutual promises, covenants and obligations as set forth herein,
Plano and Allen agree as follows:
1. Plano agrees to accept the additional 7.5 MGD of water
at the North Plano Pipeline.
2. The effective date of this Agreement shall be as of the
date of the last signatory hereto.
